THE Department of Justice (DOJ) has recommended the filing of criminal charges for violation of the Intellectual Property Code against officers of Bangkok-based manufacturer of energy drink Red Bull and its local product distributor for unfair trade competition and conspiracy to commit fraud through misbranding.
In a nine-page resolution, Justice Undersecretary Jose Vicente Salazar found probable cause to indict the officers of Thai company TC Pharmaceutical Industries Co. Ltd, makers of the popular energy drink, and Maryland Distributors Inc. for violation of Section 168 in relation to Section 170 of RA 8293 (Intellectual Property Code) and Sections 11(g) and 15(a) of RA 3720 (Food, Drug and Cosmetic Act).
Charged were Thai nationals Pavana Langthara, Suthirat Yoovidhya, Supreeya Yoovidhya, Nucharee Yoovidhya, and Visuit Chiemkitchavarote, who are all officers of TCP. Also named respondents were MDI officers Gino Baltao, Gina Tolentino, Ramoncito Abad, Benjamin Ros, and Nelson Escobar.
The complaint was filed by Energy Food and Drinks Inc., a local company originally appointed by TCP in March 2003 as its exclusive distributor of Red Bull Supreme Energy Drink. EFDI obtained a Certificate of Product Registration for Red Bull with the BFAD, which was to expire on March 31, 2013.
The case reached the DOJ after complainant appealed the findings of the city prosecutor of Legazpi, Albay that dismissed the charges it filed against its Thai partners and Maryland despite the evidence culled by the National Bureau of Investigation (NBI).
In its complaint, EFDI claimed that in 2009, it discovered the proliferation in the market of Red Bull bearing labels it registered with the Bureau of Food and Drugs but tampered with by Maryland, thus, prompting it to file a complaint with the NBI.
The NBI then conducted a series of test buys where Red Bull bottles with tampered labels of complainant were recovered. It found out that the bottles’ logo stating that EFDI is the authorized Philippine importer of Red Bull was covered or superimposed with stickers that stated that it was manufactured by TCP and imported by Maryland, which is based in Taytay, Rizal.
The complainant said it only learned after TCP published an advertisement that the latter already terminated the appointment of EFDI as its Philippine distributor for Red Bull since October 2008, and that it had already filed with BFAD a notice to cancel the Certificate of Product Registration previously issued to EFDI.
This prompted EFDI to file a case before the Legazpi city prosecutor’s office, which ruled to dismiss it on the ground that the issues raised in the case is not alleged violations of RA 8293 and RA 3720, but “a civil dispute over a product distributorship agreement.”
The unfavorable ruling of the city prosecutor prompted it to file the case before the DOJ.
Ruling on the case, Salazar said there is sufficient evidence showing that respondent TCP and Maryland officers conspired “when they acted in unison in violating the property rights of EFDI.”
“Complainant was able to adduce sufficient evidence that respondents, in conspiracy with one another, engaged in unfair competition. The importation of Red Bull products, the tampering of the product label and the proliferation thereof in the market constitute ‘underground sales and marketing’ of red Bull products, which undermined the property rights of herein complainant EFP,” the resolution stated.
The DOJ added that a food shall be deemed misbranded if its labeling is false or misleading in any particular.
Salazar said that since complainant EFD was the exclusive distributor, its name must be indicated in the label of Red Bull products.
Citing a Supreme Court case, he said the right to perform an exclusive distributorship agreement and to reap profits resulting from such performance is a proprietary right that a party may protect.
“In the instant case, however, the bottles of Red Bull bore tampered stickers/label,” the DOJ said in the resolution.
The DOJ noted that EFDI had established a trade or business in which it had acquired good will from 1993 up to the discovery in the market of Red Bull with tampered labels in 2009, or for a period of 16 years.
“In the course of its operation, EFDI’s business has certainly acquired value beyond its assets, arising from the reputation complainant EFDI established with its retailers and clients. This goodwill, which results from being the exclusive distributor of Red Bull, is entitled to be protected from any illegal use by an person,” the DOJ added.

SENATORS will hold hearings beginning on Monday on the proposed P2.006-trillion national budget for next year to ensure its passage before yearend, Senate finance committee chairman Franklin Drilon said.
The budget season will kick off with a two-day briefing by the inter-agency Development Budget Coordination Committee (DBCC) on macro-economic targets, revenue generation and expenditure programs in 2013.
The DBCC, which prepares the national budget, is composed of the Secretaries of the Department of Budget and Management (DBM) as chairman and of the Department of Finance and the National Economic and Development Authority (Neda) as members.
The Office of the President is also a member, and the Bangko Sentral ng Pilipinas (BSP) serves as a resource body.
After the DBCC are hearings of the finance sub-committees on the proposed budgets of various national government departments, as well as of government-owned and controlled corporations (GOCCs) starting Wednesday with the Commission on Elections (Comelec) being the first to be grilled.
The Comelec earlier slammed the DBM for trimming its budget from the proposed P24 billion to only P8 billion to conduct the midterm and barangay elections to be held in May and October 2013, respectively.
Comelec Chairman Sixto Brillantes said the budget is not enough considering payment to teachers and the military who will be tapped to ensure peaceful elections.
But Malacañang said the Comelec has enough savings to bankroll operations after it decided to buy over 80,000 precinct count optical scan (PCOS) machines that were used in the 2010 presidential election.
President Benigno Aquino III has since promised to act as mediator to resolve the impasse.
Expected to get attention as well is the conditional cash transfer – the administration’s flagship poverty alleviation program – because of its huge allocation.
The Department of Social Welfare and Development (DSWD) will get P44.26 billion to implement the CCT in 2013, an increase of 12.2 percent from this year’s allocation of P39.45 billion.
The hearings by the sub-committees are expected to last until end of October creating ample time for plenary deliberations by November, said Drilon.
He said Congress will be able to pass the budget before December 31, a trend, which began on Aquino’s assumption to power in 2010.

PORAC — Mayor Condralito dela Cruz said over the weekend that he has ordered the closure of the Manuali transfer facility here, as the town is now implementing a strict “no segregation, no collection” policy among all its barangays to reduce the total generated garbage here.
“The facility is now totally closed,” Dela Cruz said.
Dela Cruz told Sun.Star Pampanga that the move is in compliance with government standards on solid waste management and a serious response to the call of Governor Lilia Pineda to implement a strict segregation programs in barangays so that only residual waste is collected for disposal in landfills outside Pampanga.

“We have met with various barangay and community leaders and we are now implementing the program. If it is not segregated, we will not collect it,” Dela Cruz said.
Dela Cruz said that segregation helps in recycling waste that could still be reused, like plastic bottles, newspapers, plastic bags, cans and the like.
He said that segregation is also the start of community awareness towards the importance of caring for the environment.
To facilitate the further segregation of collected waste, Dela Cruz said he has ordered a material recovery facility to be operational in Barangay Mitla.
In a meeting with village chiefs and garbage collectors of the town, Dela Cruz and Vice Mayor Dexter David said the “no segregation, no collection” policy will take effect immediately, and violators, from the household source to those found dumping garbage indiscriminately along waterways and public places, would be dealt with accordingly based on the provisions of Ecological Solid Waste Management Act 9003.
The mayor added that they welcome the plan of Pineda to privatize the solid waste management programs for the province.
He said millions each year is devoted to garbage collection and disposal alone in Porac town.
Pineda earlier said she is seriously considering privatizing the garbage disposal of Pampanga in a bid to save on enormous cost on garbage collection and provide an effective garbage segregation program.
The governor said the move will greatly help local government units meet garbage costs. She said the province will at least spend P1 billion in garbage disposal and segregation if the Provincial Government will be taking care of garbage collection.
“Even now, the municipalities are already spending a big amount of money on garbage collection,” Pineda said, stressing that communities should also have a responsibility towards their own garbage and help their respective local government units.
Under the plan, households in respective barangays would be asked to chip in a small amount for the garbage generated in their respective homes. The garbage generated should be segregated and only residual garbage should end up in dumpsites.
The Provincial Environment and Natural Resources Office (Penro) earlier projected a total of P1.4 billion annually for the hauling of the garbage produced by all towns in Pampanga to the Kalangitan Sanitary Landfill in Capas, Tarlac.
Arturo Punzalan, Penro chief, said this during the presentation of the current situation of various dumpsites in the province with local chief executives, environmental groups and other stakeholders.
“Ang gastos pa lamang natin sa hauling ng basura ay P15,000 kada truck,” Punzalan said.
He said the current condition of the open and controlled dumpsites has reached an alarming state.
This came despite the massive campaign by Penro last year on waste segregation, including the establishment of clustered material recovery facilities in various localities.

STO. TOMAS — Mayor Joselito Naguit said over the weekend that the P9.5 million in cash advances he allegedly made for the months of May to November 2011 were all returned, accounted for to the last centavo and deposited in the municipal fund of Sto. Tomas.
This, Naguit said, is contrary to the accusations of former municipal administrator Rodelio Garcia that the amount was used by the local chief executive for his “personal gains.”
In an exclusive interview with Sun.Star Pampanga at his house Saturday afternoon, Naguit pointed to attachments — bank statements and journal entry vouchers — in his counter-affidavit submitted to the Office of the Deputy Ombudsman for Luzon on July 23 this year.
“Contrary to the allegations of the former municipal administrator, each and every cash advance was duly accounted for and returned not even fully used or liquidated but directly deposited in the municipality’s PNB Bank account, within the parameters required by law. There were seven withdrawals corresponding to seven cash advances and there also seven deposits equivalent to the seven withdrawals. There was a total amount of P9.5 million in cash advance for the period of seven months from May to November in 2011 and no less than P9.5 million was likewise deposited for the said cash advances,” he said.
“None of those took more than 30 days from withdrawal to return as predominantly un-used cash advances because their intended contingency or purpose were no longer needed or did not fully materialize,” he said.
He added: “There were actual withdrawals made in support of the cash advances but all were regular, fully documented and were in accordance with accounting principles observed by the local government of Sto. Tomas.”
Naguit vehemently denied the claims of Garcia that the cash advances from the general fund that were allegedly “later on shifted as a misappropriation of the 20 percent development fund” were used for his personal gains like his alleged “jueteng” business in Tarlac and restaurant in San Matias.
“None of those funds is unaccounted for and were taken by myself for the purpose of covering my alleged losses in an alleged jueteng operation or STL business, or for the purpose of building a restaurant. I am not the owner, incorporator or stockholder of that Northrails Resources Inc. Garcia is pointing to as the STL (small town lottery) operator in Moncada, Tarlac. I am not aware of their dealings and of any jueteng operations in that province. In my SALN (statement of assets, liabilities and net worth), the said corporation is nowhere to be found and my name never appeared in their corporate documents. I do not own, operate and am not interested in STL business or jueteng operation especially not in the province of the President,” he said.
“Funnside Ningnangan is not one of my assets as reflected in my SALN but is actually owned by my brother, Architect Josefino F. Naguit Jr., in equal partnership with Librada G. Manlapaz of Apalit. The restaurant is a small partnership in the amount of P1 million and not P4.5 million as Garcia impressed that would need three months of cash advances to be completed. It is a known fact that our family has been in businesses even before I ventured into politics. And Garcia knows that fully well,” he said.
“Simply put, nothing is missing contrary to the allegations of the former municipal administrator whom — for the record — I fired because of unprofessional behavior and petty misconducts about money. For a fourth-class municipality like Sto. Tomas, which is IRA (internal revenue allotment) dependent, with just P54 million in total income (which is not readily available at the start of the year but given monthly at around P4 million), the non-return of the alleged malversed P9.5 million would paralyze the municipality. Hence, to take P1.5 million each every month for seven months would be tantamount to not being able to give the salaries of most municipal employees or failure to operate the various offices since the current operating expenses of the municipality for 2011 which includes the salaries of employees is more than 50 percent of the total budget of the municipality. Again, nothing is missing,” he said.
Naguit reiterated that the belated filing of the charges against him is pure harassment and is clearly politically motivated.
In his affidavit, the mayor noted: “If indeed there was misappropriation of the subject amount, how come from May 2011 it is only now after he (Garcia) became closely associated with the incumbent vice mayor that he is complaining. The only reason he did not file any case at the time of the questioned transaction is because the said transactions were done in accordance with the law and there was never any single centavo unaccounted for. On the other hand, the only reason for the belated filing of the case is to harass me as revenge for not agreeing to extend and prolong his appointment as municipal administrator.”
“More importantly, the present complaint is a political tool to discredit my third term re-election bid this coming election. In fact, this is the ultimate goal and the very reason why another person associated with the vice mayor is also… filing two complaints on the same subject matter, one with the Commission on Audit and another with the Office of the Local Government Finance (Department of Finance). To make it simple, the present case is merely a harassment suit for political mileage and for the purpose of discrediting my person for the ultimate purpose of having the possibility of my person being suspended,” the mayor said.

FLORIDABLANCA, Pampanga — “The governor of Pampanga has an ‘eye’ for potential development in tourism.”

Thus said members of the Angeles City Library staff led by Agnes Gomez after their recent team-building in barangay Nabuklod here.

Gomez, member of the Alliance of Travel and Tour Agencies of Pampanga (ATTAP) and owner of the D Travel Shop in Angeles, said Pineda has foreseen the development of Nabuklod way before others did.

“The place will attract tourists from all walks of life regardless of their age. The governor really has taste and her eyes are wide open when it comes to beauty yet to be fully discovered,” said Gomez, whose group led by ATTAP president Gilda Padua has vowed to help the provincial government promote Nabuklod and other premiere destinations, including the old Roman Catholic churches in Pampanga built by Spanish priests way back in the16th and 17th centuries.

Gomez and Padua are excited for Pampanga’s future in tourism as international and local flights at the Clark Airport now number at least 300 weekly.

Pampanga Capitol officials, including General Services Office (GSO) chief Royce Pring, said the governor is “very passionate “in the over-all development of Nabuklod as a tourist destination and agricultural area.

“If you want to make the governor happy, talk about Nabuklod or anything about Aetas,” said Provincial Administrator Andres “Jun” Pangilinan in his conversations with journalists.

The provincial government is batting for a holistic approach in the development of Nabuklod, Pampanga’s newest tourist attraction and home of Floridablanca-based Aetas.
