Public given until July 20 to oppose CJ applications

MANILA (Updated 2:31 p.m.) — The Judicial and Bar Council (JBC) will accept opposition to the nominees for Chief Justice until July 20, four days before the screening body will begin to quiz applicants to determine their fitness to lead the Judiciary. Jose Mejia, who represents the academe in the eight-man body, said interested parties can submit their objections to the JBC Secretariat located at the Supreme Court in Padre Faura St., Manila, or in these e-mail addresses: jbc@sc.judiciary.gov.ph and jbc87supremecourt@gmail.com.

A list of nominees, which passed the minimum requirements set by the Constitution, will be published on Monday. They will undergo public interviews slated July 24 to 27 when issues against them are expected to be raised by the JBC.

Under the Constitution, a member of the Supreme Court must be a natural-born citizen of the Philippines; at least 40 years of age; must have been for 15 years or more a judge of a lower court or engaged in the practice of law in the country; and must be of proven competence, integrity, probity and independence.

So far, there are 24 individuals battling for the position left by Renato Corona, who was ousted by the Senate impeachment court last May 29 for betrayal of public trust and culpable violation of the Constitution for failure to truthfully declare his peso and dollar accounts.

Meanwhile, Mejia could not say if Associate Justice Diosdado Peralta will lead the selection process for the next Chief Justice despite the Supreme Court decision dated July 3 that allows a senior justice who did not apply for the position to do so.

“We may have to discuss it in our meeting if he will sit as chairperson,” he said in a text message.

Following tradition, the five most senior magistrates are automatically nominated for the post. Associate Justice Antonio Carpio and Justices Presbitero Velasco Jr., Teresita Leonardo-de Castro, and Arturo Brion accepted their nominations, while Peralta declined to be considered.

At present, retired Supreme Court Justice Regino Hermosisima is the temporary chairperson of the eight-man body also composed of Senator Francis Escudero (Senate), Iloilo Representative Niel Tupas Jr. (House of Representatives), retired Court of Appeals Justice Aurora Lagman (private sector), lawyer Milagros Fernan-Cayosa (Integrated Bar of the Philippines) and Mejia (academe).
