To water-down brewing strike, CDC execs negotiate CBA with employees

CLARK FREEPORT–Representatives from the Clark Development Corporation (CDC) have opened negotiations with their employees regarding the enforcement of their collective bargaining agreement.
CDC executives only opened negotiations after employees warned of a strike.
During the negotiations, CDC officials said they need a “declaratory relief” or go signal from higher government offices or courts such as the Bases Conversion and Development Authority or the Office of the President before they can enforce the CBA.
Until higher-office issue relief, CDC representatives said, the implementation of the agreed provision of the CBA will have to be on hold.
CDC employees disagreed to their employer’s proposal saying such provision were not discussed when the CBA was agreed in 2010.
Michael Landayan, president of the Association of Concerned CDC Employees (ACCES), said members of their union will meet up on February 1 to vote whether they pursue their strike or not.
The CDC management has earlier denied negotiations with the employees which ACCES sees as a clear violation of the Labor Code.
The union said, “CDC management has grossly violated existing CBA for non-renegotiation on the third year and the discontinuance of the gradual build-up on provident fund, which will supposedly be 17 percent as employer’s share this January 2013 cited on Article XII, Section 1 of CBA.”
“Since the CBA is (still) binding between ACCES and management for a period of five years from March 13, 2010 to March 12, 2015, the union has no recourse but to file notice of strike,” Landayan said.
The CBA is in consonance with the Labor Code of the Philippines as reason to protect the rights of the workers as stipulated in the Philippine Constitution, the highest governing law of the country.
CDC management’s hands, according to reports, are tied-up because of RA 10149, the Government Owned and Controlled Corporations Law, which prevents them to negotiate with the workers.
Meanwhile, the CBA of the Association of Concern Supervisory Personnel (ACSP) has yet to be implemented since Dec. 21, 2011.
Despite the agreement and the favorable ruling of the Accredited Voluntary Arbitrator to ACSP, the CDC has yet to implement the CBA and instead filed a temporary restraining order at the Court of Appeals to quash the implementation.
Lawyer Froilan Bancugan, the arbitrator assigned by the National Conciliation and Mediation Board (NCMB) and National Labor Relations Commission (NLRC), has also directed CDC to garnish back wages, including other benefits of the ACSP and implementation of CBA. ●Charlene Cayabyab
