Lawmaker cautions Labor department on shorter work hours in Mindanao

MANILA — A party-list lawmaker on Monday expressed reservation on the proposal of the Department of Labor and Employment (Dole) to shorten work hours in areas in Mindanao affected by the daily brownouts.
Democratic Independent Workers’ Association (Diwa) party-list Representative Emmeline Aglipay, a member of the House committee on labor and employment, said Dole should first consult workers to be affected by such proposal.
“The Dole guidelines issued in 2010 do not cover a shortening of the number of work hours, but instead cover alternative schedules which retain the total number of core work hours,” Aglipay said.
The party-list lawmaker was referring to Advisory no. 4 issued by Labor Secretary Rosalinda Baldoz which provides employers with three flexible work arrangements, namely, compressed workweek, gliding on flexi-time schedule, and flexi-holidays schedule.
“Arrangements covered under Advisory no. 4 should comply with the provision that states such arrangements should be entered into only with the consent of the workers, and without any diminution of benefits,” she added.
Undersecretary Lourdes Transmonte earlier said Dole is considering allowing establishments affected by the daily power outages in the South to shorten the work hours of its employees.
“We already have a flexible and compressed work week every time there is an economic crisis or in this case an energy crisis. We are now guiding companies on how adopt this so there is no problem,” Transmonte said.
Aglipay, meanwhile, said that night shift workers should be entitled to “special compensation” under the law.
“As for arrangements which shift the core work hours to the night time, without night shift differential pay, it is my position that the Dole must first decide on a maximum period for which this arrangement may be applied,” the neophyte lawmaker said.
“It is unclear whether the Mindanao power crisis will be resolved in the near future, and it would be grave injustice to expose employees indefinitely to the documented detrimental effects of nightwork without the special compensation that has been guaranteed to them under the Labor Code,” Aglipay said.
