Supreme Court nullifies emergency powers for Sulu guv

MANILA (Updated 10:50 a.m.) — Only the President of the Philippines has the sole power to declare a state of emergency and call out the police and military in keeping the peace in troubled areas, the Supreme Court recently said.
In a decision written by Associate Justice Maria Lourdes Sereno, the Supreme Court nixed Proclamation No.1 of Sulu Governor Abdusakur Tan declaring a state of emergency in the province as a result of the abduction of three members of the International Committee of the Red Cross (ICRC) last year.
The Court ruled that a provincial governor is not authorized to call upon the Armed Forces at its own bidding, citing the presidential prerogative on emergency powers under Section 23, Article VI, and calling out powers under Section 7, Article VII of the 1987 Constitution.
While the President exercises full supervision and control over the police, a local chief executive, such as a provincial governor, only exercises operational supervision over the police, and may exercise control only in day-to-day operations.
This provision extends to the formation of private armed groups since the job of preserving peace and order is given only to uniformed personnel serving the National Government.
Using kidnapping as reason behind the issuance of an emergency proclamation was also unfounded, the Court said, since this cannot be considered a calamity or disaster under the Local Government Code.
The proclamation, which was questioned by certain Sulu residents, authorized the set-up of checkpoints and chokepoints, conduct of general search and seizures including arrests and other actions necessary to ensure public safety pursuant to the Local Government Code. (Virgil Lopez/Sunnex)
