MANILA – Despite the doubts on her independence and integrity, Justice Secretary Leila de Lima said Tuesday she will not withdraw her bid for the Chief Justice position.
In an interview, de Lima brushed aside questions on her character made by Lipa Archbishop Ramon Arguelles and House majority leader Neptali Gonzales II, saying she has already proven her mettle while she was still the head of the Commission on Human Rights, an independent constitutional body.

She said she was merely offering herself as an alternative to the so-called “insiders” in the Supreme Court (SC). If given a chance, she said she is ready to prove once again her independence as justice.
“I was able to prove independence when I was in the independent constitutional and I can do that again. I can prove again my sense of independence and my capacity for independence if I join against another independent body,” she said.
De Lima was among the 24 nominees who have accepted their nominations at the Judicial and Bar Council (JBC), a body that screens and submits a shortlist for the President’s consideration to vacant judicial posts. She earlier inhibited as member of the JBC in anticipation of her nomination for the Chief justice post.
She also claimed that she could serve as the “unifying force” in the judiciary in case she is appointed as the country’s first female Chief Justice. Her acceptance of her nomination, however, was met with criticisms.
Arguelles said de Lima’s acceptance of her nomination reeks of bad taste, being an alter-ego of the President, thus, she is inclined to toe the administration line and do the bidding of her appointing power.
On the other hand, Gonzales said that her acceptance of her nomination gave rise to the allegations of ousted Chief Justice Renato Corona that he was removed from office to pave the way for the appointment of an Aquino ally.
JBC member lawyer Jose Mejia, who represents the academe, said the eight-member council will start publishing the list of nominees on July 9, after which, the eight-man panel will schedule a public interview of the aspirants where they will be asked about the opposition on their nominations.
The JBC then will deliberate and come up with a shortlist of nominees for consideration of the President, who has 90 days, or until August 29 to fill up the vacancy in the SC.
Mejia also said the number of qualified nominees who have accepted their nominations went down to 24 from 25 after Court of Appeals justice Vicente Veloso withdrew his conforme. Veloso earlier signified his acceptance of his nomination. No reason was given for his withdrawal.
He also said the two applicants for the Chief Justice post — Jocelyn Esquivel, a nurse, and former Malabon regional trial court judge Florentino Floro — will be excluded from the list to be published by the JBC for failure to meet the minimum requirements for the position.
Under the Constitution, a member of the Court must be a natural-born citizen of the Philippines; at least 40 years of age but not 70 years old or more; must have been a lower court judge — or been practicing law in the country — for 15 years or more; and be of proven competence, integrity, probity and independence.
In 2007, the SC ordered Floro to be separated from the service after medical findings showed that he was suffering from psychosis, a condition that made him unfit to perform his judicial functions.
Meanwhile, the SC did not grant the prayer of former Solicitor General Frank Chavez for the issuance of a temporary restraining order against the proceedings being conducted by the JBC in the search for the next chief justice.
Instead, the High Court ordered the JBC to comment within the non-extendible period of five days on the issues raised in the suit, particularly on the present composition of the panel, which gives two representations to Congress.
During its regular en banc session, the High Court, likewise directed Senator Francis Escudero and Iloilo Representative Niel Tupas, the chair of the committee on justice in the Senate and House of Representatives, respectively, to file their separate comments on the petition.
All justices who have accepted their nominations inhibited from acting on Chavez’s petition, except for Associate Justice Roberto Abad, who was on official leave.
Aside from Abad, five other magistrates accepted their nominations for the top judicial posts, namely, Justices Antonio Carpio, Presbitero Velasco Jr., Teresita Leonardo-de Castro, Arturo Brion and Maria Lourdes Sereno, who is Aquino’s first appointee to the SC.
In his petition, Chavez questioned why the JBC gave two representations to Congress and gave both of them voting powers. He also questioned the argument of the panel that giving separate representations to Escudero and Tupas was based on its tradition. (JCV/Sunnex)

THE Asian Development Bank (ADB) will provide the Philippines with $1.87-billion worth of loans for projects and technical assistance for the next three years, the National Economic and Development Authority (Neda) said Monday.

The Neda and ADB reiterated the importance of ensuring the quality of projects at the proposal, implementation, and operating stages during their recent meeting.

“We support this program as government can fully utilize it through quality implementation, supervision, monitoring, and evaluation of projects by different agencies. One of the ways by which we can ensure the success of the assistance program laid out before us is guaranteeing the quality at entry and exit of the projects that we will handle,” said Neda Deputy Director-General Rolando Tungpalan.

The meeting on ADB’s Country Programming Mission 2013-2015 showed that the Bank’s Country Operations Business Plan for those years was broken down into $600 million for 2013, $700 million for 2014, and $570 million for 2015, he said.

The lending program covers projects in the Public sector management, $750 million (44 percent); Multisector, $470 million (27 percent) (include disaster risk financing and social protection projects); Education, $300 million (17 percent); and Transportation, $200 million share (12 percent).

“We are glad the ADB lending program responds to our needs and priorities as laid out in our Philippine Development Plan (PDP) for 2011-2016,” Tungpalan said.

The program also involved a $325-million co-financing from the Association of Southeast Asian Nations Infrastructure Fund that was launched during the ADB’s 45th Annual Governors’ Meeting in Manila. The fund will support projects on water supply, transportation, and road improvements for three years.

Meanwhile, officials from the ADB said lessons from the country portfolio review were systematically incorporated in the formulation of the three-year business plan.

“Given the kind of partnership and mutual accountability that ADB and the Philippines have, we are happy that we have been able to apply the lessons from our involvement in ADB programs in the past to the way we currently do our government processes,” Tungpalan said. (SDR/Sunnex)

SANTO TOMAS – Mayor Joselito Naguit recently urged his constituents to observe proper waste segregation in order to reduce the volume of domestic garbage produced in this town.

“Buri kuna ring samantalan ing pamikatagun ayni. Anyaran ku kareng kabalen tamu keni Sto. Tomas na mag-segregate tamung basura para makasaup tamu king programa ng Nanay,” Naguit said.

The mayor said that with proper waste segregation, the hauling expenses will be reduced, to the benefit of the residents and Municipal Government.

Earlier, the Provincial Government advocated the establishment of material recovery facilities (MRFs) in different places in the province. But only a few villages have come up with their own operational MRFs.

This is despite the massive campaign on waste segregation including the establishment of clustered MRFs.

Governor Lilia Pineda also previously distributed dump trucks in all towns in the province to further bolster the campaign on waste segregation.

The junkshop workers, likewise, were given garbage carts or “kariton” as they are treated partners of the Provincial Government in solid waste management.

MABALACAT — Member-consumers of the Pampanga Electric Cooperative II (Pelco II) assailed the management of said electric firm for the sudden increase in power rates.

With most electric bills increasing by 100 percent this month, the consumers criticized the Pelco II management for not issuing prior notice for the said adjustments.

The Pelco II management increased the power rate from P8.70 to P10.20 per kilowatt-hour, a group of consumers said.

Pelco II Mabalacat Sub-station manager Mario Pangilinan declined to comment, saying he is not allowed to issue any statement regarding the decision of the management of the electric cooperative based in Guagua town.

However, Pangilinan furnished Sun.Star Pampanga a notice addressed to Pelco II customers regarding the Deferred Accounting Adjustment (DAAs) of the Energy Regulatory Commission (ERC).

The Pelco II management stated in the notice that on March 26, 2012, the ERC issued an order regarding the DAAs for the Recovery of Incremental Fuel and Independent Power Producer (IPP) Costs under the 13th to 17th Generation Rate Adjustment Mechanism and 15th to 16th Incremental Currency Exchange Rate Adjustment (Icera).

“Pursuant to the ERC decision, the National Power Corporation and Power Sector Asset and Liabilities Management Corporation (Psalm) are authorized to recover the DAAs effective March 26 to April 25, 2012 billing period,” the Pelco II management stated.

“Further it (ERC decision) directed successor generation companies (SGCs) to provide assistance to the said government agencies in implementing the recovery/ refund of the DAAs and act as billing agents,” the electric cooperative added.

Pelco II, in compliance to the ERC order, implemented the adjustments of 0.6904 per kilowatt hour effective in the June 2012 billing period.

“Pelco II will also act as billing and collection agents from the end consumers,” the notice indicated.

MALOLOS CITY—Water elevation at the Angat Dam has remained low and nearing critical level despite rains brought by successive typhoons that hit the country.

This developed as the Pampanga River Flood Forecasting and Warning Center (PRFFWC) advised Bulacan and Pampanga residents living in low-lying areas to be on alert for possible flooding as typhoon Dindo is expected to bring more rains.

Records obtained by Punto from the Provincial Disaster Risk Reduction Management Office (PDRRMO) showed that water elevation at the Angat Dam dropped to 186.51 meters above sea level (masl) yesterday morning from 186.84 masl recorded on Wednesday.

The said water elevation is just six meters above the 180 masl critical level.

Liz Mungcal, head of the Bulacan PDRRMO said typhoons Butchoy and Dindo brought minimal rainfall in the eastern part of the province were the dam is located.

She said that despite the low water elevation there is nothing to worry about as more rains are expected in the coming days.

“Typhoon season na, kaya anytime ay madadagdagan ang tubig sa dam dahil madalas na ang pag-ulan,” she said.

Located on the hills of Sierra Madre in Norzagaray town, Angat Dam supplies 97 percent of Metro Manila’s potable water requirement.

As this developed, the PRFFWC warned residents living on low lying areas and river banks in Bulacan and Pampanga to be on alert for possible flood.

Based on PRFFWC forecast issued at 9 a.m. yesterday, they expect 40 to 60 millimetres of rainfall in the next 24 hours.

In the previous 24 hours before the forecast, the PRFFWC recorded a 30 millimetres of rainfall from their rain gauge stations.

Watercourses likely to be affected by the possible rainfall are the tributaries of the Rio Chico River, the Candaba Swamp, the lower main of the Pampanga River and the tributaries of the Angat River in Bulacan.

The PRFFWC also warned residents living in high-tide-affected areas.
