Court allows Abalos to seek treatment sans order

A PASAY City court allowed Monday former Commission on Elections (Comelec) chairman Benjamin Abalos to seek medical treatment without prior court order in case of emergencies.

nal Trial Court Branch 117 Judge Eugenio dela Cruz, in an order dated March 20, set conditions in granting the former poll official’s request.
One of such conditions is for Abalos’s custodian at the Southern Police District (SPD) to inform the court within four hours after the former Comelec chief is brought to a hospital complete with the findings of the doctors.
The court said the hospital where Abalos shall be brought in or confined should not be more than a radius of 10 kilometers from his place of detention at the SPD headquarters and that he should be guarded by at least four regular policemen from the SPD every time he is brought to the hospital or doctor.
The hospital where Abalos shall be confined is also required to submit a medical report to the court and that in case of routine medical check-up, the SPD shall also secure the court’s written order before he is brought to the doctor.
The court also said that Abalos should be brought back to his detention cell not later than 5 p.m. on the same day he is taken for routine medical check-up.
Dela Cruz is hearing the 11 counts of electoral sabotage charges against Abalos filed by the Comelec in connection with alleged irregularities in the 2007 senatorial polls.
Abalos refused to enter a plea during his arraignment early this month, forcing the court to enter a not guilty plea on his behalf.
On March 7, Abalos through his counsel, Brigido Dulay asked dela Cruz to issue a standing order that would allow his jailers to bring him to the hospital without prior court approval in case of emergencies.
The 77-year-old Abalos has complained of difficulty in breathing and pains in the stomach and jaw and was taken to the SPD clinic on that date.
Last December, he also complained of stomach pains and high blood pressure. His family said he is suffering from gastric ulcer. (AH/Sunnex)
