CSC verifies JO rally against Lazatin

ANGELES CITY–The Civil Service Commission in Central Luzon (CSC-3) clarified with Pampanga First District Representative Carmelo “Tarzan” Lazatin whether the job order employees of the city government pushed through with their plans to stage a rally in front of the congressman’s district office.
In a letter dated November 22, CSC 3 Director Karen Litz Zerna verified if the rally actually took place in order to “have basis in asking for the daily time record and leave forms of the employees and take other appropriate action.”
The Lazatin camp only received the letter on December 6.
On November 14, amid threats from Angeles City job order employees under the administration of Mayor Edgardo Pamintuan that they will conduct a rally in front of his office, Lazatin wrote to Zerna and sought the assistance of a CSC representative to explain to the employees in question several pertinent rules regarding the proper conduct of government employees, particularly the observance of the eight-hour working time.
In her response, Zerna said that their office was not able to send a representative as she and the other concerned officers, Assistant Regional Director Carlos Rabang and CSCRO-III Legal Division Head Atty. Rosalinda Oliva, all had prior commitments scheduled for November 15, the day of the rally.
“Had we received your request earlier, we could have adjusted our respective schedules in order to address your concern,” Zerna wrote.
Lazatin, in response to Zerna, wrote that while he acknowledges that job order employees are not actually considered as government employees, they are still obligated to follow the eight-hour working time of government employees since their salaries are still taken from taxpayers’ money.
Section 1, Rule XVII of the Omnibus Rules Implementing Book V of the Administrative Code of 1987, heads of department or agencies are mandated to require all officers and employees under him to strictly observe the prescribed government office hours. Section 5, Rule XVII of the same Omnibus Rules also states that “officers and employees of all departments and agencies, except those covered by special laws, shall render not less than eight (8) hours of work a day for five days a week or a total of forty (40) hours a week, exclusive of time for lunch. As a general rule, such hours shall be from eight o’clock in the morning to twelve o’clock noon and from one o’clock to five o’clock in the afternoon on all days except Saturdays, Sundays and Holidays.”
On November 15, several job order employees of the Angeles City Government staged a rally in Plaza Miranda, in front of San Nicolas Public Market.
The Lazatin camp said JO employees gathered around 10 a.m. and held a program from 12 noon to 1 p.m.
The Pamintuan camp has earlier said that the JO employees conducted the rally during their one hour lunch break and that they went back to work after the rally. ●–Charlene A. Cayabyab
