Court allows Abalos to seek treatment sans order

A PASAY City court allowed Monday former Commission on Elections (Comelec) chairman Benjamin Abalos to seek medical treatment without prior court order in case of emergencies.

nal Trial Court Branch 117 Judge Eugenio dela Cruz, in an order dated March 20, set conditions in granting the former poll official’s request.
One of such conditions is for Abalos’s custodian at the Southern Police District (SPD) to inform the court within four hours after the former Comelec chief is brought to a hospital complete with the findings of the doctors.
The court said the hospital where Abalos shall be brought in or confined should not be more than a radius of 10 kilometers from his place of detention at the SPD headquarters and that he should be guarded by at least four regular policemen from the SPD every time he is brought to the hospital or doctor.
The hospital where Abalos shall be confined is also required to submit a medical report to the court and that in case of routine medical check-up, the SPD shall also secure the court’s written order before he is brought to the doctor.
The court also said that Abalos should be brought back to his detention cell not later than 5 p.m. on the same day he is taken for routine medical check-up.
Dela Cruz is hearing the 11 counts of electoral sabotage charges against Abalos filed by the Comelec in connection with alleged irregularities in the 2007 senatorial polls.
Abalos refused to enter a plea during his arraignment early this month, forcing the court to enter a not guilty plea on his behalf.
On March 7, Abalos through his counsel, Brigido Dulay asked dela Cruz to issue a standing order that would allow his jailers to bring him to the hospital without prior court approval in case of emergencies.
The 77-year-old Abalos has complained of difficulty in breathing and pains in the stomach and jaw and was taken to the SPD clinic on that date.
Last December, he also complained of stomach pains and high blood pressure. His family said he is suffering from gastric ulcer. (AH/Sunnex)

Students to Santiago: Surveys are constitutionally protected

MANILA — Students of various colleges said Monday that there is nothing wrong with publication of surveys, as Supreme Court classified polls as part of the constitutional guarantee of freedom of expression.
The Student Council Alliance of the Philippines (Scap) took exception the comments made by Senator Miriam Defensor-Santiago on the reliability and propriety of the release of survey results in the ongoing impeachment trial of Chief Justice Renato Corona.
“The Supreme Court has ruled several times that surveys are covered by freedom of expression,” Scap national secretary-general Gibby Gorres told Sun.Star.
Santiago earlier said the Pulse Asia survey indicating that Corona is guilty before nearly half of Filipinos can be used to influence the decision-making of her fellow senator-judges.
The senator likewise questioned the reliability of the independent pollster for getting public opinion at the time Corona’s accusers had just finished the presentation of evidence.
“They (Pulse Asia) were not affected at all by the negative response of the public, that was a clear effort to manipulate the result of the impeachment trial,” Santiago said over radio station dzBB.
She also said the survey was contemptuous and an affront to fair justice.
But Scap said: “With all due respect to Senator Santiago, surveys will not fall under sub judice rule on discussing merits of the case since we are not party to the impeachment.”
It cited a decision dated January 28, 2000, when the High Court declared as constitutional the conduct of exit polling, where voters were asked whom they had chosen on Election Day.
This right was challenged in February 2001 with the passage of the Fair Election Act, which contained a provision banning publication of surveys 15 days before national elections and seven days before local elections.
However, the Manila Standard, together with the Social Weather Stations (SWS), asked the SC to declare Section 5.4 of the law as unconstitutional, which eventually ruled to their favor on May 5, 2001.
Scap had conducted a survey to 2,010 students in five universities — Ateneo de Manila University, De La Salle University, Ateneo de Davao University, University of the East, and Tarlac State University.
The survey started when it was Corona’s turn to refute allegations of betrayal of public trust and culpable violation of Constitution.
Of the five schools, four demonstrated high level distrust of Corona with Ateneo de Davao topping the list with 78.3 percent.
Corona’s alma mater Ateneo de Manila, meanwhile, showed only 41 percent expressing lack of trust in the Chief Justice. Thirty-nine percent of the 410 randomly polled students in the Quezon City-based campus were still undecided, while only 21 percent expressed trust in him.
Students, who reportedly follow the developments of the case occasionally, were asked to fill out a written questionnaire from March 11 to 25.
This coincided with defense panel’s presentation of witnesses and evidence pointing that the magistrate correctly declared all his properties in his statement of assets, liabilities and net worth (SALN).
“This should serve as a challenge to Corona to come clean. We reiterate our call to the Chief Justice to open his dollar accounts, take a leave of absence and testify before the impeachment court. We believe if he will continue to hide behind legal technicalities, those who are undecided will eventually shift to the anti-Corona camp,” Gorres said.
The survey, which will be repeated once the Corona camp concludes its rebuttal, has a margin of error of plus/minus five percent at the 95-percent confidence level. (Virgil Lopez/Sunnex)

Palace to Pacquiao: Present proof over tax case

MANILA (Updated) — Malacañang urged boxing icon Manny Pacquiao on Monday to present income-related documents before the court handling the contempt case filed against him by the Bureau of Internal Revenue (BIR) in Koronadal City.
Presidential spokesperson Edwin Lacierda made the comment following Pacquiao’s call to President Benigno Aquino III to order the dismissal of BIR Cotabato City Regional Director Rozil Lozares, who filed the case against the Sarangani representative.
Lozares filed the case against Pacquiao for violating Section 266 of the National Internal Revenue Code after the lawmaker allegedly failed to obey summons from the BIR.
Lozares said the tax bureau issued a subpoena duces tecum (or subpoena for production of evidence) in January directing the Sarangani lawmaker to present income-related documents but Pacquiao supposedly failed to appear before the BIR court.
Earlier, BIR Commissioner Kim Henares admitted that the issuance of a summon was prompted by Pacquiao’s “significant drop” of the taxes he paid in the BIR from 2008 to 2010.
In 2008, Pacquiao was a top individual tax payer, but in 2010, his ranking significantly fell to 113th place in the list of 500 top taxpayers in the country.
Pacquiao dismissed the case filed by the BIR as “pure and simple harassment”.
“I think the case has been (filed) with the court…if it’s already with the court, they should allow the presentation of evidence in court,” Lacierda said.
On Pacquiao’s claim that he already paid taxes in the United States on his bouts there, Lacierda said the government respects the Philippine-US tax treaty.
“He obviously has paid the income tax – the federal income tax in the US for his income abroad,” he said.
However, Lacierda stressed that what the BIR has been looking were those coming from his endorsements in the Philippines.
“My understanding is we’re looking at the local endorsements here in the country,” he said.
Lacierda assured that the government is going after those corrupt officials in the government, including the BIR.
“That’s our policy, our anti-corruption program,” he said.
Henares said the BIR was actually being considerate with Pacquiao since her office only filed contempt charges.
She said the BIR could actually file tax evasion if it wanted to.
Henares urged Pacquiao to just present to the BIR the documents being asked from him.
The provision on “failure to obey summons” provides penalties to persons who refuses “to appear, to testify, or to appear and produce books of accounts, records, memoranda or other papers, or to furnish information as required under the pertinent provisions of this Code.”
Should the boxing champion be found guilty of the charges pending before the prosecutor’s office in Koronadal City, he could face a fine ranging from P5,000 to P10,000 and suffer imprisonment of one year to two years. (SDR/Sunnex)

Government prepares to assist overseas workers in Korean Peninsula

THE government has drawn out measures for the overseas Filipino workers (OFWs) in the event that the tension in the Korean Peninsula heightens, Malacañang said Monday.
Presidential spokesman Edwin Lacierda, in a news briefing, said the Department of Foreign Affairs (DFA) is on top of the situation.
“We already have the measures drawn out by the DFA as suggested by the President in our first meeting,” he said.
Lacierda said the government is aware of the number of Filipinos in South Korea and North Korea if the need to repatriate them arises.
“There are around 55,000 Filipinos living in South Korea and about seven or nine Filipinos in North Korea working in United Nations related agencies,” he said.
Democratic People’s Republic of Korea (DPRK) is planning to launch a satellite between April 12 and 16. Powerful countries, such as the United States and Japan, have been demanding North Korea not to push with its plan.
The DFA has issued a statement joining the other countries in the call.
Lacierda said that the DPRK plan could likely be discussed during the Association of Southeast Asian Nations leaders’ summit in Cambodia next week.
“I think there will be a topic on DPRK. But as to the substance, again, let me hold comment on that. But there is a discussion on DPRK,” he said. (SDR/Sunnex)

Work resumes at Clark construction site

CITY OF SAN FERNANDO — The Labor department lifted the stoppage order it issued on the contractor of a building owned by North Haven Pharmaceutical (NHP) Building after an accident killed four of its workers.
On March 2, four people were killed and nine others were wounded when the wall of the NHP that was being constructed collapsed.
Labor communications officer Jerry Borja, quoting a report by Regional Director Raymundo Agravante to Labor Secretary Rosalinda Dimapilis-Baldoz, said the lifting of the stoppage order was a result of the construction firm’s compliance of the recommendations stated in the cease and desist order (CDO) issued by the Department of Labor and Employment (Dole).
The report said the firm also complied with the violations cited in the Dole’s accident investigation report.
The lifting of the CDO was also result of a series of joint-undertakings by the Dole, Clark Development Corporation (CDC) and TCCI.
Borja said a conference was held at the department’s regional office on March 6 between agency officials, NHP and TCCI. The conference was witnessed by the CDC and representatives from the Department of Public Works and Highways (DPWH).
Those who attended the conference have jointly recommended the demolition of the remaining concrete walls in order to eliminate the presence of imminent danger, he said.
TCCI and North Haven Pharmaceuticals jointly agreed to comply with the recommendation by installing supports to secure the concrete walls and prevent possible collapse prior to the execution of demolition work, he added
A day after the said conference, TCCI submitted its construction methodology wherein the procedures in installing GI support and knock-down methods were enumerated, Borja said quoting Agravante’s report.
On March 12, upon receipt of Dole and CDC evaluation and recommendations for the safe execution of the construction methodology, TCCI submitted a letter expressing their commitment to strictly comply with the comments and recommendations by Dole and CDC. As agreed upon, TCCI installed the GI Pipe Support on the existing walls.
With regard to the company’s failure to comply with Section 5 of Dole’s Department Order 13, series of 1998, regarding non-submission of occupational safety and health program, TCCI, through its Safety Officer submitted its environment safety and health program and likewise a proof of the employment of a Safety Officer, in compliance with Section 7 of Department Order 13 regarding the non-accreditation of full-time safety practitioner with the Dole.
On March 22, Engr. Eduardo Dela Cruz of the Technical Support and Service Division for Labor Relations and Labor Standards of the Dole-Central Luzon conducted a Basic Orientation on Construction Safety for workers involved in the demolition and construction work where the importance of health and safety practices in the workplace and likewise the importance of the usage of the proper personal protective equipment was stressed.
Aside from the orientation, the Dole representatives also witnessed the payment of back wages to 23 workers amounting to P59,942. The said back wages according to Agravante include underpayment of workers, unpaid holidays, rest days worked, and 13th month pay.

Tough leaders not necessarily brand leaders

Top global brands are “created” and “built.” And they sometimes become synonymous with the product. You’ve probably heard “Give me a Xerox copy of that document”, or “Go Colgate your teeth”. How about “Please Hoover the floor,” and “The sun is sharp, I must wear my Polaroids.”

That is the ultimate in brand building.

But is this really true? Yes, it is true, but as competition grows in these areas or as markets change, the market leader may also change. Yet, the initial product and brand may no longer be the market leader or, in some cases, the owner/manufacturer of the “leading brand” may even go bankrupt but still be remembered by the “massa” as the product they know.

Of the examples mentioned above, all have had their heyday and, with one exception, they have lost their way in the market place and no longer dominate their respective markets anywhere in the world. Two went bankrupt but have since made a comeback, where new owners of the brand took over the brand name but have built new and different products using the old brand name, in the hope that their marketing power will be able to re-launch these excellent brand names. Hey guys, this is an extremely tough process that may never succeed.

The main reasons these dominant names of old fail can often be put down to: (1) complacency – when you are number one, always think and act as if you are number two; (2) not being able to change with the times in a changing market place; and (3) seriously underestimating competitors, and being arrogant and inflexible.

Europe and the US dominated the motorcycle market in the 1950s and 1960s; they didn’t see the Japanese coming until it was too late. The Japanese had lower manufacturing costs, more reliable products and ultimately better “price performance”. So BMW and Triumph lost the market lead. BMW, in particular, has bounced back, but in a different market, the superbike marketplace, which is a smaller niche market area. But their comeback depended heavily on the power of their brand name and that they continually produced high quality cars during this period. On the other hand, the Japanese had no idea of how to build a brand name and it took some time for the Honda’s, Yamaha’s and Suzuki’s of this world to become household names—but they did eventually succeed.

Special kids ‘Reach for the Sky’

MAGALANG — Scores of mentally and physically challenged children benefitted from the “Reach for the Sky 2” project jointly initiated Saturday by the Canon Advocacy Team and the SM Cares.
Some of the kids with disabilities were given a chance to experience flying on board ultra-light aircrafts and Cessna planes at the Angeles City Flying Club Woodland Airpark at Talimundok, Santa Maria, in this town, Saturday.
The children belonged to various organizations, including the Parent Advocates for Visually Impaired Children, Kythe Foundation, Philippine Society for Orphan Disorders, Autism Society of the Philippines, Down Syndrome Association of the Philippines, Saint Francis School–VSA Arts Philippines Incorporation and the Attention Deficit Hyperactivity Disorder Society of the Philippines.
The Philippine Air Force also assisted in this year’s event by providing a chopper, which was used in flying some of the children around the area.
The PWD (Photography with a Difference) — Touching Lives Through Photography as an advocacy began with a chance encounter with 2008 between photographer John Chua and Ian, a 25-year-old youth with autism.
Chua invited Ian and his mother to the Manila Zoo as he had wanted to capture bonding moments between a mother and her son, hoping such photographs would give her solace and inspiration during difficult times.
Margie Escuelta, Canon head of Corporate Communications, said they sponsored and initiated PWD Achievers Reach for the Sky last year so that children may enjoy various activities, including flying.
She said Canon has also been involved in various projects as part of their corporate social responsibility.
The Canon A Team consists of some 80 volunteer photographers at present, according to Escuelta.
As part of its 15th year anniversary this year, Canon is also planning to conduct a basketball clinic for kids with Down syndrome and ADHD.
“We want to teach them so that they will be able to maximize their abilities and not their disabilities,” Escuelta said.

Pampanga meat processing firm bags award

CITY OF SAN FERNANDO, Philippines—Madrid-based Business Initiative Directions (BID) gave the Century International Quality Era (CQE) Gold Award to meat processing company Mekeni Food Corp. during its 14th convention on March 11 in Geneva, Switzerland.
Prudencio Garcia, Mekeni president, shared the news last week in a letter to Levy Laus, chairman of the Pampanga Chamber of Commerce and Industry (PamCham).
“We would like to share with you and our PamCham members the good news that once again Mekeni Food Corp. had scored another first in the Philippines’ food industry by being awarded the Century International Quality Era-Gold Award,” Garcia said.
The award, he said, put Mekeni in the league of top global corporations that have been recognized for quality.
In a statement, Laus lauded Mekeni, saying it now serves as a model to Kapampangan and Filipino businessmen in terms of product quality and corporate excellence.
BID, a private organization, selects the winners through the principles of a quality model being implemented by companies in more than 100 countries.
Criteria include customer satisfaction, communication strategies, benchmarking, information and data analysis, leadership, planning and decision making, human resources, processes and production, financial outcome and business results.
The awards are divided into the gold, platinum and diamond categories. Votes from winners came from the BID council, previous winners and online polling.
Garcia said the award was another testimony to Mekeni’s continuing adherence to the highest standards of food quality and safety.
Felix Garcia and his wife, Medicia Santos, both public school teachers, began Mekeni in 1986 as a home-based enterprise making chicharon (cracklings) and tocino (sweetened meat).
They processed the meat from the poultry and piggery in Barangay (village) Balubad in Porac town that they helped manage.
The company was devastated by the eruption of Mt. Pinatubo in 1991, prompting Felix to ask his sons to return from well-paying jobs abroad to rebuild the company and help their town rise again.
