House to junk impeachment raps vs SC justice

MANILA — The House of Representatives will junk the impeachment complaint against Supreme Court (SC) Associate Justice Mariano del Castillo, Speaker Feliciano Belmonte Jr. said Friday.

“We will not elevate it to the Senate. (We) may lack of time to act on it next week before we adjourn,” Belmonte said.
Majority Leader Neptali Gonzales II meanwhile said the plenary vote on the impeachment complaint against Del Castillo has not been finalized yet.
“That’s very far from our minds at the moment. We decide after the break,” he said.

Congress will adjourn sine die on June 7 and will resume session on July 23.

The House leadership’s decision came after the Senate impeachment tribunal came out with a guilty verdict on Chief Justice Renato Corona for his failure to truthfully disclose his assets and net worth.

Del Castillo is accused of betrayal of public trust for plagiarizing a ruling on World War II comfort women.

Several paragraphs of the SC justice’s ruling was allegedly borrowed without proper attribution from “A Fiduciary Theory of Jus Cogens” by Evan Criddle and Evan Fox-Decent, “Breaking the Silence: On Rape as an International Crime” by Mark Ellis, and “Enforcing Erga Omnes Obligations in International Law” by Christian Tams.

Last February, the House Committee on Justice approved the impeachment complaint against the SC justice. It has been pending for plenary vote since.

The justice committee report endorsing an impeachment against the SC justice will need a one-third vote—at least 95—from members of the House of Representatives before it is sent to the Senate impeachment tribunal for a decision.

Chinese media told: Exercise restraint

THE Philippine government urged China on Saturday to ask Chinese media to exercise restraint on their reporting to ease tension over the Panatag or Scarborough Shoal off West Philippine Sea.
Presidential spokesperson Edwin Lacierda made the statement after Defense Secretary Voltare Gazmin and Chinese Defense Minister Liang Guanglie met last Monday and reportedly agreed to exercise restraint in making statements on the issue.
“I think we have done and we have been prudent in our statements. We have, from the very, very start, we have emphasized that we intend to de-escalate tensions,” Lacierda said.
“There is no benefit for us to be recalcitrant in our statements,” he added.
Lacierda said that from President Benigno Aquino III, to Foreign Affairs Secretary Albert del Rosario and to the various spokespersons of the government, they have exercised restraint and prudence on their statements.
“I suppose it would be good if our Chinese counterparts would also assist Chinese media…to exercise restraint in their interest of resolving tensions and in the interest of not sowing unwanted or unneeded tensions between two countries especially among the people,” he said.
China Daily, in its opinion page, reportedly criticized the Philippines for its alleged illegal occupation of islands in the West Philippine Sea, which it said belongs to China.
Both Manila and Beijing have been claiming the Panatag Shoal, which China calls as Huangyan Island.

Aquino may name new Chief Justice earlier than expected

PRESIDENT Benigno Aquino III may name the new Supreme Court Chief Justice earlier than expected, Malacanang said on Saturday.
“The President has 90 days to make a decision. I don’t think he will use up the entire 90 days, although he is not in a hurry,” presidential spokesperson Edwin Lacierda said in an interview over dzRB Radyo ng Bayan.
But Lacierda assured that Aquino will have a thorough assessment of those nominees to be submitted by the Judicial and Bar Council (JBC) whose members are set to convene on Monday.
He said he was not aware who would be included in the shortlist to be provided by the JBC to the President.
Justice Secretary Leila de Lima and Bureau of Internal Revenue (BIR) Commissioner Kim Henares were reportedly among those being eyed to be the new chief magistrate to replace ousted Chief Justice Renato Corona.
“Certainly, Secretary Leila de Lima is fully qualified and she has proven her competence and her integrity,” Lacierda said.
In the case of Henares, he said the BIR chief is also qualified.
He said Aquino continued to assess the people who could be the next Chief Justice.
“One of the things he (Aquino) mentioned was that if you appoint someone from within the Cabinet, what will be the gain to the executive branch, what will be the loss to the executive branch? So these are assessments that we will be making,” he added.
The other candidates who could be included in the shortlist for possible Chief Justice’s post include the three most senior associate justices of the high tribunal such as Antonio Carpio, Arturo Brion and Diosdado Peralta.

Aquino ratifies labor convention for domestic workers

PRESIDENT Benigno Aquino III has ratified the International Labor Organization’s (ILO) Convention 189 concerning decent work for domestic workers and forwarded it to the Senate for its concurrence.
Department of Labor and Employment (Dole) Secretary Rosalinda Baldoz said the country’s ratification of the landmark convention definitely sends a strong signal to the world of the Philippine government’s firm commitment to the welfare and protection of domestic workers.
“President Aquino has ratified ILO Convention 189 on 18 May and has sent to the Senate, through Senate President Juan Ponce Enrile, the Instrument of Ratification for its concurrence,” Baldoz said. “We welcome this development and we hope the Senate will concur in its ratification.”
She said the convention and its accompanying recommendations, which apply all domestic workers, set the standards for decent work for domestic workers and provide them with the same protection, respect, and dignity accorded to other workers.
The ratification of ILO Convention 189 makes the Philippines the second ILO member state, following the earlier ratification made by Uruguay, of the landmark convention that the Philippines, through the Dole, had played a leading role toward its adoption by the 183-member ILO during the 100th session of the International Labour Conference in Geneva, Switzerland on June 16 last year.
The Philippine ratification would complete the required two ILO member states to put the Convention into force. Article 21 of the Convention provides that it shall come into force 12 months after the date on which the ratification of two members has been registered with the director-general of the International Labor Office. Thereafter, the Convention shall come into force for any member 12 months after the date on which is ratification is registered.
The anticipated completion of the Philippines’s process of ratification of ILO Convention 189 is expected to make it one of the fastest-ratified ILO Conventions in history, amplified all the more by its universal significance in emancipating the vulnerable domestic workers and in lifting them from virtual slavery and abuse-prone conditions, to decent work status at level with formal workers.
Aquino, in his letter to Enrile and the members of the Senate said “the Department of Labor and Employment and the Tripartite Industrial Peace Council (TIPC) were consulted and concurred with the ratification of the Convention.”
Under the Convention, each ILO member-state shall take measures set out in the Convention to ensure the effective promotion and protection of the human rights of all domestic workers and to respect, promote and realize the fundamental principles and rights at work of domestic workers, namely: freedom of association and the effective recognition of the right to collective bargaining; the elimination of all forms of forced or compulsory labor; the effective abolition of child labor; and elimination of discrimination in respect of employment and occupation.
Baldoz said the Philippines’ groundwork for the ratification of ILO Convention 189 was soundly based on a thorough and meticulous process of social dialogue and consultations with the tripartite sectors, advocates, and stakeholders.

Guv gets medical equipment from DOH

CITY OF SAN FERNANDO – Governor Lilia Pineda led other provincial officials on Friday in receiving medical equipment from the Department of Health (DOH).
Provincial Health Officer Dr. Marcelo Jaochico and Board Members Monina Laus and Trina Dizon witnessed the simple turn over ceremony held at Clark Freeport.
Dr. Leonita Gorgolon, Central Luzon center for health development director, said donated equipment include microscope, chemical analyzer, weighing scales, and goose head lights.
Gorgolon said that other provincial health offices in the region will also receive the same set of equipment.
“Kailangan mayroon kayong medical technologist para sa chemical analyzer. Baka kasi ibigay natin wala namang gagamit,” she stressed.
Gorgolon said the analyzer must be maximized with its full potential in order to fully serve the needs of patients.
“Fifty thousand ang halaga ng chemical analyzer kaya dapat mayroong gagamit nito,” she added.

Development council: Prioritize coastal roads

CITY OF SAN FERNANDO — The sectoral committee for infrastructure development (SCID) of the Regional Development Council (RDC) in Central Luzon “strongly endorsed”, and vowed to prioritize the construction and development of coastal roads linking Bulacan, Pampanga and Bataan.
SCID chairman and Bulacan Governor Wilhemino Sy-Alvarado said the motion raised by Balanga City [Bataan] Mayor Jose Enrique Garcia III merited immediate attention and endorsement since the construction of the coastal roads from Calumpit to Lubao is part of the 25-year development plan.
It can be recalled that a similar scheme has been broached early last year by Pampanga Governor Lilia Pineda and Second District Representative Gloria Macapagal-Arroyo and similarly been included in the province’s development plan which notes the coastal roads would spur development in Libao, Sasmuan, Macabebe, Masantol and part of Minalin.
“We are strongly endorsing it and draft the necessary resolution of support. As far as I know, there has already been a feasibility study on that since it is part of the 25-year development plan of the past administrations. All it needs now is revisiting the proposal because the coastal roads would definitely bring development in areas of Bulacan and Pampanga as well as Bataan where they would traverse,” said Sy-Alvarado.
“It is actually what they did in Cavite. Look at how fast communities and business grew along their renowned coastal road. They veered away from center points and moved outwards to coastal areas before focusing on main inner areas. It will facilitate the transport of goods from the west –that is Bataan and Pampanga — to south like Bulacan And Manila and vice versa. Aside from that, it will cut travel time by as much as two hours. Sana lang it would be realized during our time,” he added.
Sy-Alvarado also told Sun.Star Pampanga that the SCID will formalize its endorsement and resolution seeking to fast track the construction of the stalled North Rail project, citing its importance to the Clark Freeport and linkages to Metro Manila.

Delay in bridge work affects residents, students

APALIT – The delay in the reconstruction of the bridge in Barangay Colgante in this town is continuously causing inconvenience to thousands of residents including students.
Local officials also fear that students will be affected during the opening of classes on June 13.
The concrete structures discovered during a clearing of operation conducted by the contractor is causing the delay in the bridge construction.
Donato Samson, an engineer from contractor Leadway Construction and Development Corporation, working on the collapsed Colgante bridge, said the original deadline for its reconstruction is on June 15.
As of this month, the replacement of the bridge is still ongoing and the setting up of bored piles and abutments for the structure are halfway through.
“The Delta Components and materials are ready but because of the obstructions, nagtagal kami sa clearing,” said Samson.
But Rochelle Olalia, another engineer from the contractor, claimed that they are still ahead of the new deadline given to them which is on September 15 this year.
The delay in the construction of the said bridge is continuously causing inconvenience to the residents and motorists.

Aquino’s House allies asked to revive SCTEX probe

ANGELES CITY — A fishermen alliance has challenged President Benigno Aquino’s allies in the House of Representatives to revive the “unconcluded investigation on the controversial Subic-Clark-Tarlac Expressway (SCTEx) project”.
The Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya) issued the statement a day after Malacañang Palace spokesperson Abigail Valte announced to the public that the President will not sign a waiver that would open his bank accounts to public scrutiny.
In a press statement, Pamalakaya vice chair Salvador France asked party mates and allies of the President to reopen the congressional inquiry on the expressway project which the Pamalakaya official said failed to reach a conclusion.
“In the name of truth and accountability, we ask the Liberal Party and other allies of President Aquino from other political parties to resume the investigation. If President Aquino really wants to clean the government, then he should order Congress to revive the investigation on SCTEX and submit himself to honest-to-goodness probe in aid of legislation,” France stressed.
“To be brutally frank here, we strongly believe Mr. Aquino has something to do with the grand corruption pertaining to SCTEX corruption scandal. If he has nothing to do with the overpricing and machinations that led to the leap bound hike in the price of Hacienda Luisita land from P 40,000 per hectare to P 1 million per hectare, then by all means he should come clean and let Congress and other independent bodies to probe him,” said Pamalakaya.
Pamalakaya maintained that portioned of Hacienda Luisita through which the SCTEX passed was realigned to make it pass through the sugar-estate controlled by the family of the President.
The militant group asserted that Hacienda Luisita was paid by the government for P80 million for the right of way for 83 hectares of land that was made part of the expressway.
Pamalakaya said the administration of former President Gloria Macapagal-Arroyo spent taxpayers money for an overpriced property by P92 per square meter.
Pamalakaya recalled the government paid P100 per square meter, where the actual sale of farmland at the time of selling was only between P6 to P8 per square meter. The group said the overpricing was confirmed by no other than the Department of Agrarian Reform (DAR) during a congressional hearing.
The militant group said on top of the P80 million, the Arroyo government also spent taxpayers money amounting to P170 million to construct a road interchange which linked Luisita private road to SCTEX.
Pamalakaya recalled that the still unconcluded House committee investigation confirmed that President Aquino, then a congressman and House Deputy for Luzon used his influence as a congressman in 2004 to have the original route diverted to Luisita which at that time was largely inaccessible. The same inquiry asserted that Aquino stood as the proponent of the SCTEX project that directly benefited his family.
The congressional hearings then pointed out that Aquino’s interference in the SCTEX project through Hacienda Luisita paved way to increase the original cost of the expressway project from P18.7 billion in 1999 to P21 billion in 2004. At the time SCTEX project was done, its cost ballooned to a whopping P32.808 billion, or almost doubled of its original price.

Business as usual for Ombudsman despite grenade incident

MANILA — Scheduled commitments of Ombudsman Conchita Carpio-Morales pushed through on Thursday, hours after a grenade was found outside her Muntinlupa City residence.
Speaking to reporters, Morales said “these are the risks attendant to the job” running after corrupt employees and officials in government.
“I’m a fatalist, if it’s your time, it’s your time (to die),” she said.
An M-26 hand grenade encased in a canister was found outside the fence adjacent to the house security quarters.
One of the two guards stationed at Morales’s house discovered the canister with a note bearing the Ombudsman’s initials “CCM” and an illegible message.
The grenade is already in the custody of the PNP Southern Police District, which is currently investigating the case. They are likewise reviewing the video recording of the closed-circuit television (CCTV) camera installed in the Ombudsman’s house.
To date, there is yet no conclusive investigative report.
Coincidentally, a two-day security survey that ended last Wednesday was conducted in the Office of the Ombudsman.
Aimed to determine the office vulnerabilities to security breaches and recommend appropriate security measures, the exercise entailed a veiled attempt to breach the office security, including an unannounced mock planting of explosives at vital areas and the effectiveness of detection by the K-9 unit
