Clark power project bidding ‘aboveboard’
CLARK FREEPORT — The bidding process for the design and build services for the Clark 230-kilovolt (KV) power transmission Line Project Phase 3B was aboveboard, said an official of the Clark Development Corporation (CDC).
Franco Alejo L. Madlangbayan, CDC vice president for Operations and Technical Services (OTS), denied allegations of rigged bidding to favor the Meralco Industrial Engineering Services Corp. (Miescor)-NARI-TBEA consortium, saying the CDC complied with all the pertinent rules and procedures prescribed under the Government Procurement Reform Act.
“In fact, despite being the lone bidder during the first bidding in January 2012, MIESCOR was still declared to be ineligible for its failure to submit the joint venture agreement between AsiaPhil Manufacturing Industries Inc. and PT Alstom Grid. There was absolutely no favoritism, much less ‘rigging’ as alleged by some quarters,” Madlangbayan added.
Records obtained from CDC showed that when Miescor applied for a motion for reconsideration for its failed bid, CDC sought the legal opinion of the Government Procurement Policy Board (GPPB) and the Office of the Government Corporate Counsel (OGCC).
Their responses prompted the CDC Board of Directors to declare a failure of bidding, paving the way for the second bidding of the project.
The Phase 3B project involves the construction of 230KV transmission lines to address the projected power shortage in late 2013 with the entry of new investments into the Clark Freeport Zone.
Madlangbayan said a second bidding conducted in April 2012 was participated in by three groups where the Miescor-NARI-TBEA consortium was determined to be one of two eligible bidders, the Romago-AsiaPhil-Alstom Joint Venture being the other.
The third bidder, Ron Daniell Construction Corporation-Iljin Electric Philippines Joint Venture, was declared ineligible for failing to submit the required technical data sheets.
After the Miescor-NARI-TBEA consortium submitted the lowest calculated bid in the second bidding, post-qualification procedures were initiated by the Phase 3B Technical Working Group. This included site inspection and validation of two similar transmission line projects in the Republic of Tajikistan that were implemented by TBEA, a member of the consortium.
After a careful review and evaluation of documents, the CDC board approved the award of the project to the Miescor-NARI-TBEA consortium in October 2012.
For his part, CDC chief Francis Elum said “the members of the CDC Board of Directors are appointed by President (Benigno) Aquino (III), and they are all aware of his thrust toward transparency and accountability. The Board has given specific instructions to all department and committee heads to adhere to the President’s policy.”
Elum added the chronology of events over a period of 13 months from November 2011 for this Phase 3B project shows that CDC has strictly complied with Procurement Law, with full transparency and accountability as espoused by the President.
While the project’s budget was pegged at P1.5 billion, the lowest calculated bid tendered by the Miescor-NARI-TBEA consortium was P1.08 billion, followed by the Romago-AsiaPhil-Alstom Joint Venture at P1.2 billion, the CDC officials said.
