Government orders in-depth probe on illegal tunnel

INTERIOR and Local Government Secretary Jesse Robredo ordered Wednesday an investigation on the possible culpability and liability of a lawyer who allegedly intervened on the case of a tunnel that was discovered near the Lumbia City Jail in November 2011.
During his visit in Cagayan de Oro on Wednesday, Robredo said lawyer Robert Raypon of the Public Attorney’s Office (PAO) in El Salvador City, Misamis Oriental, must be investigated on why he took custody of the three persons who were earlier held for questioning by operatives of the Lumbia Police Station.
“We are now investigating why a PAO lawyer of El Salvador intervened on a case in Cagayan de Oro,” Robredo said.
He said he also asked the explanation of authorities in Cagayan de Oro, particularly the Bureau of Jail Management and Penology (BJMP) and the Lumbia Police Station, why they could no longer locate those allegedly involved in the case.
“Sabi ko nga na magsampa na rin ng pormal na reklamo because this is a very serious offense dahil kung nagkataon ay nakatakas ‘yung mga bilanggo na may malaking kasalanan sa bayan,” Robredo said.
City Jail Warden Superintendent Clint Russel Tangeres said they have yet to file an administrative case against Raypon after their investigation, as ordered by Robredo.
On November 15, 2011, jail officers noticed a ridged cable sticking out from the ground near a building inside the city jail and when checked, they discovered an 86-meter tunnel underneath the jail compound.
The two-meter-wide tunnel was almost completed; and if had it reached the jail compound, it would have led directly to the cells of Batang Mindanao, Batman gang and the Reception and Diagnostic Center (RDC) that holds high profile convicts, including two Swedes serving life imprisonment for human trafficking, two Chinese nationals also serving life imprisonment for drug trafficking, and a police officer arrested for rape.
After the illegal digging was discovered, the Lumbia Police City Jail held for questioning at least three persons believed to be involved in the digging.
However, Police Inspector Joel Nacua, station commander of Lumbia Police Station, was forced to release the three after Raypon worked for their release, citing that no case has yet been filed against them.
When asked for comment, Raypon told Sun.Star Cagayan de Oro that he was just contacted by the family of the three apprehended persons to check on their status and why they were arrested.
“They were released since there was no case filed yet at that time. That was only my participation. That’s all I can say,” Raypon said.
Related to this, charges for violation of the National Building Code were filed against Christopher Moreno, the renter of the lot, where the digging was discovered.
Moreno is a resident of Vamenta Subdivision in Barra, Opol, Misamis Oriental, and Consuelo Aberasturi, owner of the lot.
Based on initial investigation, Moreno also uses the name Jewateddy Alforque Alpeche, with address at 4th Street Mega Road Heights in Tubod, Iligan City.
Police said Moreno/Alpeche is a hired contractor and is a known miner in Iligan City.
However, Tangeres said Moreno might be using a fictitious name.
“Ang problema namin ngayon kung lalabas na ang warrant of arrest ay saan namin hahanapin si Moreno dahil fictitious yata yung name at address niya,” he said.
