Tarzan bill for more trial courts okayed

ANGELES CITY–Pampanga First District Representative Carmelo “Tarzan” Lazatin’s bill seeking for the establishment of six additional regional trial courts here has been approved by the House Committee on Justice.
During the hearing held last November 14, the committee, chaired by Iloilo 5th District Rep. Neil Tupaz, Jr., has approved Lazatin’s House Bill 5532 entitled “An Act Creating Six Additional Branches of the Regional Trial Court in the Third Judicial Region to be Stationed at the City of Angeles, Province Of Pampanga, Further Amending for the Purpose Batas Pambansa Bilang 129, Otherwise known as ‘The Judiciary Reorganization Act Of 1980,’ as Amended, and Appropriating Funds Therefor.”
Under the Batasang Pambansa Blg. 129 or the Judiciary Reorganization Act of 1980, Angeles City only has eight RTCs.
“Due to the limited number of trial courts here, the judges in these eight RTCs are overworked because they need to try and decide a lot of cases, which cannot be done overnight. So what happens is that some other cases are being delayed,” Lazatin said.
Lazatin explained that in order to improve the disposition and administration of justice and to ensure the rights to a speedy trial, the number of courts must necessarily be increased.
“The delay in the resolution of cases runs contrary to what Section 16, Article 111 of the 1987 Constitution guarantees to each person, which is a right to speedy trial,” Lazatin added.
Quoting a letter from Judge Omar Viola, Executive Judge of Angeles City Regional Trial Court, Lazatin said the Honorable Judge informed him that “the Regional Trial Courts of Angeles City have an average of 700 to 900 cases for each court and at the rate the cases are being filed, each docket of the court will reach the 1,000 mark”.
The situation cited by Judge Viola also prompted the City Council of Angeles City to pass a resolution requesting Lazatin to push for the creation of additional Regional Trial Court branches.
At present, 22 of the 75 regional trial courts comprising the Third Judicial Region are based in the province of Pampanga and eight in Angeles City.
If enacted into law, the Supreme Court will assign the respective branch numbers for the created branches.
The Chief Justice of the Supreme Court, in coordination with the Secretary of the Department of Justice, shall immediately include in the Court’s program the implementation of the measure.
Meanwhile, the Supreme Court, through its representative, Deputy Court Adminitrator Antonio Eugenio, Jr., expressed its full support to the measure, hailing Congressman Lazatin for proposing the establishment of Additional Regional Trial Courts in Angeles City.
A similar measure, Senate Bill 3056, authored by Senator Francis “Chiz” Escudero has been approved on third reading at the Senate on September 19, 2012 and is now at the House of Representatives for concurrence. ● Charlene Cayabyab
