DILG airs view on Boking’s term under Mabalacat City

MABALACAT CITY – Will Mayor Marino Morales, already reputed to be the longest staying mayor now on his sixth successive term by the quirk of politics, be entitled to fresh three successive terms after this town’s conversion into a component city last Saturday?

Following the referendum that confirmed Republic Act 10164 declaring Mabalacat as Pampanga’s third city, the question has been the subject of debates among local folk.

Local newpapers have referred to Morales as the last mayor of Mabalacat as municipality, and its first mayor as city.

Morales, in an earlier interview, said this issue would be “up to the courts to decide.”

But Florida Dijan, regional director of the Department of Interior and Local Goverments (DILG) told Punto that in 2007, her department came out with an “opinion” in a similar case involving the cityhood of Digos in Davao del Sur.

“The opinion was that the current mayor could not be entitled to a fresh three successive term privilege since his mandate covered the same constituents and the same geographic location,” she said.

Dijan said that such opinion had been enforced in other similar cases nationwide.

Morales was first elected Mabalacat mayor in 1995. Except for brief interruptions, he is now virtually on his fifth mayoral term and is entitled to run for reelection in the polls next year and even in 2016.

If he would be entitled to a fresh three successive reelections, then he could run even in the 2019 polls.

Morales’s peculiar fortune was triggered by electoral protests by his political opponent in the series of local elections starting 1995 when he became mayor.

After three terms that he served fully, Morales ran anew for mayor in 2004 in what could be interpreted as a fourth term, on the argument that his opponent was found, although belatedly by the Comelec, to have been the true winner in the 2001 mayoral elections. Morales argued that his three-successive term privilege was interrupted.

When Morales won in 2004, a supporter of his opponent filed a protest insisting he was on his fourth term contrary to law.

Again in a belated move, the Comelec ordered Morales to turn over his post to his vice mayor on May 17, 2007, only a few months before the next elections.

In 2009, the Supreme Court came out with a unanimous verdict saying Morales “was not the duly elected mayor of Mabalacat, Pampanga for the 2004-2007 term and that he did not serve his full term.

“Morales cannot be deemed to have served the full term of 2004-2007 because he was ordered to vacate his post before the expiration of the term. Morales’ occupancy of the position of Mayor of Mabalacat from 1 July 2004 to May 16, 2007 cannot be counted as a term for purposes of computing the three-term limit,” the court said.

Thus, the High Court said the term of office of Morales from July 1, 2007 to June 30, 2010 “is effectively his first term for purposes of the three-term limit rule” for local elective officials.

The Supreme Court concluded in 2009, Morales was serving a first term as mayor and is entitled to re-election for another two more terms. Morales could still run for mayor in the 2013 and 2016 elections, the court said.

Pineda wants garbage management privatized To solve global problem and prevent spread of diseases

CITY OF SAN FERNANDO – Pampanga Gov. Lilia Pineda said on Tuesday the province will pursue the priva-tization of solid waste manage-ment aimed at maximizing public funds and prevention of diseases blamed on poor sanitation caused by the presence of garbage.

Pineda said she and Mayor Oscar Rodriguez of this city earlier met and agreed to work together for the effective and long-term solution to the garbage problem experienced not just in the country but in other nations.

In data obtained recently, Pampanga – excluding the highly urbanized city of Angeles – produces at least 950 metric tons of garbage per day.

Pineda said the privatization will be done on a “per town, per city” basis to prevent control of one entity and give local government units free hand in choosing their respective private firm to handle their solid waste.

Rodriguez, who met Pineda when the governor turned over a P1.9-million garbage truck to the city, said the governor “has some good ideas but nothing concrete yet.”

Pineda asked Rodriguez’s support and assistance in her quest for the permanent and acceptable solution to the garbage problem.

Rodriguez, president of the League of Cities of the Philippines (LCP), said privatization is “okay with, me if feasible and will meet the requirements of the present law.”

Pineda said her priority program on health had been negatively affected by poor sanitation and dirty surroundings caused by the presence of uncollected garbage and the foul smell associated with it.

Pineda cited the case in Malaysia when the “number of diseases decreased” after the country pursued privatization of the collection and management of solid waste.

Pineda said the annual budget of the province and other towns and cities, notably the LGUs with lesser income and budget, could not afford disposing of non-segregated garbage in sanitary landfills. She said her planned privatization will “still focus on segregation of waste at source and tapping of landfills.”

In Apalit, Mayor Oscar “Jun” Tetangco said he had introduced segregation of waste at source in the first class municipality’s 12 villages even before the national government’s strict implementation of Republic Act No. 9003, or the Philippine Ecological Solid Waste Management Act.

He disclosed that the segregation had allowed barangays to earn from garbage to pay for their electric bills for street lamps and reduce the volume of waste transported to sanitary landfills.

But the two-term mayor said that despite their “collective efforts” to reduce the volume of garbage, the municipal government spends at least P15 million yearly. He added that their town produces at least 30 metric tons of garbage daily “on a conservative estimate.”

Tetangco said he will support Pineda’s plan of privatizating the handling of garbage.

The governor’s plan, he added, “is not just feasible but practical and more importantly permanent.”

“The town council can allot at least P10 million compared to what I use now if the private company will handle properly all the waste and collection,” said Tetangco.

Pineda on Monday said she had met town and village officials to discuss the issues on the privatization of solid waste management.

“We will exert all efforts to get the pulse and opinions of the general public before we finally decide with the planned privatization.

And of course we will seek the support of Vice Gov. Yeng Guiao and the rest of the board members,” said Pineda in the dialect.

Pineda said she had asked the Department of Environment and Natural Resources’ (DENR) Environment Management Bureau (EMB) Regional Director Lormelyn Claudio to help in the proper implementation of the planned privatization and the aggressive efforts of the province to implement segregation of waste at source.

ADB to extend $625M for Philippine PPP projects

THE Asian Development Bank (ADB) has approved $625-million private equity fund to assist the Philippine government’s infrastructure projects under the public-private partnership (PPP) program.
ADB’s investment in the Philippine Investment Alliance for Infrastructure (PINAI) fund is alongside commitments from Philippines’ state-owned pension fund Government Service Insurance System (GSIS), Dutch pension fund asset manager APG, and the Macquarie Group.
“Apart from our direct equity investment, ADB’s participation can help mobilize additional investment in the Philippines from top tier international partners, foster competition in domestic infrastructure finance, and establish a secondary market for well-performing infrastructure assets,” said Philip Erquiaga, director general for ADB’s Private Sector Operations Department.
“We are delighted to partner with GSIS, ADB and Macquarie and play a role in reducing the Philippine infrastructure funding gap. PINAI provides for an excellent investment opportunity and we expect it to enjoy an early mover advantage and to generate attractive risk-adjusted returns for our clients: pension funds in the Netherlands with combined assets of over €300 billion (around $367 billion),” said Hans-Martin Aerts, head of Infrastructure Asia at APG Asset Management in Hong Kong.
ADB expressed hope that the success of the PINAI fund will also spur more private equity funds that will catalyze additional foreign capital into the country, and further the development of domestic capital markets.
“Our participation in the fund will contribute to economic growth and investors’ confidence. This will also mean enhanced returns on our investments which will redound to the greater benefit of our members and pensioners,” GSIS president and general manager Robert Vergara said.
The fund will invest in Philippine core infrastructure assets with an initial focus on existing projects that need expansion or rehabilitation, but will also be in a position to support the development of critical infrastructure projects from the ground up.
According to the Philippine Development Plan, around 12 percent of the country’s $120 billion investment requirements need to come from the private sector. PINAI will target five to 10 investments of approximately $50 million to $125 million each to provide for portfolio diversification.

Aquino leads commemoration of Cory’s 3rd death anniversary

PRESIDENT Benigno Aquino III will lead on Wednesday the main ceremony commemorating the third death anniversary of his mother, late President Corazon “Cory” Aquino, at Edsa Shrine in Ortigas.
Activities include a mass at the Edsa Shrine and the unveiling of Cory’s bust at 5:30 p.m.
The President will also grace a photo exhibit featuring his late mother, who died of colon cancer in August 1, 2009.
Deputy presidential spokesperson Abigail Valte said there is no schedule yet if the President and his sisters will visit their mother’s tomb at Manila Memorial Park in Parañaque City.
Malacañang said it will join the nation on Wednesday in remembering the former President “who proved the Filipino is indeed worth living for.”
“As wife, mother, and President, she exemplified the virtues of faith, perseverance, and integrity. As a widow dressed in yellow, her soft spoken and honest dedication to the struggle to win back our democracy by peaceful means, earned her the respect of an empowered nation and the international community,” presidential spokesperson Edwin Lacierda said in a statement issued Tuesday.
“She was, in so many ways, the nation’s moral compass — a constant presence that personified not only the greatness Filipinos could achieve but also the people’s staunch determination to defend and nurture our democratic institutions and the principles she and millions of Filipinos helped restore and rebuild,” he added.
The Palace official said the late President “was a gift” bestowed upon the country who will never be erased in people’s hearts and minds.
Corazon Aquino led a bloodless revolution in 1986 that toppled Ferdinand Marcos, who ruled the Philippines for 20 years. She was the 11th president of the republic and the first female president in Asia.

Students told: Avoid violent initiation rites

MALACANANG urged students on Tuesday to refrain from participating in violent activities like hazing following the death of another freshman law student of San Beda College due to alleged brutal initiation rites.
“Kung totoo man na ito ay biktima ng hazing, itigil na po natin ang ganitong cycle of violence, wala namang nagbe-benefit sa ganito (If it’s true that the victim died of hazing, let’s stop this cycle of violence. No one will benefit from it),” deputy presidential spokesperson Abigail Valte said.
She assured that the Philippine National Police will conduct thorough investigation on the case of Marc Andrei Marcos, a freshman law student of San Beda College.
Television reports said Marcos died last Tuesday after going through a violent hazing ritual in Dasmarinas, Cavite on Sunday.
The San Beda Law Student Government confirmed Marcos’s death in a post on its Facebook page.
Pending police investigation, the case is being treated by authorities as a “mauling” incident.
“We condemn in the most (sic) strongest terms the hazing activities and the deaths that arise therefrom for breeding a culture of fear, violence and impunity in schools and universities, which are supposedly centers of free discourse, learning and progressive thought,” Kabataan party-list said in a statement.
If the hazing angle proves true, Marcos would be the second San Beda law student to die from hazing this year after Marvin Reglos, who was killed in February.
Last February, the Kabataan party-list group filed House Resolution 2188, directing the committees on higher and technical education and youth and sports development to conduct an inquiry on death of Reglos.
Senate President Juan Ponce-Enrile proposed stricter implementation of the law rather than revising it.
“We have to improve law enforcement. Charge and punish those who are responsible if necessary, whether it’s murder or homicide,” he said in a chance interview.
Twenty-one years since the passage of Republic Act 8049 — the law that regulates hazing and other forms of initiation rites in fraternities and sororities — hazing activities had continued, which resulted in numerous fatalities without single conviction under the law.

Bishops: Character change more than Charter change

EVEN as government leaders continue to debate on whether to amend the 1987 Constitution, the influential Catholic Bishops’ Conference of the Philippines (CBCP) spoke Tuesday of a more important change: character.
At the weekly Church-organized forum, CBCP president Archbishop Jose Palma said it would be better if the public would first learn how to follow existing laws before thinking of amending them.
“We have many beautiful laws. So, for us, I think we should really try to be law-abiding citizens first. We have good laws, we just choose not to follow it,” said Palma.
He said, however, that there may also be enough reason to review the current Constitution but that it will not be for the bishops to identify or push for them.
“Maybe, these are issues better discussed by people that are more knowledgeable of the situations and people who are really of the competence to evaluate particular laws,” said Palma, referring to lawmakers.
Earlier, Palma expressed the CBCP’s openness to the recently revived Charter Change moves in Congress if and when the government leaders find it necessary.
Last Monday, House Speaker Feliciano Belmonte Jr. and Senate President Juan Ponce Enrile failed to convince President Benigno Aquino III to agree to their initiative to amend the economic provisions of the Constitution.
Still, the President had agreed to refer the proposed changes for study and comment by his economic and legal teams in consultation with the private sector.
In a separate briefing, House Majority Leader Neptali Gonzales II related the President also asked leaders of Congress if the amendments will not touch on the current political structure.
“Both leaders of Congress gave the assurance that they will not support any changes to the political provision of the Constitution,” he said.
Consulting the President, Belmonte said, is important because his voice will hold sway over congressmen-allies.
“We do need his concurrence because in the first place because it requires three fourths vote in both Houses and I don’t think that can be on the basis alone on the charisma of (Cavite Representative) Jun Abaya and Boyet (Neptali) Gonzales,” he said.
The Speaker said Charter Change should take off within the year or else Congress will focus on other priorities.

Tañada to lead public forum on FOI in Angeles City

ANGELES CITY – Deputy Speaker Lorenzo “Erin” Tañada III is set to lead a public forum on the Freedom of Information (FOI) bill in Barangay Balibago here on Thursday.
The forum will be held to shed light on how the bill, if enacted into law, would affect government officials, media practitioners and local stakeholders.
Balibago barangay chairman Rodelio Mamac said media practitioners, non government organizations, government leaders and church leaders have been invited to attend the event.
“This will give stakeholders enough information on the importance of the bill and its current status in the House of Representatives and the Senate. People can address their questions to the good congressman so that they can be properly enlightened,” Mamac said.
Tañada, the principal author of the bill, earlier challenged his fellow legislators to do what the Senate does and move for the immediate passage of the measure.
“It should move at the same pace that the House made former Chief Justice accountable in our impeachment complaint,” he said in a press statement, referring to convicted Chief Justice Renato Corona.
He said the bill, if enacted into law, puts in place a provision implementing the automatic disclosure of transactions of public concern as required by Section 28, Article II of the Constitution. The previous Congress failed to ratify the FOI measure due to lack of quorum.
Mamac said Tañada will also meet with local leaders in Angeles City and visit the barangay’s social hygiene facility and vermin compost garden.
He said the barangay officials will discuss with the congressman the achievements of the barangay in terms of solid waste management and local health concerns.

DFA opens 2nd Pampanga consular office at Marquee

ANGELES CITY — The Department of Foreign Affairs (DFA) opened on Monday its second regional consular office in Pampanga at the Marquee Mall here to provide passport servicing to one of the country’s top regions with the most number of overseas Filipino workers (OFWs).
The opening of the new facility at the third floor of the said mall was facilitated by DFA assistant secretary for consular affairs Jaime Victor Ledda, DFA undersecretary for international and economic relations Laura del Rosario, Ayala Land Incorporated senior vice president Bobby Dy, Foreign Affairs Secretary Albert Del Rosario and Mayor Edgardo Pamintuan.

Also attending the event were San Fernando Archbishop Paciano Aniceto and Pampanga Governor Lilia Pineda.
DFA Angeles is hosted by Ayala Land and is one of the largest mall-based consular offices of the DFA with a floor area of 811 square meters. The office can accommodate some 500 passport applicants per day.
Efficient servicing
Del Rosario said that in an effort to serve the public, the mall-based consular office will process passport applications from 10 a.m. to 8 p.m., Mondays to Saturdays. The consular office will also be open half days on Sundays for passport releases and claims.
“By December, we hope to put in place a dedicated call center that would allow passport applicants to schedule the time and day they prefer to be served at any of our consular locations in Metro Manila and other parts of the country,” Del Rosario said.
The move, Del Rosario said, is part of the DFA’s initiative to deal with long lines and further improve passport servicing.
The agency also recently opened a 995-square-meter facility at Robinsons Starmills here, the biggest in Luzon outside of Metro Manila.
Del Rosario said the DFA expects to generate more savings once it concludes negotiations with its private sector partners for the hosting of its remaining consular offices.
The DFA expects to save some P1.14 billion pesos in operating costs in the next 10 years from the mall-based consular offices.

Pampanga Chamber of Commerce and Industry (PamCham) vice chairman Rene Romero lauded the opening of the new consular office, adding it would surely create more commercial activity within the mall.
He said an efficient passporting system will help in facilitating more people who would like to travel or work abroad.
“We are happy that DFA has taught of creating mall-based offices. These offices will surely give applicants enough convenience and accessibility at the comfort of the mall’s premises,” Romero said.
PamCham, along with other supporters of the DFA, has loaned artworks and furniture of the initial operations of the consular offices here and the City of San Fernando.
Romero said they are encouraging the DFA to establish more similar consular offices in other areas of the province and Central Luzon.

DTI urged: Monitor price hike of goods

CANDABA – Locals here are urging the Department of Trade and Industry (DTI) to closely monitor the movement of prices of various goods in the market particularly this rainy season.
The call came as prices of vegetables, fish and other basic commodities remarkably increased after a week of heavy rains.
“Ang talong po dati P15 hanggang P20 kada kilo pero ngayon po ay umabot na sa P30. Ang repolyo naman mula P40, ngayon P60 na (Before, you can buy a kilo of eggplant at P15-P20, but now, it costs P30, while a kilo of cabbage has increased from P40 to P60),” a plain housewife, Normita Sanchez, said.
Sanchez added that traders should refrain from taking advantage of the rainy season to increase their earnings, at the expense of the people.
“Hindi pa naman ganun kahirap ang pagpasok ng produkto sa palengke natin. Normal pa naman ang sitwasyon kahit nag-uulan sa mga nagdaang araw kaya sana kung magtataas sila ng halaga ng bilihin ay huwag naman sobra,” another resident here pointed out.
Sun.Star learned that before the rainy season started, the price per kilo of tilapia was only P80. Now, it ranges from the P90 to P100 per kilo.
However, what is more alarming is that despite the increase of its price, there is not enough supply of tilapia in the market.
Earlier, an official from DTI-Pampanga warned traders who are overpricing basic commodities.
Nathaniel Samson, a DTI senior specialist, previously stated that they have already deployed additional personnel to check the prices of goods and commodities in the supermarkets and public markets.
This came after receiving numerous complaints from consumers that some traders are engaging in overpricing of goods deemed essential during calamities.
