Palace to study granting emergency powers to Aquino

MANILA — Malacañang is not shutting the door for President Benigno Aquino III to have special powers to address the worsening blackouts in Mindanao.
The President’s allies at the House of Representatives have expressed willingness to grant Aquino the emergency powers to immediately address the power situation in Mindanao.
Deputy presidential spokesperson Abigail Valte said Malacañang has to study the proposal as soon as it is filed in Congress.
“We will have to study the proposal when filed in the Lower House (House of Representatives),” she said.
Residents of Mindanao have been complaining about the long hours of brownouts, which have been affecting businesses.
“As of the present time, the power situation is being addressed by the Department of Energy (DOE) with the stakeholders in Mindanao,” Valte said.
The DOE has dispatched 120-megawatt power barges in Mindanao to augment the electricity supply from the hydropower plants but electric cooperatives are not contracting them yet because of the higher power cost.
Eastern Samar Representative Ben Evardone, chairman of the House committee on public information, said if the widespread blackout continues in Mindanao, this could damage the image of the Philippines.
The administration lawmakers also raised the possibility of the President calling for a special session so that Congress could grant him emergency powers.
Congress has been on a Lenten break and will only resume its session in May.
The government earlier admitted that power blackouts could last until 2013.
Valte said the government is currently trying to resolve the problem.
Malacañang warned residents in Mindanao that if they will not share the burden of shouldering the higher cost of electricity rates, they will continue to suffer long hours of brownouts.
Energy Secretary Jose Rene Almendras had also said residents in Mindanao have to pay more for their electricity consumption as they will source out their power from diesel-run power barges.
The power shortage in Mindanao could be alleviated by 2014 when a 300-MW coal-fired plant becomes operational, Almendras said. (SDR/Sunnex)

Arroyo camp questions witnesses’ relevance in bail hearing

THE camp of former President Gloria Arroyo questioned the materiality and relevance of the two witnesses presented by the prosecution during Tuesday’s resumption of the hearing on her petition to fix bail before a Pasay court.
Arroyo’s legal counsel, Ray Montri Santos, said witnesses presented by the prosecution before the sala of Pasay City Regional Trial Court (RTC) Branch 112 Judge Jesus Mupas have no knowledge on the alleged tampering of votes in Maguindanao in the 2007 senatorial election.
The former president and her co-accused, former Maguindanao governor Andal Ampatuan Sr., and former election supervisor Lintang Bedol are facing charges of poll sabotage.
Prosecutor Ma. Juana Valeza presented Commission on Elections (Comelec) employees Juan Vergel Soriano of the records section and Retzie Villena of the human resource management office during the bail hearing to identify election documents purportedly showing the tampering of votes.
Soriano is the custodian of the election documents allegedly relating to the case while Villena was the one who allegedly received the ballot box containing the certificate of canvass from Maguindanao.
At the start of the hearing, Santos’s and Bedol’s lawyer, Reynaldo Princesa, agreed to stipulate on merely the existence of the election documents to be identified by Soriano as he had no personal knowledge on the preparation thereof but they later posed objections when Valeza began asking him about the contents of documents showing the voter turnout in Maguindanao in the elections of 2004, 2007 and 2008.
The defense counsels argued that Valeza could not ask questions about matters not covered by the cross-examination and that was not part of the stipulation.
The court, however, allowed Valeza to ask questions relating to the contents of the documents.
Villena for her part testified that she was part of the reception committee that received the ballot box purportedly containing the Certificate of Canvass (COC) from Maguindanao from acting election officer Christina Roan Manara.
However, the defense questioned the documentary evidence showing such receipt did not show that a ballot box was actually turned over by Manara with Princesa saying that Villena submitted a “wrong certification” because it showed receipt of neither the ballot box nor the certificate of canvass as certified therein.
On cross-examination by Princesa both witnesses admitted that they have no knowledge of any tampering of votes in Maguindanao as alleged by the Comelec.
For his part, Santos said the testimonies of Soriano and Villena did not prove anything with respect to the tampering as they had no personal knowledge on the allegations raised against the accused in the case.
The defense lawyers also scored the Comelec for presenting corroborating witnesses before presenting the principal witnesses as the usual trial practice. They said the prosecution should go directly to the allegations since what is being heard is merely the petitions for bail.
Earlier, the prosecution said they intend to submit a total of 249 evidentiary exhibits and 42 witnesses though Valeza said they may dispense with the presentation of the other witnesses if the defense would be willing to stipulate on their testimonies, a fact that the defense said they cannot agree without them being able to see the evidence first.
In a related development, Ampatuan’s lawyer, Sigfrid Fortun, said his client would also join the bail hearings of her co-accused.
All of the accused argued they should be allowed to post bail since the government’s witness against them is weak, with the former chief executive saying the case against her hinged on the lone testimony of former Maguindanao provincial administrator Nurie Unas.

Aquino directs Cabinet to hurry PPP projects approval

PRESIDENT Beningo Aquino III has directed the Cabinet’s economic cluster to accelerate the approval of public-private partnership (PPP) projects.
Spearheading the Philippine Investment Forum at The Peninsula Manila in Makati City, Aquino said the government should not miss the opportunity brought about by the renewed interest on the Philippines from local and foreign businessmen.
“There has to be more speed in terms of giving a thumbs up, or a thumbs down to all the various projects that are under consideration. We cannot afford to think of decades upon decades,” he said.
“We are missing the opportunities that are already extant,” he added.
The President said at least eight PPP projects will be rolled out this year. These include building schools, roads, bridges and airports.
One particular focus is rehabilitation and improvement of the Ninoy Aquino International Airport (NAIA), which now becomes congested as more air traffic is experienced by the country.
“There is a need to really expand our gateways and various studies are underway to determine exactly how best to achieve that,” the Chief Executive said referring to NAIA.
“There are limitations to how much you can expand NAIA especially given the density of the population in the surrounding areas. But that should not stop us from having the facilities available for the tourists,” he said.
Aquino said there is also a study being done on a proposal to build a nautical highway aimed at cutting down travel time from Luzon to Mindanao. He said the proponents of the project want to reduce travel time from Mindanao to Luzon from three days to about 15 hours.
Once this is realized, the President stressed that products coming from the south could easily reach Metro Manila consumers, thus, a big boost to Mindanao’s agricultural producers.
He also hoped to implement simultaneously the North Luzon-South Luzon Expressway given the interest of not only one, but several proponents.
Aquino also expressed hope that the recently approved P60-billion Light Rail Transit Line 1 South Extension project, which will connect the LRT 1 to Cavite province, could be operational before he steps down from office in 2016.
“I have full faith that Transportation and Communication Secretary Mar Roxas will have this extension operational at the soonest possible time. And if I haven’t ridden on it by 2015, I will be very severely disappointed,” he said.
Since he assumed the presidency, Aquino batted for the PPP projects. But so far, only one had been bidded out last year, the P1.4-billion four-kilometer Daang Hari-South Luzon Expressway under the PPP projects. (SDR/Sunnex)

Topacio blasts DOJ over Reyes watchlist order

MANILA, Philippines – Former Palawan Gov. Joel Reyes’ lawyer on Tuesday lashed out at the Department of Justice (DOJ) for including him in a watch-list order in connection with the murder of environmentalist and radio broadcaster Dr. Gerardo “Doc Gerry” Ortega.
Reyes is accused of being the brains behind the killing.
His lawyer, Ferdinand Topacio, said the watch-list order “is most unfortunate and shows the DOJ’s penchant for flouting the law and lawful orders of the courts.”
“The DOJ must be forcefully reminded that Department Circular No. 41 which authorizes the issuance of watchlist and hold-departure orders is the subject of a temporary restraining order by the Supreme Court, the case of Arroyo v. De Lima, et al., which has not yet been lifted. Therefore, there is no legal foundation for such an issuance pertaining to former Governor Reyes. This is on top of the serious constitutional issues involved in the reinvestigation of the case against Gov. Reyes, which is still pending before the Court of Appeals,” Topacio said in a press statement.
Ortega’s family earlier welcomed the finding of probable cause by the DOJ against Reyes for the killing of the radio broadcaster last January 2011.
Speaking to journalists at a news conference, Mika and Erika Ortega, daughters of Doc Gerry, said they felt relieved that the preliminary investigation is already concluded, and the case will now go to trial.
The Ortegas asked the court to issue a hold departure order against Reyes and his co-accused Mario Reyes, Jr., Romeo Seratubias, Arturo Regalado, Valentin Lecias, Armando Noel, Jr., Dennis Aranas, Arwin Arandia, and Rodolfo Edrad once warrants for their arrest are issued.
Topacio, however, said the DOJ may be violating legal processes.
“The DOJ should not consider itself above judicial processes by continuing to impose its will in the face of pending cases in court involving the powers it is now exercising; it should exercise a becoming modesty and give judicial courtesy to the courts, instead of arrogantly performing such acts which it fully well knows will be prejudicial and subjudice, or which may render such cases moot,” he said. “Such blatant disrespect for legal processes should not be the hallmark of a department led by a person who aspires to high elective office.”
“The challenge to the power of the DOJ to issue watchlist orders goes to the very heart of the constitutional presumption of innocence, right to travel, liberty of abode and other indispensable civil and political rights, and the DOJ should be more circumspect in using – and abusing – such prerogatives until after a definitive ruling from the Supreme Court is had in the matter,” he added.

Special kids ‘Reach for the Sky’

MAGALANG — Scores of mentally and physically challenged children benefitted from the “Reach for the Sky 2” project jointly initiated Saturday by the Canon Advocacy Team and the SM Cares.
Some of the kids with disabilities were given a chance to experience flying on board ultra-light aircrafts and Cessna planes at the Angeles City Flying Club Woodland Airpark at Talimundok, Santa Maria, in this town, Saturday.
The children belonged to various organizations, including the Parent Advocates for Visually Impaired Children, Kythe Foundation, Philippine Society for Orphan Disorders, Autism Society of the Philippines, Down Syndrome Association of the Philippines, Saint Francis School–VSA Arts Philippines Incorporation and the Attention Deficit Hyperactivity Disorder Society of the Philippines.
The Philippine Air Force also assisted in this year’s event by providing a chopper, which was used in flying some of the children around the area.
The PWD (Photography with a Difference) — Touching Lives Through Photography as an advocacy began with a chance encounter with 2008 between photographer John Chua and Ian, a 25-year-old youth with autism.
Chua invited Ian and his mother to the Manila Zoo as he had wanted to capture bonding moments between a mother and her son, hoping such photographs would give her solace and inspiration during difficult times.
Margie Escuelta, Canon head of Corporate Communications, said they sponsored and initiated PWD Achievers Reach for the Sky last year so that children may enjoy various activities, including flying.
She said Canon has also been involved in various projects as part of their corporate social responsibility.
The Canon A Team consists of some 80 volunteer photographers at present, according to Escuelta.
As part of its 15th year anniversary this year, Canon is also planning to conduct a basketball clinic for kids with Down syndrome and ADHD.

Pampanga village seen as next ‘Rio de Janeiro’

CITY OF SAN FERNANDO — If plans push through, the Nabuclod Eco-Tourism Adventure Park in the highlands of Nabuclod village in Floridablanca town could be the next world spot in the likes of Rio de Janeiro in Brazil.
The plan to erect a similar gigantic replica of the Risen Christ (Ascension) was mentioned during the Nabuclod Project Technical Working Group (TWG)’s meet recently at Capitol.
Fourth district Board Member Nestor Tolentino, TWG head, expressed glee over the proposal of Sinukwan director and erstwhile arts advocate Peter De Vera to establish an “icon” in the now renowned Nabuclod area.
“If they did it in Brazil, why can’t we?” said Tolentino.
Rio de Janeiro is the most visited city in the southern hemisphere and is known for its natural settings, carnival celebrations, samba, Bossa Nova,
balneario beaches such as Barra da Tijuca, Copacabana, Ipanema, and Leblon. One of the most famous landmarks in addition to the beaches include the giant statue of Christ the Redeemer (‘Cristo Redentor’) atop Corcovado mountain, named one of the New Seven Wonders of the World and Sugarloaf mountain (Pão de Açúcar) with its cable car.
“Nabuclod has some of those now like the cable cars and zip lines. Aside from the icon Christ Ascension, there would also be an icon of the ‘Lady of Nabuclod,’ the Virgin Mary herself, in a selected spot there. Although the proposal of Peter De Vera will undergo close scrutiny in a committee hearing, it will be impossible,” said Tolentino.
Nabuclod has been lately drawing crowds composed of various groups, including non-government organizations to help Aetas and push for environmental advocacies like tree planting.
Consultant Roy Imperial proposed and gained approval for the “plant a tree with commitment,” where every visitor would sign a pledge to take care of a tree or more, with fees that will help sustain the development of Nabuclod.
Also approved during the meeting was the regular English tutorials of Aetas who would act as tour guides, as well as the identification of some five hectares for chili plantations based on the Nueva Viscaya template.

Pampanga gov orders creation of anti-overloading task froce

Pampanga — Governor Lilia G. Pineda has ordered the immediate creation of an anti-overloading task force as a way to protect the roads and bridges in the province against overloading vehicles.

Pineda said the provincial government has collaborated with the Manila North Tollways Corporation (MNTC) for the use of weighing scale.

Owners of the vehicle which will exceed the specific weight will be charged P30.

With this, a memorandum of agreement (MOA) on the implementation of the provisions of the anti-overloading law (Republic Act 8794), will be signed by stakeholders on January 12 at the Pampanga Capitol.

Art Punsalan, head of the provincial government’s Environment and Natural Resources Office, said the provincial government upon the directive of Governor Pineda, will assist in the creation and conduct of the anti-overloading task force.

The task force will be composed primarily of the personnel from the Land Transportation Office, Department of Public Works and Highways, Manila North Tollways Corporation, Philippine National Police and the Pampanga Mayors League (PML).

He said the PML, through Apalit mayor Jun Tetangco, has vowed to support the task force after being asked by the governor to participate actively in anti-overloading efforts.

The Pampanga Truck Owners Association, led by its president Arnold Liwanag, said the group also manifested their support to the said campaign.

Palawan as new exit point of illegal recruiters

PUERTO PRINCESA CITY, Philippines – Illegal recruiters transferred their operations to Palawan province, including island municipalities making them as exit points to Sabah, Malaysia.
The National Bureau of Investigation said the recruiters transferred their operation here and its nearby municipalities in order to elude the intensive operation against illegal recruiters.
According to NBI Regional Director Manuel Almendares Jr., these recruiters came after government law enforcement agencies began strict monitoring of their activities in Zamboanga area.
Authorities have already intercepted hundreds of victims of illegal recruitment and human trafficking here.
But Almendares assyred that although these illegal recruiters and human trafficking are now operating outside Zamboanga City, the NBI regional office is keeping a close watch on them.
“We are now strengthening and intensifying our intelligence gathering of information of the possible re-entry of these illegal recruiters and human trafficking operations,” he said.

NIA to reconstruct Bulacan’s Bulu Dam

MANILA, Philippines – The National Irrigation Administration (NIA) will reconstruct a collapsed dam in Bulacan blamed for the flooding of several towns in the onslaught of typhoon “Pedring” last year.
Other than the reconstruction of Bulu Dam, the NIA’s Regional Irrigation Management–Central Luzon under engineer Reynaldo Puno will implement more than P120 million worth of irrigation projects this year in Pampanga.
It is also undertaking the repair of existing irrigation systems.
NIA Administrator Antonio Nangel said among the projects included in the P120-million fund are the irrigation project in Bacolor town costing P92.15 million; improvement of the SIPPAMA pump irrigation, P9.215 million; and improvement of the TEOBACU-IA irrigation canal facilities, P18.43 million, both in San Luis town.
Nangel has directed Puno to conduct a feasibility study on the reconstruction of Bulu Dam, which irrigates some 1,300 hectares of cash crops and palay in San Miguel town.
The decision to reconstruct the dam, built by the Department of Public Works and Highways for flood control, was reached in a recent meeting of NIA officials with Bulacan officials led by Gov. Wilhelmino Sy Alvarado.
Nangel and Puno said the Bulu Dam reconstruction would cost P400 million to P500 million.
The feasibility study, they said, will be completed by July and the detailed engineering before yearend. They have yet to determine the source of funding.
At the height of “Pedring” late last year, the Bulu Dam collapsed and the water rushed downstream, mixing with floodwaters from the swollen Pampanga River and inundating Candaba, Calumpit and nearby towns for several weeks.
