Funeral parlors ask for exemption on zoning law

ANGELES CITY — Owners of four funeral parlors here are asking the City Council to exempt them from the implementation of an ordinance setting a common place for memorial homes.
This was gleaned in a position paper dated March 26, 2012 prepared by Grace M. Perez of Funeraria Luzon, Philip Cesar Samson of Pangilinan Memorial Chapels, Aries Galang of Galang Memorial Homes, and Jay Martin D. Cruz of Angelina Memorial Chapels.
In line with the city’s Comprehensive Land Use Plan, the City Council passed Ordinance Number 101 Series of 2000 or the Revised Zoning Ordinance of Angeles City.
Memorial parlors are given 10 years to transfer along the MacArthur Highway near the La Pieta Memorial Park or Holy Mary Memorial Park in Barangay Cutcut here.
“We have been making representations with the City Council for several years now in order to amend the existing zoning ordinance to permanently exempt us from the ambit of said ordinance because it would clearly deprive us of our constitutional rights to life and property,” the complainants stated in their letter to the City Council.
The funeral parlor owners also lamented that they are always being required to secure certificates of non-conformance, which is inconvenient on their part.
They claimed they have been deprived of their right to expand and improve their respective facilities and compete with other funeral firms.
The group also assailed the approval of a City Council resolution exempting Indiongco Funeral Parlor, owned by Councilor Alex Indiongco, in securing a certificate of non-conformance pursuant to Section 1 and 2 Article VIII of Ordinance 101.
In a separate letter to the City Council dated March 23, 2012, the four funeral firms expressed their request for similar resolution granting them exemption in securing Certificates of Non-Conformance.
Indiongco, for his part, said the City Council is set to amend Ordinance Number 101 and the funeral parlors will be allowed to remain in their present locations.
He also clarified that he was given exemption by the City Council because his permit to operate already expired last month.
