Subic locators cry foul over new BIR order

SUBIC Bay Freeport: Locators inside this Freeport, headed by Subic Bay Freeport Chamber of Commerce (SBFCC) President Danny Piano, protested the new Bureau of Revenue (BIR) order implementing taxes on oil products here.
This after the BIR issued last week Revenue Regulation-2-2012 that would tax oil companies even those inside the Freeport zones starting next week.
The BIR however noted that it would be refunded if buyers can show proof that the oil products were consumed inside the Freeport.
The order was setup to curb reported oil smuggling inside the Freeport of the country.
“In light of reported rampant smuggling of petroleum and petroleum products resulting to substantial revenue losses, it becomes mandatory for the government to immediately implement corrective measures to stop this activity in order to ensure the collection of correct taxes,” the BIR state.
But Piano explained that Subic Freeport is operated and managed as a separate customs territory under Republic Act 7227.
“I think it is questionable that a mere government agency regulation can override a law legislated by the Philippine Congress.” Piano said.
Piano further explained that the regulation, while targeting importers, will eventually affect and inconvenience all locators.
This is because of the provision that “no claim for refund shall be granted unless it is properly shown to the satisfaction of the BIR that said petroleum or petroleum products have been sold to a duly registered locator”, according to Piano.
“It is very disconcerting that investors and locators are the ones who will be penalized and forced to take the brunt of additional bureaucracy when the solution to the problem simply lies in government agencies doing their jobs,” Piano added.
“We appeal to Finance Secretary Cesar Purisima and BIR Commissioner Kim Henares to rescind RR 2-2012, and to our legislators and President Aquino to repeal this overreaching and burdensome regulation.” Piano said.

PNoy-Pawikans released in Subic bay

SUBIC Bay Freeport: A resort here released more than 100 turtle hatchlings which was all named ‘PNoy Pawikan’ Wednesday.
Mark Dayrit, owner of All Hands Beach Resort said that more tha 60 foreign students from an international school released the ‘PNoy Pawikans’ which coincided with the President Benigno Aquino’s birthday last February 8.
All Hands beach has become an instant tourist attraction after several batches of Pawikan were released since December last year.
The company has already taken measures to make the beach resort into a sea turtle nesting site.
“We have already contacted the Ecology Center of the SBMA (Subic Bay Metropolitan Authority) and have asked their support in helping these animals,” Dayrit said, adding that the resort staff was given proper training in taking care of the turtles.
He also said that the Ecology Center has given them five tags to identify the mothers that lay their eggs on the resort’s beach. The center also gave them a chart to record the number of eggs laid along with a guide on how to relocate the eggs to a safer place within the beach.
All Hands is also making elementary and high school students aware of the need to protect these animals by giving free lectures on the life of a sea turtle before some hatchlings were released.
“We want to make sure that the kids get firsthand experience on how to handle these animals. Awareness is the key in the survival of the sea turtles,” Dayrit said.
The resort has successfully released 5 batches of turtle hatchlings, 4 more batches are expected to hatch and release in the coming month.
One of the species who recently laid eggs was a Hawksbill sea turtle.

They share time, money to lift lives of poor Kapampangan

In 1987, a year after People Power I swept her to the presidency, Corazon Aquino inspired 35 people to return to their roots in Pampanga and, since they were successful in their respective careers, share their talents, time and money to help lift the lives of the poor among their cabalen (province mates).
Twenty five years later, the Kapampangan Development Foundation (KDF), left with just 11 founders, continues to help the poor.
“Many individuals and groups have joined us in this journey of volunteerism. And we realized that President Cory’s idea back then is the PPP [private-public partnership] her son, President Aquino, is doing today,” KDF president Benigno Ricafort said in a program celebrating the foundation’s anniversary.
The work has been life-changing.
Ryan Tuazon, 13, is due for enrolment this June in Grade 1 after his cleft palate had been corrected. Rusty Bognot, 18, received an artificial leg, enabling him to work in a guitar factory, while Augusto Ramos, 70, also received an artificial leg so he can continue working by delivering garments.
Jaime Santos, 56, signed up as a KDF volunteer after a cataract operation restored his eyesight.
But it took Margarita Juico’s flashback for the audience to know the beginnings of KDF and the work it has been doing.
“I cannot help but feel nostalgic, even sentimental that when you started KDF in 1987, I was with President Cory as her appointments secretary. I certainly remember KDF. I saw how President Cory was very proud of the Kapampangan who organized themselves to rally behind her to help the Kapampangan region,” said Juico, now chair of the Philippine Charity Sweepstakes Office.
The KDF, she said, organized a big dinner and meeting at the Manila Hotel where more Kapampangan pledged support for its program, then called Rich (Rural Industrialization Can Happen).
“President Cory was your guest. I remember how often KDF sought my help in getting President Cory’s presence in inaugurating KDF projects in Pampanga, Tarlac and San Miguel, Bulacan. I was informed that the livelihood programs that KDF initiated became templates and models for the Mt. Pinatubo resettlement communities that were built later on by the rehabilitation task force,” Juico said.
Model
The KDF, she said, had become a model for the other provinces in harnessing the power of private sector organizations in helping people.
Ricafort considers 2007 a golden year because after being invited by the Ateneo School of Government to meet with four new provincial governors, the KDF decided to focus on addressing physical disabilities and decreasing maternal and child deaths.
Through 50 partners pooling health professionals and resources together, KDF had given artificial legs to 370 people, wheelchairs to 399 people, operations to 547 children, cataract surgery to 760 elderly, and medical examinations and medicines to 2,832 women and children.
It also gave free circumcision to 248 boys, dental care and tooth extraction to 263 people, walkers, crutches and canes to 188 people and mobile laboratory and X-ray services to 170 others in the last four years, a report showed.
Ricafort said he and the founders, who include Br. Andrew Gonzalez, former President Diosdado Macapagal, Rizalino Navarro, Fortunato Aguas and Lamberto Ocampo, were only after the “gantimpala ng langit” (reward from heaven) for why they formed KDF.
“From out of the goodness and the blessings we have received, I think it was natural to be thankful to God and share the blessings,” he said.
Archbishop Paciano Aniceto honored KDF by saying it renders faithful and generous services to the poor.
Among the steady partners are the Rotarians, Lions, Quota International, Operation Smile, Mother Teresa of Calcutta Medical Center, Social Action Center of Pampanga and Arellano University.

Wind, solar projects in Subic backed

SUBIC BAY FREEPORT—Business groups and residents opposed to a coal-fired power plant for Subic have urged President Aquino to invest instead in alternative energy for the freeport.
Former Environment Undersecretary Gregorio Magdaraog, coconvenor of the Subic Anticoal Coalition, said the Aquino administration may use Subic to promote its alternative energy policies to avoid destroying the freeport’s tourism appeal.
In various public consultations last year, Energy Secretary Jose Rene Almendras said the 600-megawatt coal-fired power plant would be needed to keep Luzon’s power supply steady in the near future.
The plant will be built and managed by RP Energy Inc. (RPEI), a consortium composed of Aboitiz Power, Manila Electric Co. and Taiwan Cogen Corp.
There are projects in the Subic Bay Metropolitan Authority (SBMA) pipeline that the government could tap to build an alternative energy model for Subic, according to a freeport official who requested anonymity because he was not authorized to speak on the subject.
The official cited the contracts approved under the present SBMA board with the Energy Logics Group Inc., the Hydro China Subic Ltd Corp. and the Energy Logics Philippines Inc. All these projects have a combined committed power supply of 503 MW.
These projects, which amount to $1.188 billion in investments, could provide the amount of power to the Luzon grid in place of RPEI’s coal-fired plant, the official said.
“We commend and endorse the implementation of a $450-million solar and wind power energy project that [the board] signed with Hydro China that will showcase Subic Bay Freeport as a center for renewable energy,” Magdaraog said in the statement.
SBMA Chairman Roberto Garcia, in a recent roundtable discussion with Inquirer editors and correspondents, said Hydro China had put up two wind towers in the freeport so it could record the strength and frequency of wind in the area in preparation for the project.
Garcia said the tests, which would last a year, are proceeding smoothly.
“It looks okay because the towers are in a high altitude area,” he said.
At least 155 representatives of local governments, the zone’s business locators, freeport workers and residents rejected the coal-fired power plant project when they participated in a mandated Social Acceptability Process (SAP) in December last year.
The SAP results had been submitted to President Aquino, according to Garcia. “The [SAP] report that SBMA [sent] to the Department of Environment and Natural Resources and the Office of the President validates our claim that there is overwhelming opposition to the RPEI coal-fired power plant,” Magdaraog said.
Alex Hermoso, lead convenor of the Zambales-Olongapo Civil Society Networks, said: “We are not against the provision of additional power to supply the national grid. But power production must also be environmentally responsible.”
“This is really the bone of contention, we are against coal as fuel [to generate electricity], but some would misrepresent our position (and SAP) as being antienergy, which is not so,” he said.—Robert Gonzaga, Inquirer Central Luzon

Pampanga group draws lesson from CJ trial

CITY OF SAN FERNANDO—A civil society group in Pampanga began last week a campaign encouraging all incumbent elected and appointed officials in Pampanga to disclose their statements of assets, liabilities and net worth (SALNs) in the run-up to its April 30 filing deadline.
The Kapampangan Manalakaran Inc. (Kamai) said the officials, starting from Gov. Lilia Pineda down to barangay leaders, should make public their SALNs during their years of service in government by posting this in the official website of their local governments.
The local SALN campaign was inspired by the impeachment trial of Chief Justice Renato Corona, said lawyer Ma. Amelia Tiglao-Cayanan, Kamai spokesperson.
“The impeachment trial of Chief Justice Renato Corona has come down to issues of public leadership and accountability: honesty, trustworthiness and loyalty to duty,” Kamai said in a statement.
“The same trial is a test of our nation’s democracy as it is a time for our people to reckon with truth,” it said.
The SALN, it added, is a yardstick of honesty and transparency and anchored on the maxim “public office is a public trust.”
The Code of Conduct and Ethical Standards for Public Officials and Employees (Republic Act No. 6713) requires government officials to file their SALNs.
“The 2013 election is around the corner and our cabalen (province mates) should be well informed on the net worth of our government officials, who are running the affairs of different barangays, cities/towns, districts, party-lists, and the province of Pampanga,” said Kamai.
Candaba Mayor Jerry Pelayo, president of the Pampanga Mayors League, said he would disclose his SALN provided those in Congress, especially members of the prosecution in Corona’s impeachment trial, would disclose theirs.
“It should start from the top,” said Pelayo.

1 hurt in hold-up incident in Olongapo

OLONGAPO City: A driver was shot in the neck but was able to take himself to the hospital after a robbery hold-up try in Barangay Mabayuan, Olongapo City Monday evening.
According to a police report the robbery hold-up occurred around 8:45pm along Otero Ave in Barangay Mabayuan.
The suspect which has yet to be identified by authorities pulled out a gun and declared hold-up and took the bag of 2 victims identified as Solly Rayang and Rose Focbit.
The driver of the jeepney with Body No. J03-018 and Plate No. CWA 400 identified as Noel Ulanday saw the commotion and stopped the jeep and tried to intervene but was shot by the suspect in the neck.
The suspect fled the scene with another suspect riding a motorcycle and escaped.
The suspect manage to take P1,300 and a mobile phone.

Congress to probe missing cars in Subic

SUBIC Bay Freeport: The House of Representative approved House resolution 1664 which sets to probe the disappearance of some 1,800 imported second-hand vehicles which was supposed to be in storage in different areas inside Subic Bay Freeport.
Filed by Quezon City 2nd District Representative Winnie Castelo, the resolution paves the way for the Ways and Means committee to formally probe the issue.
Castelo was quoted as saying “Subic locators should explain where these used and imported vehicles are now or come out with the latest official inventory to account for each vehicle.”
The inquiry stemmed from earlier reports that some luxury vehicle were missing in Subic among these are a Jaguar, Porshce, Mercedes-Benz, Land Rover, Chrysler and Ferrari.

Govt building budget air terminal in Clark

THE government plans to put up an P8-billion terminal for budget carriers in Clark, Pampanga, to accommodate the “spillover” traffic from the Manila International Airports’ congested terminals, an official said over the weekend.

Clark International Airport Corp. president Victor Luciano said the state-run firm was now preparing another public-private partnership project to build another terminal at the Diosdado Macapagal International Airport, which would be up for bidding next year.

“We will draft the terms of reference to be approved by the national government,” Luciano said.

He said the terminal, to be patterned after the Kuala Lumpur International Airport, would occupy 40 hectares and have a maximum annual capacity of up to 10 million passengers.

“In two years that will be finished,” Luciano said.

He said a city air terminal in Northern Metro Manila was also being planned to complement the terminal for budget carriers. It would allow passengers to save on extra traveling costs because shuttle buses would take them to the airport.

Luciano said his agency had allotted P120 million to build the new terminal while a private partner would put up a counterpart fund. The winning bidder is to build and manage the terminal and run the shuttle buses.

Meanwhile, Luciano said Metro Pacific Investments Corp.’s plan to put up a terminal in Clark had not yet been proposed to his agency. Only San Miguel Corp. had formally submitted a proposal to build one.

“[San Miguel] has submitted a proposal for Terminal 2, and we are looking at that now. That’s independent of the planned budget terminal,” Luciano said.

The airport in Clark is 85 kilometers away from the Ninoy Aquino International Airport. It is the main airport serving the Clark Special Economic Zone. The airport handled 607,704 international passengers and 46,525 domestic passengers last year.
