PANTABANGAN, Nueva Ecija – Rep. Teddy Casiño pressed for a full dress investigation on the condition of the Pantabangan Municipal Electric System (PAMES) even as power has not been restored in the municipality as of press time.

But Casiño, who chairs the House committee on energy said he motored to the town to personally hear the sentiments of townsfolk regarding the issue that the local government is facing with the power producer First Gen.

“Alam naman natin nagkaroon ng mukhang mismangement sa power distribution company,” he said.

“Gayunpaman ang importante para sa atin ngayon, maibalik kaagad yung kuryente.,”

He said the provincial government and the National Electrification Administration can come up with a measure to immediately reconnect the electricity for the benefit of the residents while an audit of PAMES transactions is being conducted.

He also said that the PAMES franchise is already up for renewal and this could be the best time for a probe.

He said he will make sure the franchise would not be renewed unless its finances are properly audited and accountable people are made to pay.

“Managot ang dapat managot,” he said.

Tension rose when Vice Mayor Romeo Borja, Jr., decided to face the crowd, which police estimated at about 120 people, and started enumerating the names of those people and entities who owed PAMES, including the leaders who spoke prior to his attendance.

He said naming them gave him a heavy heart but had to do it to prove that it was his father’s fight for his constituents that resulted to the power cut-off.

He first mentioned villages such as Malbang whose head, Danilo Padilla, also belonged to the picket speakers.

Malbang, he said, had P1.4 million debt. Villarica, which host the power plant, owed P2.3 million.

While doing it, however, someone from the crowd shouted “bulaan” apparently referring to the vice mayor.

Among those he named who supposedly failed to settle bills with PAMES were the protest group La Solidad leader Bienvenido Reyes who allegedly has 10 months unpaid bills amounting to about P25,000; a resort owned by another protest leader Dr. Bernardo dela Merced with some P268,000 debts for 18 months; Padilla has 31 months, P41,000; former Mayor Ruben Huerta, five months, P11,000; Coun. Teodora Agustin, 47 months, P119,000, among others.

The vice mayor admitted he himself has an outstanding bill for eight months.

In reaction, Reyes said he will castigate his wife as soon as he went home for no -paying the bills.

But Borja said they did not blame the people for failing to pay their bills and instead run after FGHPC with allegedly undervalued equipment declaration.

“What we are saying is that it’s the billionaire company that should pay properly,” he said, adding that FGHPC enjoys a five-month tax moratorium that would amount to roughly P100 million.

LUBAO, Pampanga- Confirmation that former President, now Rep. Gloria Macapagal-Arroyo would seek reelection next year in this province’s second district has fueled anew a search for her opponent.

Architect Adonis Simpao, who was the official candidate of the Liberal Party (LP) against Arroyo in the 2010 congressional race in the district, said he would not run again, but stressed he would help search for a worthy opponent to Arroyo.

Kapampangan journalist Randy David, who initially announced he would challenge Arroyo in the 2010 polls but backed out later, said in a text message to Punto that “I have no plan to run in Pampanga in the next elections or to embark on a political career. Politics is not my vocation.”

David, a native of Barangay Betis in Guagua in the second district, explained that “I thought of opposing GMA (Arroyo’s initials) in order to send her a strong message: that it was not right or fair for a sitting president to seek a lower office at the end of her term so she could continue political power.”

But even now that Arroyo is no longer president, David indicated she should already “step aside.”

“Pampanga deserves and needs the infusion of new and young blood. Mrs. Arroyo should step aside now, graciously retire and let the younger generation have a chance at public service,” he said.

Former governor Eddie Panlilio, whose request to be reinstated as a full time priest has remained pending after his suspension when he run and become Pampanga governor in the 2007 elections, could not be reached, but his brother Gerry said he was not anymore interested in running for political office.

Panlilio was named LP chairman in Pampanga when he ran but lost in the 2010 gubernatorial race against Gov. Lilia Pineda.

Despite his shying away from politics, Simpao said he would remain active in “civil society” concerns of the group Kapampangan Manalakaran, Inc. (KMI) which he helped found with Panlilio.

KMI, which advocates good governance and responsible citizenship in Pampanga, backed charges against Arroyo who recently posted a P1-million bail on charges of electrical sabotage before a court in Pasig City.

“We are still looking for somebody who can challenge GMA. We are not short of qualified Kapampangans, although as of the moment, there is no one person we can yet name,” Simpao said.

In the 2010 elections when she was still president while campaigning for the congressional post, Arroyo was accused of using the resources of her administration to woo voters in the second district.

Political observers in her district noted that while she no longer has access to the same powers in 2010, Arroyo still has enough resources to win the support of her constituents in the 2013 polls.

They noted that Arroyo is the biggest recipient of pork barrel in Congress, with a P2.2-billion lump sum pork barrel from the Department of Public Works and Highways budget, on top of her P70-million PDAF pork, the P50-million extra infrastructure pork, another P28 million on top of that, and the P25-million windfall from the Road User’s Tax.

This was uncovered last year when Akbayan Rep. Walden Bello revealed that Arroyo had used her influence when she was president to make sure that her district would get a lot of projects funded by “multilateral lending agencies” from Japan and South Korea.

Public Works Secretary Rogelio Singson later said that the huge funds secured by Arroyo were committed by foreign aid agencies like the Japan International Cooperation Agency and the Korea Development and Cooperation Fund, and that the government could violate these commitments.

THE Supreme Court (SC) will rule Friday on whether to allow two representatives from Congress in the membership of the vetting body Judicial and Bar Council (JBC).
Gleo Guerra, SC spokesperson, said the magistrates will continue deliberations Friday so that the JBC may be guided on how many representatives of Congress should be allowed to join their deliberation on Monday on who should be shortlisted for the position of Chief Justice.
The High Court held oral arguments Thursday on the petition filed by former solicitor general Francisco Chavez, who questioned the present eight-member composition of the JBC, which he said runs counter Section 8, Article 8 of the Constitution, which explicitly states that there should only be one representative from Congress.
Only nine justices participated in the oral arguments, while five magistrates who were nominated for the top SC post took no part, namely: Acting Chief Justice Antonio Carpio, Presbitero Velasco Jr., Teresita Leonardo-de Castro, Arturo Brion and Maria Lourdes Sereno.
Justice Arturo Abad, who was also nominated, however, took part. Sitting as acting chair during the hearing was Justice Diosdado Peralta, who is concurrently the acting chair of the JBC.
During the oral arguments, Senator Joker Arroyo, who represented Senator Francis Escudero, who sits as member of the JBC, together with Iloilo Representative Niel Tupas, labeled as “plain inadvertence” the wordings of the constitutional provision that there should be “a representative from Congress” in the composition of the JBC.
Arroyo told SC magistrates that Section 8, Article 8 should be taken in the context of a unicameral system of government, which was the original intention of the framers of the 1987 Constitution, instead of the present bicameral system where the legislature is divided into two chambers – the Senate and the House of Representatives.
He said the oversight was made at the time when the 1987 Constitution was being drafted, and the country was shifting to a bicameral form of government. He insisted that the JBC will not be complete with just one branch of Congress – either Senate or the House of Representatives – represented.
The senator said the High Court should take a long look in the constitutional provision and take into consideration the intent of the framers.
He pointed out that the five Chief Justice who sat at the SC since the 1987 Constitution was drafted exercised judicial activism by becoming policymakers and not just interpreters of the law when they “relaxed” said provision and allowed two representations for Congress in the JBC.
“When the situation calls for judicial remedy, the court should answer to it, it should respond. A single petition by one petitioner will override already what other chief justices in their wisdom, allowed. They’re happy enough with eight members, so why change it? Changing it will only cause problems. Why fix, what ain’t broke? What I’m saying is that, it will not be a new approach; it has been done in the past. It can be done now,” he said.
“The only issue is, should we follow the letter (of the Constitution) or should we follow the intent? I respectfully submit we should follow the intent,” he added.
Aside from a representative of Congress, the JBC is also composed of the Chief Justice as ex officio chairman, the Secretary of Justice, and a representative of the Congress as ex officio members, a representative of the Integrated Bar of the Philippines, a professor of law, a retired member of the SC, and a representative of the private sector.
SC justice Jose Catral Mendoza, who earlier penned the majority decision in favor of Chavez’s petition, agreed that there should only be seven members in the JBC. He said the SC has no authority to add one more to that number.
Associate Justice Jose Perez said the inadvertence Arroyo spoke of was never proven, and is at best just a speculation.
“The Constitution should be respected as it was ratified by the Filipino people. By what capacity does the SC say that the ratified provision is not correct?” he asked.
Arroyo pointed out that the inadvertence was not given much importance then because the people were only interested in the structure. He also noted that even Fr. Joaquin Bernas, a member of the constitutional commission, stated in the pleadings that there had been an inadvertence, but his statement has never been controverted by other framers of the Constitution.
Justice Mariano del Castillo proposed that both chambers of Congress should just form a bicameral committee to resolve the conflict on who should be sent to represent congress in the JBC.
During his interpellation, Chavez challenged the argument of Arroyo that there was an inadvertence, pointing out that the constitutional provision was explicit and unambiguous, thus there is no more room for interpretation.
“‘A’ means one, single, solitary, as simple as that. Judicial inquiry is already complete. There is no need for us to go to the extrinsic means. There is no need to say ‘seven’ because there is no need to state the obvious. There is no inadvertence. There is pure intent to provide only one representative from Congress,” he said.
Chavez likewise lashed at the Senate and the House for saying they will no longer send a representative to the JBC, saying this smacks of childishness on the part of lawmakers to hold hostage the JBC’s voting process.
“Let the JBC vote as originally constituted. Not sending a representative to the JBC is a childish threat. Growing old is inevitable but growing up is an option,” he said.
Even if Congress fails to send a representative, he said there will still be quorum with six remaining members present.
Two resolutions have been filed Thursday at the House of Representatives insisting that there should be two representatives from Congress in the JBC.
The twin resolutions were principally authored by House Speaker Feliciano Belmonte Jr., House Majority Neptali Gonzales II and Iloilo Representative Niel Tupas, an ex-officio member of the JBC in his capacity as chairman of the House committee on justice.
Senator Francis Escudero, the chairman of Senate committee on justice and human rights, is also ex officio member in the JBC.
“Reducing the representation and vote of the two houses of Congress in the JBC to one representative and one vote would effectively dilute the participation and role of the electorate in the screening and selection of nominees to the judiciary, diminish the independence of a co-equal and coordinate body, and depart from the principle of checks and balances inherent in a democratic and tripartite system of government,” House Resolution (HR) 2615 stated.
In House Resolution (HR) 2616, the House asked the JBC to “defer the consideration of all nominees and the preparation of the shortlist to be submitted to the President for the position of Chief Justice of the Supreme Court” pending the resolution of the motion for reconsideration.
Last week, the JBC screened all 20 nominees to the post vacated by ousted Chief Justice Renato Corona.

PRESIDENT Benigno Aquino III visited on Friday the families affected by the recent Typhoon “Gener” in Baseco compound in Manila.
Aquino went to Iriga City Friday morning to pay his last respect to former Commission on Elections commissioner Vicente de Lima, the father of Justice Secretary Leila de Lima, who died from colon cancer last Tuesday.
From Iriga City, the President will go straight to Barangay 105 in Baseco compound, said deputy presidential spokesperson Abigail Valte.
Houses, mostly made of light materials, along Baseco’s coast have been destroyed by barges, which were swept away by the storm surge.
Malacañang appealed to residents along Manila bay whose houses were ruined by the storm to heed government relocation plans.
Social Welfare Secretary Corazon Soliman has announced plan to transfer residents along the danger areas in Manila Bay to a compound owned by the government.
“We appeal for the residents along these areas that have been identified as danger areas to heed the appeal of the DSWD (Department of Social Welfare and Development) to prevent these incidents from happening again,” Valte said.
She also appealed to the public to stop finger pointing and let the government focus on its relief operations.
“Let us not blame anyone on what had happened. Maybe it’s best if we focus on how to help them, what to provide for them,” she said.
She, meanwhile, agreed that what happened along Manila Bay should serve as a lesson for local government officials and the public.
Valte said the amount of trash that washed up on the Manila bay area was no joke as the Metropolitan Manila Development Authority, so far, has collected 80 trucks along Roxas Boulevard.
The Palace spokesman said the Department of Public Works and Highways is coordinating with Manila Mayor Alfredo Lim regarding the reconstruction of the damaged seawall.
She said the government will continue to enhance its disaster response to avoid casualty in times of calamities.
“Again, as mentioned in the past few days, zero casualty is the target that we continue to set for ourselves. While some may say that that is quite high for a standard, that is what we want,” she said.
Valte noted that the DSWD provided more than P7-million relief assistance to affected families in Luzon and Visayas.
The department has prepositioned relief goods amounting to P5.6-million and has standby funds of P37.35 million.
Aside from the relief operations, Valte said the Department of Health also alerted the public hospitals on possible rise of leptospirosis cases due to flooding.

CITY OF SAN FERNANDO -– A high ranking official of the Philippine Army has proposed on Friday for a climate change adaptation summit.
Brigadier General Gregorio Pio Catapang, 703rd infantry brigade commander, said climate change is an emerging enemy which could even be considered a threat on national security.
“Kailangan magkaroon tayo ng climate change summit para mapaghandaan nating mabuti ang epekto nito sa ating mga kababayan. Mapag-uusapan na rin dun yung mga proyekto na may kinalaman sa climate change,” Catapang said.
The army general said that the summit could help the Kapampangans determine their degree of readiness in terms adaptability on changing climate.
Last year at the height of Typhoon Pedring and Quiel, residents in one barangay in San Simon town were asked to temporarily recolate to safer ground but refused, he said.
“Kasama namin si governor noon pinapalikas namin ang mga tao pero ayaw nila sumunod. Sanay na daw sila sa tubig baha. Pero kinabukasan sila na mismo ang nakikiusap na e-evacute sila,” Catapang added.
He also pointed out that the safety of the Kapampangan is at stake with the new war on climate change. “Tapos na giyera sa insurgency as far we are concerned. Ang bago nating laban ay ang sa climate change.”
