Injunction vs revenue bureau’s regulation issued

ANGELES CITY – A regional trial court here has issued a writ of preliminary injunction, stopping the Bureau of Internal Revenue (BIR) from enforcing “directly or indirectly” Revenue Regulation No. 2-2012 as it runs contrary to the law that created the Subic and Clark Freeport Zones.
This said regulation is about applying value-added tax (VAT) on all petroleum and petroleum products that are imported and/or brought directly from abroad to the Philippines including Freeport and Economic zones.
“This Court, in the exercise of its sound judicial discretion, finds the prayer for the issuance of the writ of preliminary injunction to be impressed with merits and hereby grants the same,” branch 58 Presiding Judge Philbert Iturralde said in his seven-page decision issued April 4, 2012.
Iturralde ordered the “BIR, its agents, representatives, or assigns, and all persons acting in its place and stead” to cease and desist from enforcing the said regulation.
Iturralde also ordered petitioner, Pampanga 1st District Representative Carmelo Lazatin, to post a P15-million injunction bond to answer for any damage that may be suffered by the BIR in the event that the Court should later determine that the lawmaker is not entitled to the relief prayed for.
Lazatin hailed the BIR and the Finance Department to court after finding that the controversial regulation contradicts Republic Act 7277, the law that created Subic and Clark Freeport Zones. Republic Act 9400 later amended RA 7277.
In his petition, Lazatin emphasized that RA 9400 provides that no national or local taxes shall be imposed on registered business enterprises within the Clark Freeport Zone (CFZ).
In his decision, Iturralde sided with Lazatin, saying “there appears to be a patent conflict between the questioned regulation and RA 9400, in order to prevent injury to the registered businesses inside CFZ, there is a need to restrain the BIR from implementing Revenue Regulations No. 2-2012 until the main case has been heard.”
Iturralde also contradicted BIR’s claim that the regulation merely intends to implement corrective measures which appears to be lacking in the basic law to stop smuggling.
“A careful examination of the statute provides a penal sanction for such act,” Iturralde said, citing Section 9 of RA 9400, which states that “Any registered business enterprise found guilty of smuggling by final judgment, either as principal, accomplice or accessory shall be perpetually barred from doing business in any freeport and special economic zone, in addition to the penalties and sanctions imposed by existing laws.”
The judge also ruled that a department regulation like Revenue Regulations No. 2-2012 cannot go beyond the terms and provisions of the basic law, as decided by the Supreme Court in the case of Philippine Amusements and Gaming Corporation vs BIR.
“Revenue Regulations No. 2-2012 cannot go beyond the provisions of RA 9400 which amended RA 7227,” said Iturralde.

DILG to host synchronized barangay assembly in Lubao town

LUBAO — The Department of Interior and Local Government (DILG) will conduct the nationwide Synchronized Barangay Assembly Day (SBAD) on March 31 in front of the barangay hall of Barangay San Miguel here.
The event is in pursuance to the Proclamation No. 260, dated September 30, 2011, issued by President Benigno S. Aquino III, declaring the last Saturday of March and the second Sunday of October 2011 and every year that would follow as Barangay Assembly Days.
DILG regional director Florida Duan told Sun.Star Pampanga that the primary objective of the event is for barangay officials and residents to have dialogue on the different issues and concerns affecting the barangay such as peace and order, disaster preparedness, solid waste management and clean-up activities.
“Barangay officials shall likewise present the State of Barangay Address (Soba) with emphasis on CY 2011 Second Semester Accomplishments, Financial Reports and Updates on CY 2012 First Semester on-going programs,” Florida said.
DILG provincial director Angie Blanco said the synchronized village meets are in line with the DILG’s advocacy of transparency and good governance.
“It’s actually a nationwide event in line with President Benigno Aquino III’s ‘matuwid na landas’ and Secretary Jesse Robredo’s call for good governance at the barangay level. But it’s not your ordinary village assembly since this time, every detail would reported by barangay captains like as an example, where funds really where put into,” she said.
“In Pampanga, there would be something new in the SBGR or state of the barangay report since there would be an evaluation or measure in terms of the use of the Barangay Performance Governance System. On March 31, we will start at Lubao where one of its barangays, San Miguel, would be the first to report, particularly on their successful MRF (materials recovery facility),” Blanco added.
Among officials expected to attend the Pampanga assembly, according to Blanco, are Governor Lilia Pineda, DILG regional director Florida Dijan and non-governmental organizations like the Pampanga Chamber of Commerce and Industry Inc.

Court’s decision on 2007 polls ‘moral victory’

CITY OF SAN FERNANDO – “It’s simply a moral victory.”
This was Governor Lilia Pineda’s reaction with the recent Supreme Court’s decision junking the appeal of former governor Eddie Panlilio which questioned the Commission on Elections (Comelec) ruling declaring Pineda as the duly-elected chief executive of Pampanga in the May 2007 elections.
Panlilio’s petition was rendered moot and academic by the High Court following the regular national and local elections in May 2010, and the proclamation of winners.
This, the ruling said, “has left the Court no alternative except to dismiss the petition in accord with jurisprudence to the effect that the expiration of the contested term of office renders the petition moot and academic.”
Pineda won the gubernatorial race of May 10, 2010 and assumed office on July 1, 2010.
As per Comelec records, Panlilio won in the 2007 polls with 219,706 votes, as opposed to Pineda’s 218,559 votes.
Pineda contested her win before the Comelec and after a revision of votes, the Second Division subsequently declared her as the duly elected governor.
The Comelec declared that Pineda’s votes totaled 190,729 votes as against the 188,718 votes cast in favor of Panlilio.
Panlilio was then ordered by the Comelec to vacate his post but continuously performed the duties of a governor while the case is still pending before the Supreme Court until his term ended.
“I was not proclaimed and I did not sit as governor,” Pineda said.
It can be recalled that Panlilio served his full term as governor from July 30, 2007 up to June 30, 2010. Pineda did not sit even a single day at the Capitol during that period.
Panlilio elevated the case to the Supreme Court on May 17, 2010.

Capitol, DOLE Allot P5.7M for Summer Jobs

CITY OF SAN FERNANDO – The provincial government and the Department of Labor and Employment (DOLE) had allotted an estimated budget of P5.7million for the 537 beneficiaries of the special program for Employment of Students (SPES) and 200 nurses this summer.
The estimated P3.4M will be covered by the provincial government, equivalent to 60% of the budget. The remaining 40% will be provided by DOLE.
During the orientation, Governor Lilia “Nanay” G. Pineda, together with the Provincial Public Employment Service Office (PESO) headed by Luningning Vergara, welcomed the beneficiaries of SPES who will work under the provincial government here.
In her welcome remarks, Vergara advised the beneficiaries to always be dedicated to their work. Furthermore, the PESO manager said that the program would help the youth in gaining work experience and developing a sense of responsibility even at a young age.
Accordingly, cousins Kelvin, Mark Louie, and John Kenneth Aquino of Bulaon intend to take advantage of this opportunity to not only gain work experience but to earn extra money for their tuition this coming school year. The youngsters are incoming freshmen at Don Honorio Ventura Technological State University (DHVTSU) to study Automotive, Education, and Drafting, respectively.
The SPES beneficiaries will be tasked to gather information from barangays throughout the province to complete the proposed Skills Registry System under the provincial government.
Each beneficiary will be earning P6,190 after the 20-day work period.

Barangay assembly all set in Lubao town

CITY OF SAN FERNANDO, Pampanga, March 31 (PIA) — Spearheading this year’s first Barangay Assembly Day tomorrow (March 31), the Department of Interior and Local Government (DILG) has chosen Barangay San Miguel in Lubao town as the showcase barangay in the region.

DILG Regional Director Florida Dijan said “this activity which will be conducted simultaneously in all Barangays nationwide will be discussing the 2011 accomplishments of the barangays.”

“Also, issues and concerns affecting their operations will be highlighted in the program,” Dijan added.

Moreover, the assembly is also expected to have barangay officials present their State of the Barangay Address (SOBA) to have an overview on their proposed programs and plans for this year 2012.

The activity is pursuant to Proclamation No. 260 dated September 30, 2011 and in consonance to Sections 397 and 398 of the Republic Act 7160 otherwise known as the Local Government Code of 1991.

Arroyo couple to be arraigned Wednesday on graft charge

Former President Gloria Macapagal-Arroyo and her husband, Jose Miguel Arroyo, are ready to face the music but a coaccused in a graft complaint against them is not.
The Arroyos are set to be arraigned Wednesday on graft charges over the canceled $329-million national broadband network (NBN) deal but former Transportation and Communications Secretary Leandro Mendoza has asked the Sandiganbayan to reset his arraignment because of a recent stroke.
The Arroyos don’t intend to seek a postponement, according to their lawyer Edna Batacan. A fourth coaccused, former Commission on Elections Chairman Benjamin Abalos, is also expected to appear before the Sandiganbayan Fourth Division Wednesday to enter his plea on the graft charge.
Mendoza said he needed at least a month to recover from the stroke he suffered on March 18.
In a motion filed by his counsel before Holy Week, Mendoza said he was still weak and remained confined at St. Luke’s Medical Center in Bonifacio Global City.

Gina Joy Gasmen Howell, a 20-year-old lass from Barangay Mining here, is the lone candidate from Pampanga to the annual beauty tilt which winners will be crowned on Sunday night (April 15) in Quezon City.
Howell’s mother – Melinda Gasmen – was also a former resident of adjoining Mabalacat town.
“I am just glad to have come from a city and a province that both have produced national beauty titlists. I hope that people in these places I represent would be just as proud and I hope not to disappoint them,” Howell said.
Pampanga has produced beauty queens including Melanie Marquez, Miss International 1979; Maricel Morales, Mutya Ng Pilipinas 1995 and Semi-Finalist in the Miss Asia Pacific; Marilen Maristela, winner of Mutya Ng Pilipinas and Miss Asia Pacific 1996; and Juliann Savard, Miss Teen Philippines 2006, among others.

Ordinance creating trike franchise body barred

ANGELES CITY — Balibago chief Rodelio Mamac is set to file before the Regional Trial Court (RTC) a petition for declaratory relief against City Council Ordinance 296, which creates the city’s Motorized Tricycle Franchising and Regulatory Board.

Mamac said the petition stipulates prayer to declare the ordinance null and void because it is unconstitutional and discriminatory.
