CDC labor dispute elevated to DOLE

CLARK FREEPORT–The appeal of a labor union from the Clark Development Corporation (CDC) has been elevated to the Department of Labor and Employment’s national office.

The appeal of the Association of CDC Supervisory Personnel (ACSP) to implement their collective bargaining agreement has been elevated to the labor agency’s national office after a referendum among union members.

Asked whether to go on strike, 52 members of the ACSP voted “yes” while three said “no.”
Given the result of the referendum, ACSP President Victor Barbieto said the negotiations to implement the CBA will now be at the DOLE national office.

Negotiations at the DOLE national office will last for seven days.

“After seven days, if CDC will still not implement the CBA, we will proceed with the strike. We will rally in front of the CDC executive office,” Barbieto said.

The members of the union casted their votes during the 20th anniversary celebration of the CDC last week.

In earlier statements, the CDC management said they cannot implement the CBA following the provisions of Executive Order No. 07 and Republic Act 10149 or The GOCC Governance Act of 2011.

EO No. 7 states that CBAs between employees and GOCC employers may no longer be negotiated. The order also states that being no longer a subject for negotiation, such CBAs are furthermore taken out of the jurisdiction of arbitration proceedings.

However, the Court of Appeals has denied the request for a temporary restraining order of CDC against the CBA implementation. The CA even ordered the immediate implementation of the CBA.

“They have left us no [other] recourse but to go on strike, because the present administration of CDC continues to violate our constitutional right,” Barbieto said.

Meanwhile, the CDC’s rank and file union is also set to conduct their own strike vote on May 3. The union also submitted a notice of strike at the regional office of the National Conciliation and Mediation Board (NCMB) on April 18.

Both the ACSP and Association of Concern CDC Employees (ACCES) said to have an industrial peace in Clark Freeport, President Arthur Tugade should implement the rights of the workers as his gift during Labor day.

“We are appealing to CDC, especially to President Tugade to implement what is right and due to the workers as enshrined in the Constitution,” Barbieto said.

The two unions have also urged the CDC management to release the Performance-Based Bonus (PBB) of CDC as mandated by law. ●Charlene A. Cayabyab
