Palace to Pacquiao: Present proof over tax case
MANILA (Updated) — Malacañang urged boxing icon Manny Pacquiao on Monday to present income-related documents before the court handling the contempt case filed against him by the Bureau of Internal Revenue (BIR) in Koronadal City.
Presidential spokesperson Edwin Lacierda made the comment following Pacquiao’s call to President Benigno Aquino III to order the dismissal of BIR Cotabato City Regional Director Rozil Lozares, who filed the case against the Sarangani representative.
Lozares filed the case against Pacquiao for violating Section 266 of the National Internal Revenue Code after the lawmaker allegedly failed to obey summons from the BIR.
Lozares said the tax bureau issued a subpoena duces tecum (or subpoena for production of evidence) in January directing the Sarangani lawmaker to present income-related documents but Pacquiao supposedly failed to appear before the BIR court.
Earlier, BIR Commissioner Kim Henares admitted that the issuance of a summon was prompted by Pacquiao’s “significant drop” of the taxes he paid in the BIR from 2008 to 2010.
In 2008, Pacquiao was a top individual tax payer, but in 2010, his ranking significantly fell to 113th place in the list of 500 top taxpayers in the country.
Pacquiao dismissed the case filed by the BIR as “pure and simple harassment”.
“I think the case has been (filed) with the court…if it’s already with the court, they should allow the presentation of evidence in court,” Lacierda said.
On Pacquiao’s claim that he already paid taxes in the United States on his bouts there, Lacierda said the government respects the Philippine-US tax treaty.
“He obviously has paid the income tax – the federal income tax in the US for his income abroad,” he said.
However, Lacierda stressed that what the BIR has been looking were those coming from his endorsements in the Philippines.
“My understanding is we’re looking at the local endorsements here in the country,” he said.
Lacierda assured that the government is going after those corrupt officials in the government, including the BIR.
“That’s our policy, our anti-corruption program,” he said.
Henares said the BIR was actually being considerate with Pacquiao since her office only filed contempt charges.
She said the BIR could actually file tax evasion if it wanted to.
Henares urged Pacquiao to just present to the BIR the documents being asked from him.
The provision on “failure to obey summons” provides penalties to persons who refuses “to appear, to testify, or to appear and produce books of accounts, records, memoranda or other papers, or to furnish information as required under the pertinent provisions of this Code.”
Should the boxing champion be found guilty of the charges pending before the prosecutor’s office in Koronadal City, he could face a fine ranging from P5,000 to P10,000 and suffer imprisonment of one year to two years. (SDR/Sunnex)
