Use of public schools in politics not illegal

ANGELES CITY — Mayor Edgardo Pamintuan said the use of public schools for political activities is not illegal.
The mayor issued the statement in reaction to the comments of Congressman Carmelo Lazatin’s camp saying Pamintuan’s Partido Abe Kapampangan is illegally using public schools for political gatherings.
“The use of public schools facilities for political activities such as that of Abe affairs is not illegal. This is in recognition of the people’s rights to organization and peaceful assembly among other civil and political rights,” Pamintuan said.
Department of Education (DepEd) Order 10 issued in 2010 “Clean Schools Clean Elections,” which allowed the use for political rallies and public meetings even during the campaign period as long as it is not scheduled during school days while classes are ongoing, according to Pamintuan.
However, Pamintuan said organizers of political rallies and public meetings must first secure the necessary permits from the proper local government official to be able to use public schools.
School heads should remind the organizers of political rallies and public meetings to be held on school premises that said organizers are responsible in making sure that the school surroundings will be cleaned and the campaign materials and propaganda will be removed after the rally or meeting, Pamintuan added.
The mayor said most of the members are from poor and marginalized sectors and it is precisely why they joined ABE, because they want to be empowered by exercising their political rights.
“Since most, if not all ABE activities are community-based, ABE event organizers are always looking for venues that are large and near enough to the communities so they won’t need to spend whatever precious money they have left for transportation/fare. For this reason, public school covered courts are the ideal venue for our members to hold our huge-crowd party activities,” the mayor said.
“Our Mass Oath taking and Bingo events are organizational activities that we have been holding since last year, way before election/campaign period. At any given time, our Party officials preside over the oath taking of 1000 to 3500 members. This is a necessary organizational exercise and duty for every ABE member,” he added.
Principals of the public schools, where the Abe party conducted its activities were all informed, Pamintuan said.
“We made sure that our events were held after school hours if not during the weekends so as not to interrupt the on-going classes,” he said.
The mayor added: “We are hopeful that Cong. Tarzan (Lazatin) will not use this ‘issue’ or this type of politicking to give undue pressure the school principals who are doing the best they can to maintain their integrity and impartiality.”
