1 killed, 39 injured in Parañaque demolition

MANILA (4th Update) — A man died during a tension at a demolition of makeshift stalls in Parañaque City on Monday morning, a Philippine Red Cross (PRC) official said.
PRC secretary-general Gwendolyn Pang told Sun.Star that Arnel Leonor Tolentino, 21, a resident of the disputed Silverio compound in San Isidro village, died of gunshot wound to the head, while 39 others sustained injuries.
Five of those injured were brought to a hospital, while the others were treated by Red Cross personnel.
Three policemen identified as certain Police Officers 1 Tagacay, Estaris and Comboya were also rushed to the Parañaque Community Hospital due to laceration and abrasion in the legs and hands.
The Department of Interior and Local Government said it will check if the police have liability on Tolentino’s death.
The incident developed after hundreds of residents fought with court personnel and riot police who tried to knock down makeshift stalls at a flea market to give way for the construction of condominium units in the 9.2-hectare property.
The demolition team was not able to penetrate inside the compound due to the riot. The team pulled out at the area before 2 p.m. and the situation went back to normal, so the Red Cross team pulled out by 2:30 p.m.
“We heard that some of those who caused the riot are not from the subdivision,” Parañaque City Mayor Florencio Bernabe said in a television interview, adding that only makeshift stalls that have been blocking the main road in San Isidro are covered by the order issued by the Parañaque Regional Trial Court branch 195.
He added the area, which is covered by the court order, has been a subject of expropriation proceedings over a decade ago and that a site is being readied for the affected residents in the same compound.
The area is home to 28,000 families, according to militant group Kalipunan ng Damayang Mahihirap, but Bernabe only counted 1,800 urban poor families as recipients of the housing program.
A television report said about 250 police personnel came to the area to assist the implementation of the court order.
Parañaque Representative Edwin Olivarez earlier tried to negotiate with residents to keep one lane of Sucat Avenue open and allow the police to demolish market stalls outside the compound.
But residents started throwing stones and glass bottles at the police.
“Residents are fighting the demolition because they were already awarded land titles under the Community Mortgage Program (CMP). They paid for these lots for several years. The court has been unfair to the poor,” Kadamay secretary-general Gloria Arellano told Sun.Star.
CMP is a socialized housing program of the National Government, which assists legally organized associations of residents of depressed areas to own the lots they occupy for a maximum individual loan of P90,000.
Party-list group Akbayan said the incident should serve as a wake-up call on the Aquino government that demolitions will escalate into violence unless a proper program of relocation and housing is crafted to address the needs of the informal settlers.
For its part, Kabataan party-list blamed the government’s alleged failure to provide secure jobs and decent wages in both rural and urban areas and lack of “genuine” agrarian and urban land reform for the mushrooming of informal settlers.
“The government cannot solve this fundamental problem by demolishing homes and inflicting violence on the landless poor,” Kabataan party-list Representative Raymond Palatino said.
Last month, militant group Alyansa Kontra Demolisyon petitioned the Supreme Court to nullify some provisions of the 20-year-old Urban Development and Housing Act.
The group said the law legalized demolitions, forced evictions, arsons and various forms of destruction of livelihood to give way to various projects and businesses of foreign investors.
