THE Anti-Money Laundering Council (AMLC) is in favor of a proposed law in the House of Representatives that would expand the exceptions on the disclosure of dollar deposits.
A week after former Chief Justice Renato Corona was convicted by the impeachment tribunal, the House Committee on Banks and Financial Intermediaries discussed on Tuesday House bills amending Republic Act (RA) 6426 or the Foreign Currency Deposit Act.
Present in the committee hearing was AMLC Executive Director Vicente Aquino.
To recall, the AMLC earlier provided Ombudsman Conchita Carpio-Morales a document detailing the transactions in Corona’s alleged 82 dollar accounts.
“The Foreign Currency Deposit Act should be amended to increase the number of exceptions. These proposed amendments shall not modify or amend or repeal the provisions of the AMLC,” Aquino told reporters in an ambush interview.
Aquino, meanwhile, refused to comment on the conviction of Corona for his failure to truthfully disclose his assets and net worth.
“It’s over. We have learned a lot, a lot of good lessons,” he briefly said.
RA 6426 was Corona’s excuse for his non-declaration of dollar deposits in his statement of assets, liabilities and net worth (SALN).
Contrary to Ombudsman Morales’s claim that he has at least $10 million in transactions in 82 dollar accounts, Corona earlier told the impeachment tribunal that he only has $2.4 million in four dollar accounts.
Corona argued that under RA 6426, foreign currency deposits shall be absolutely confidential “except upon the written permission of the depositor.”
In House Bill 5809, ACT Teachers party-list Representative Antonio Tinio is proposing that the exceptions provided under RA 1405 or the Bank Secrecy Law be applied as well to RA 6426.
Under the Bank Secrecy Law, peso deposits are absolutely confidential “except upon written permission of the depositor, or in cases of impeachment, or upon order of a competent court in cases of bribery or dereliction of duty of public officials, or in cases where the money deposited or invested is the subject matter of the litigation.”
Leyte Representative Sergio Apostol, chairman of the House Committee on Banks and Financial Intermediaries, for his part, however, said he was not in favor of adding exceptions to RA 6426.
“(I’m) not really (in favor). It will depend on the recommendations of the technical working group (TWG) and the committee as a whole,” Apostol said in an interview.
Camarines Sur Representative Luis Villafuerte, vice chairperson of the committee, said the Foreign Currency Deposit Act should be clarified to “address the evils that are deemed to rise with respect to deposits of government officials.”
“The objective of the foreign currency deposit law is that it should not be used as a haven of crooks… We should remove all vagueness in the (absolute confidentiality) provision,” he stressed.
Surigao del Sur Representative Philip Pichay’s interpretation of the law is similar to that of the former Chief Justice.
“Under the existing law, we should not state it. Put it in the amendment that it (foreign currency deposits) should be reported,” Pichay added.
On the other hand, Senior Citizens party-list Representative David Kho pointed out that all cash assets—whether peso or dollar—make no distinction.
“When the law does not distinguish, we should not distinguish,” he said.
During the committee deliberations, Paranaque Representative Roilo Golez, who was appointed to head the TWG, said the House panel should consider inviting Corona to its hearings to “enrich the appreciation” of the law.

ANGELES CITY — A total of 400 student-Angeleños will troop to the temporary campus site of the City College of Angeles (CCA) on June 18 for the first semester of academic year 2012-2013.
Averell Laquindanum, president of the CCA, said they are making the final preparations for the first day of school at the Angeles City Library, where the college will be temporarily housed.
The city library currently has four lecture rooms where the first batch of students can have their classes.
Laquindanum confirmed that they have come up with a scheduling plan this semester to accommodate all the students of the college.
“There will be a total of 10 block sections that will take up classes in the morning, afternoon and until 9:00 p.m.,” he said.
Apart from the classrooms, the temporary campus site has also different facilities for the students to use which will supplement their studies and specific courses.
“This includes our computer laboratory, the library, speech laboratory and a tourism promotion and tour guiding laboratory that resembles a front desk as seen in different hotels, functions and establishments,” Laquindanum added.
“These facilities guarantee our students’ employability even after the 1st semester, where they can acquire a certification from the Technical Education and Skills Development Authority (Tesda), stating that they have undergone the appropriate training and are equipped with the core competencies which will match the needs of the community – more specifically the locators in Clark,” he explained.
The temporary site also holds several essential administrative offices such as a dean’s office, registrar’s office, office of the prefect of discipline, faculty lounge, office of student affairs, and dental and medical clinic, among others.

CITY OF SAN FERNANDO — Governor Lilia Pineda on Monday sought the help of the newly organized Junkshop Owners and Operators of Pampanga in solving Pampanga’s garbage problem.
Speaking before an estimated 400 junkshop owners and operators enrolled under Capitol’s “Kariton para sa Kalinisan, Kabuhayan, Kalusugan at Katahimikan” or 5K Program at the People’s Sports Center here, the governor said they are in the forefront of garbage collection and segregation.
“We will help you and I ask that you help us in return so that we can altogether solve our garbage problem and assist in proper solid waste management,” she said.
She added that the Provincial Government spends so much on the problem and “I am appealing to you to join us in solving this especially that you know areas that are filled with garbage like creeks and waterways in your respective barangays.”
She also sought their assistance in fighting the drug menace, as well as curb theft and robbery, particularly of cables and other stuff like iron fences.
“Huwag ninyong bibilhin ang mga ganitong nakaw na kalakal. Tulungan din ninyo sana kaming malutas ang problema sa droga at isuplong sa ating kapulisan ang ganitong pangyayari (Don’t buy these stolen items. Also help us solve drug problems in the province),” she said.
In return, she added, Capitol will provide PhilHealth and Health Access Cards to the junkshop owners and operators and their families, as well as educational assistance and scholarships to their children wishing to pursue their studies.

MANILA – THE Bureau of Customs recently seized over 100,000 pieces of illegally imported Digital Video Disc (DVD) movies, cell phone and laptop accessories and sacks and drums of unidentified chemicals worth P10 million.
Customs Commissioner Ruffy Biazon said one forty-footer container van arrived at the Manila International Container Port (MICP) from Guangzhou, China aboard an Evergreen Line vessel. The van was declared to contain 1,475 packages of housewares.
According to the operatives of the Revenue Enhancements for the Attainment of Collection Targets (React) Task Force, the items were consigned to Richflow Trading based in Quezon City.

MANILA — The Judicial and Bar Council (JBC) met Monday noon at the Supreme Court to discuss the selection process for the next Chief Justice.
The JBC is a constitutional body tasked to screen candidates to all posts in the judiciary.
The Chief Justice post was vacated after Renato Corona was removed from office last week when 20 of 23 senators found him guilty of committing culpable violation of the Constitution and betraying public trust.
The opening for Chief Justice post’s application and the selection process will be announced after the meeting Monday, academe representative to the JBC lawyer Jose V. Mejia said.
Among those reportedly eyed as the country’s next top judge are Justice Secretary Leila de Lima, Bureau of Internal Revenue Commissioner Kim Henares, and Senior Associate Justice Antonio Carpio, Corona’s rival to the post two years ago.
Carpio and de Lima, who are both members of the JBC, inhibited themselves from the meeting.
“Potential nominees who are part of the JBC by provision of law should just inhibit (from the deliberations and voting),” Senator Miriam Defensor Santiago said.
