Work resumes at Clark construction site

CITY OF SAN FERNANDO — The Labor department lifted the stoppage order it issued on the contractor of a building owned by North Haven Pharmaceutical (NHP) Building after an accident killed four of its workers.
On March 2, four people were killed and nine others were wounded when the wall of the NHP that was being constructed collapsed.
Labor communications officer Jerry Borja, quoting a report by Regional Director Raymundo Agravante to Labor Secretary Rosalinda Dimapilis-Baldoz, said the lifting of the stoppage order was a result of the construction firm’s compliance of the recommendations stated in the cease and desist order (CDO) issued by the Department of Labor and Employment (Dole).
The report said the firm also complied with the violations cited in the Dole’s accident investigation report.
The lifting of the CDO was also result of a series of joint-undertakings by the Dole, Clark Development Corporation (CDC) and TCCI.
Borja said a conference was held at the department’s regional office on March 6 between agency officials, NHP and TCCI. The conference was witnessed by the CDC and representatives from the Department of Public Works and Highways (DPWH).
Those who attended the conference have jointly recommended the demolition of the remaining concrete walls in order to eliminate the presence of imminent danger, he said.
TCCI and North Haven Pharmaceuticals jointly agreed to comply with the recommendation by installing supports to secure the concrete walls and prevent possible collapse prior to the execution of demolition work, he added
A day after the said conference, TCCI submitted its construction methodology wherein the procedures in installing GI support and knock-down methods were enumerated, Borja said quoting Agravante’s report.
On March 12, upon receipt of Dole and CDC evaluation and recommendations for the safe execution of the construction methodology, TCCI submitted a letter expressing their commitment to strictly comply with the comments and recommendations by Dole and CDC. As agreed upon, TCCI installed the GI Pipe Support on the existing walls.
With regard to the company’s failure to comply with Section 5 of Dole’s Department Order 13, series of 1998, regarding non-submission of occupational safety and health program, TCCI, through its Safety Officer submitted its environment safety and health program and likewise a proof of the employment of a Safety Officer, in compliance with Section 7 of Department Order 13 regarding the non-accreditation of full-time safety practitioner with the Dole.
On March 22, Engr. Eduardo Dela Cruz of the Technical Support and Service Division for Labor Relations and Labor Standards of the Dole-Central Luzon conducted a Basic Orientation on Construction Safety for workers involved in the demolition and construction work where the importance of health and safety practices in the workplace and likewise the importance of the usage of the proper personal protective equipment was stressed.
Aside from the orientation, the Dole representatives also witnessed the payment of back wages to 23 workers amounting to P59,942. The said back wages according to Agravante include underpayment of workers, unpaid holidays, rest days worked, and 13th month pay.
