Drilon: Questioning validity of impeachment verdict baseless

ADMINISTRATION ally Senator Franklin Drilon said the petition to stop the implementation of the guilty verdict on former Chief Justice Renato Corona will not hold water.
On Tuesday, lawyers Alan Paguia and Homobono Adaza and taxpayer Hernan Laurel asked the Supreme Court to issue a preliminary injunction and hold oral arguments regarding the alleged “infirm” decision of the Senate impeachment court to remove Corona from office last week.
“The move was baseless and non-sense since the Supreme Court en banc has already respected the decision of the impeachment court by appointing Senior Associate Justice Antonio Carpio as acting Chief Justice. So by this very act of the Supreme Court, the issue is settled,” Drilon, one of the 20 senators who voted for conviction, told reporters.
At present, there are six petitions asking the justices to nullify the impeachment proceedings for lack of due process and proper verification of the complaint. Justices will resume session on June 19.
In the motion, the lawyers said the Supreme Court should use its power of judicial review to check if the Senate committed “grave abuse of discretion amounting to lack of jurisdiction.”
“At stake in the successful and immediate resolution of the pending petitions is not only the viability of the Constitution and other existing institutions, including all the three branches of government, but the fate and destiny of this country,” the motion read.
Senator Ferdinand Marcos Jr., who acquitted Corona of betrayal of public trust for failing to report multi-million cash assets, said the justices will be courting a constitutional crisis if they decide to hold public debates on the petition.
“I’m sure Justice Carpio (Corona’s rival to the post in 2010) is not in favor of reopening the case. I just don’t know with the other justices. If they grant a hearing, it might lead to a constitutional crisis,” Marcos said.
Senate President Juan Ponce-Enrile earlier rejected possible High Court intervention, saying the Senate is the sole body tasked to try and decide impeachment cases.
Corona himself dropped the option to reverse the verdict. He went to his office on Tuesday to pack his belongings and bid an emotional farewell to employees and five other magistrates.
