‘Senate likely to reject High Court intervention’

MANILA (Updated 10:50 a.m.) — Lawyers of Chief Justice Renato Corona should just respect the verdict to be handed down by the Senate impeachment tribunal rather than appeal before the Supreme Court (SC) since senators will likely ignore a ruling overturning conviction, a political analyst said.
According Ramon Casiple, it will be ill-advised if Corona will seek a homecourt decision in case the Senate found him worthy to be removed as magistrate for betrayal of public trust and culpable violation of the Constitution.
“It won’t be wise for them to do so. It will only drag his SC allies into the fray. Besides, the Senate will reject SC jurisdiction being the sole body tasked to try and decide impeachment cases,” he told Sun.Star.
Corona’s lead counsel Serafin Cuevas opened on Sunday the possibility of turning to the High Court for help since the 1987 Constitution is reportedly silent on appeal and the effectivity of the impeachment court decision.
His statement, however, ran contrary to that of SC spokesperson Midas Marquez, who said that Corona has already “surrendered to God’s will.”
He said Corona’s family and supporters are optimistic that the outcome of the voting would be one for his acquittal, especially after he fulfilled his promise to answer all allegations against him “point by point,” and after issuing a waiver to his bank accounts.
The court official said Corona remained at The Medical City in Pasig where he is still recovering after a hypoglycemic attack on Tuesday shortly after delivering his three-hour opening statement in the impeachment court.
“He is now able to rest and sleep better, while doctors continue to monitor his condition,” Marquez said.
Cuevas said Corona will no longer attend the impeachment court’s voting on Tuesday and will just monitor developments either at his hospital bed or at home once he is discharged.
In disagreement with Casiple’s view is lawyer Allan Paguia, one of the six petitioners who earlier asked the Supreme Court to nullify the impeachment proceedings for lack of due process and proper verification of the complaint.
“Jurisdictional issue is already raised in six petitions pending before the SC. Hence, if CJ (Corona) is convicted, it may still be declared void ab initio. That would constitute a constitutional or political crisis, or both (if the SC reverses the Senate decision),” he said in a text message.
Lawyer Vicente Millora, who also sought the junking of the impeachment complaint, agreed.
In a text message, the former president of the Integrated Bar of the Philippines (IBP) said the Chief Justice may question the guilty verdict by filing a petition for review on certiorari because only the SC “may resolve with finality various legal issues raised at trial.”
Senators are expected to take a vote on Tuesday as they are bound to answer a question whether Corona has committed an impeachable offense in not declaring his dollar and peso bank deposits in his statement of assets, liabilities and net worth (SALN).
