Prosecution: Defense digging its own hole

THE prosecution said Friday that witnesses presented by the defense of Chief Justice Renato Corona, so far, has not done any damage against the evidence they have submitted before the impeachment court.

Bayan Muna party-list Representative Neri Colmenares, one of the impeachment prosecutors, said the defense lawyers of Chief Justice Renato Corona should just terminate its presentation of witnesses because they are only “digging their own hole.”
Colmenares said this after the defense panel admitted discrepancies between the acquisition costs of the Chief Justice’s properties and its fair market and assessed values. They explained that the values were based on the tax declarations of the properties.

The prosecution has been asserting that the acquisition cost is the most important column in the statement of assets, liabilities and net worth (SALN). Corona has not declared a single acquisition cost for his properties in his 2002 to 2010 SALNs.

“One of the most important value in the SALN is the acquisition cost, because it is the actual amount paid by CJ Corona for buying properties and therefore is directly related to corruption and unexplained wealth,” Colmenares said.

“Fair market value, even assessed value, only describes the value of the current assets, but acquisition cost is the most accurate barometer of whether the Chief Justice has more money than what he actually earned or declared in his SALN,” he added.

Spokespersons for the prosecution also said that the testimony of Supreme Court chief judicial officer Araceli Bayuga is in their favor after the defense witness said that several allowances of the Chief Justice are solely for the function of his office.

“We can use the testimony of Ms. Bayuga in our favor specifically the certain parts which she said it cannot be used for personal purposes,” Deputy Speaker Lorenzo “Erin” Tañada III said.
