Ex-Minalin mayor faces graft charge
CITY OF SAN FERNANDO–Mayor Arturo “Katoy” Naguit of Minalin has filed criminal charges before the Office of the Ombudsman against his predecessor, former Mayor Edgardo G. Flores, for alleged anomalous construction of a government evacuation center worth P7,975,521 in 2010.
In an interview, Naguit said that as local chief executive, he is duty-bound to protect the interest and properties of the municipal government, so he has no option but to file corresponding charges against the former mayor.
He refused to further comment on the issue telling the local media that he pities the accused but copies of the complaint affidavit had been furnished to the national media after his lawyer filed the case before the Ombudsman.
Based on the complaint affidavit filed last week, Naguit vehemently accused his predecessor of allegedly violating Article 213, Paragraph 1 and Article 217 of the Revised Penal Code; Section 3, Paragraphs (e) and (g) of Republic Act 3019 (Anti-Graft and Corrupt Practices Act); and Section 4, Paragraph (a) of Republic Act 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).
The complaint stated that Flores, when he was still mayor of Minalin, has made a fraudulent and prejudicial transaction.
The complaint also stated that on May 14, 2010, the construction of the Francisco P. Flores Multi-Purpose Center in Santo Rosario, Minalin, Pampanga, was completed.
“The facility was named and dedicated in the memory of the late Francisco P. Flores Sr., the respondent’s father and former municipal mayor of Minalin. The center was constructed using public or government funds from the National Housing Authority which were intended for the purpose of constructing an evacuation center for the constituents of Minalin,” Naguit stated in his complaint.
Citing documents as evidence, the mayor said the construction of the evacuation center, with movable partition and boys’ and girls’ toilets, was awarded to N22 Construction and Trading, owned and managed by Nestor O. Tolentino, for a total of P7,975,521.
However, the complaint stated that the evacuation center was constructed on private lots owned by the following persons: Francisco P. Flores (deceased), married to Anita Galopo, with an area of 1,396 square meters covered by Original Certificate of Title No. 5680; Francisco Nicolas, with an area of 562 square meters covered by Tax Declaration No. 14015-284; and Anita G. Flores, with an area of 560 square meters, covered by Tax Declaration No. 14015-259.
The mayor also stated in his complaint that “On April 20, 2008, Francisco Nicolas and Anita Flores executed a Deed of Donation in favor of the municipality of Minalin, represented by then-Mayor Edgardo G. Flores, for the purpose of donating their lots to the said local government unit and for the construction of the evacuation center….No resolution was passed by the Sangguniang Bayan authorizing then-Mayor Edgardo G. Flores to enter, sign and accept the aforementioned donations nor was the Deed of Donation ratified by the said body.
“No contract or agreement, whether by way of a Deed of Donation, Conveyance or Waiver of Rights, was executed by the heirs of Francisco P. Flores in favor of the municipality of Minalin, covering the area occupied by the evacuation center now multipurpose center and covered by Original Certificate of Title No. 5680,” he added.
It also stated that as of May 15, 2012, the lots where the evacuation center, now multipurpose center, stands are still declared under the names of Francisco Flores, Francisco Nicolas and Anita Flores.
Naguit said, “The construction of the evacuation center, now named Francisco P. Flores Sr. multipurpose center at Sto. Rosario, Minalin, Pampanga…has caused damage and undue injury to the government, specifically since the center is constructed/erected on private properties, and was not properly turned over to the municipality of Minalin”.
He clarified that the fund released to the municipality by the NHA was for the purpose of constructing an evacuation center and not for the purpose of constructing a multipurpose center in memory of the late Mayor Francisco Flores, Sr.
“There was evident fraud, bad faith and deceit on the part of respondent when he caused the construction of the evacuation center on the private lots owned by his parents and appropriated the same in favor of his family by naming the evacuation center as The Francisco P. Flores Sr. Multi-Purpose Center,” the complaint stated.
“As of October 15, 2012,” Naguit said, “the biggest portion of the lot where the evacuation center was constructed, consisting of 1,396 square meters covered by Original Certificate of Title No. 5680, is still registered under the name of the respondent’s parents.” ●HGL Reportorial Team
