CITY OF SAN FERNANDO — A total of 698 shanties, houses, and other illegal structures established along the Pampanga River in towns of Macabebe and Masantol are set to be demolished by the Department of Public Works and Highways (DPWH).

This came as DPWH started the initial implementation of the Supreme Court‘s decision involving the cleanup of waterways from Pampanga Bay all the way to the mouth of Manila Bay.

The higher court ordered DPWH and other attached agencies to clean up, rehabilitate, and preserve Manila Bay in order to restore and maintain its waters for the next generation.

Demolition will also cover at least 233.571 hectares dedicated to fishing industry, a portion of the High Water Channel (HWC) located within the municipal waters in Macabebe town.

Antonio Molano Jr., DPWH regional director, said that some 40 houses and illegal structures in Macabebe town were already dismantled.

Molano explained that all connected rivers and waterways that eventually exit to Manila bay should be cleared from any obstructions.

Macabebe Mayor Annette Balgan in a previous interview, told Sun.Star Pampanga that in Barangay San Esteban alone, a place near the mouth of Manila Bay, more than 50 hectares have been occupied by illegal fishponds.

She also stated that during dry season, they cannot pass through going to the mouth of Manila Bay except during high tide.

It was learned that the fishing structures also prevent the free flow of water from Pampanga River down to Manila Bay.

MANILA (Updated) — The Supreme Court (SC) affirmed the Court of Appeals (CA) decision ordering the inclusion of detained former Autonomous Region in Muslim Mindanao (Armm) governor Zaldy Ampatuan in list of accused in the Maguindanao massacre case.

In a resolution dated June 25, 2012, the SC’s Third Division junked the petition filed by Ampatuan, which sought for his exclusion from the 57 counts of murder filed against his father, former Maguindanao governor Andal Ampatuan Sr., and several relatives.

The Ampatuans are charged with multiple murders, in relation to the murder of 57 individuals, among them 32 media workers, on November 23, 2009, in a highway in Maguindanao province.

The SC ruled that Zaldy Ampatuan failed to show that the appellate court committed grave abuse of discretion in issuing its final ruling on November 8, 2011, ordering the Quezon City regional trial court to proceed with the trial.

“After review of the records, the Court resolves to deny the petition for failure to show that the CA any reversible error in affirming the May 5, 2010 resolution of the Department of Justice (DOJ) that ordered the reinstatement of the criminal information for murder against petitioner Datu Zaldy ‘Puti’ Ampatuan,” the SC said.

In its November 8, 2011 decision, the CA did not give weight to Ampatuan’s claim that the DOJ grossly violated his constitutionally guaranteed right to due process when it issued a resolution on May 5, 2010, reversing its April 16 resolution, based on a new evidence which was not presented during the preliminary investigation.

The DOJ’s May 5, 2010, resolution, according to the CA, was in accordance “with the facts, the law and prevailing jurisprudence on the matter at hand.”

In his April 16 resolution, then Justice Secretary Alberto Agra reversed the order of the investigating prosecutors and excluded Ampatuan from the multiple murder charges.

He noted that the latter was able to sufficiently establish that he was in Davao City from November 20, 2009 up to the early morning of November 23, 2009, when he flew to Manila and on the following day from Manila to Cotabato contrary to the testimony of the National Bureau of Investigation witness Kenny Dalandag.

Agra, however, abandoned the said resolution after it was met with public outrage.

Ampatuan, in his petition at the CA, noted that in issuing the May 5 resolution, Agra accepted and gave credence to the affidavit of new witness Abdul Talusan, which was submitted by private prosecution lawyer Nena Santos in her supplemental motion for reconsideration.

In a related development, a man who was set to testify in the Maguindanao massacre surfaced to prove he is still alive. Menzi Mangulamas Ubpon said he was not thrown into Liguasan Marsh.

He received death threats after news spread that he was set to testify against the Ampatuan clan. Ubpon was a former employee of the Shariff Aguak municipal office.

He went into hiding for the past five months after receiving death threats. On December 29, 2011, he was shot while walking to his farm in Shariff Aguak. Despite being wounded he was able to flee towards a safer location.

Ubpon showed his identification card and a resident certificate (cedula) as proof that his real name is Rahim Ubpon, and Menzi is only his alias.

PRESIDENT Benigno Aquino III clarified Thursday that there is no request coming from the Philippines for the United States to send spy planes to the disputed area in the West Philippine Sea.

“There was a mistake in my interview the other day. He believes that we already made a request. If you will go through the transcript of the interview, what I said was: ‘we might.’ In the story, we already have a request or there were already overflights which wasn’t what I stated,” Aquino said in Filipino in an interview in Pasay City.

The President, meanwhile, admitted that the Philippines lacks adequate equipment and vessels to protect its territorial waters but he sees nothing wrong to seek help from the US.
“Let us correct it. America is a treaty ally. We have deficiency, they have the capacity. If ever we have shortage, I think we can approach them to boost what we call situational awareness in the West Philippine Sea,” he said.

Aquino also denied that what he said was meant to provoke and stir up tensions with China reiterating call for the Chinese side to be careful with its statements.

“It is not clear to me what provocative statement did the Philippine side made. We are aware of various statements coming from the Chinese side. Maybe, there is a need for them to read what was published in their newspapers, with all due respect, they should balance what they were saying to what is true,” he said.

Malacañang has defended the President on the issue, saying his remarks were “taken out of context” and misinterpreted by the China. The Philippines maintained its commitment to have a peaceful resolution of the territorial row at the West Philippine Sea.

Aquino will be presiding a full Cabinet meeting Thursday afternoon to discuss the implication of the ongoing dispute between the Philippines and China to the country.

Asked if the redeployment of ships will be discussed, Aquino said: “There are many schools of thought on how to handle, how to deal with the Chinese. So we will be getting, in effect, a discussion on opposite points of view on what is the best approach to settle this issue.”

He said there should have been no issue should China already clear the Panatag (Scarborough) shoal of their fishing vessels.

“It has been three weeks since the Coast Guard vessels were pulled out from the shoal. If their vessels were also pulled out especially the government vessels, there should have been no issue. So who is delaying the issue in Panatag Shoal or in Bajo de Masinloc?” he asked.

PUBLIC Works Secretary Rogelio Singson ordered on Thursday the immediate investigation on the “covered manholes” in Metro Manila that allegedly caused flooding in parts of the metropolis recently.

Singson directed the Department of Public Works and Highways (DPWH) regional director and district engineers of the National Capital Region (NCR) for the prompt inspection of the flooded areas to check the real numbers and location of the covered manholes.

“I want them to submit immediately the reports on the inventory of these manholes and identify the negligent contractors and project engineers who are responsible in covering these manholes,” he said.

“We have to be strict on our stand to punish those who are found guilty in such violation, whether they did it intentionally or not. The contractors who covered the manholes, of course, will be held liable. They will do the clearing and they will shoulder the work expenses at no extra cost from the government,” he added.

Singson warned that the DPWH official or personnel who are accountable for the work of the contractors will also be penalized, with the least being suspended from office.

“It is no longer business as usual,” he said.

The manholes, especially the inlets in road gutters of highways, are important for the easy flow of floodwater. These should be free from any obstruction, whether garbage or excess asphalt so as not to clogged the canals and impede the flow of floodwater.

“Our private contractors might have rushed the upgrading of major thoroughfares in time for the 2012 meeting of the Asia Development Bank Board of Governors and the limited working days on weekends, but these should not be an excuse to put the quality and safety of our roads and drainage at risk,” Singson said. MANILA (Updated 5:27 p.m.) — The Philippine government has protested China’s move to place virtually the entire West Philippine Sea (South China Sea) under the jurisdiction of a newly created city.

Department of Foreign Affairs officials summoned Chinese Ambassador Ma Keqing in Manila on Wednesday and handed her a note protesting China’s recent establishment of Sansha city, which would have jurisdiction over all disputed territories in the potentially oil- and gas-rich region.

The developed amid President Benigno Aquino III’s latest pronouncement that the Philippines may ask the United States to deploy spy planes over the West Philippine Sea to help monitor the disputed waters.

Hernandez said the “extent of the jurisdiction of Sansha City violates Philippine territorial sovereignty over the Kalayaan Island Group and Bajo de Masinloc.”

Aside from the violation of the country’s territory, the DFA said the China’s move clearly violates the established rules in the area.

“The declaration on the establishment of Sansha City contradicts the spirit of the Declaration on the Conduct of Parties in the South China Sea,” Hernandez said.

“[The city’s jurisdiction] infringes on Philippine sovereign rights over the waters and continental shelf of the West Philippine Sea,” Hernandez added.

The jurisdiction of Sansha City covers the Spratly Islands, Paracel Islands, Macclesfield Bank and the Bajo de Masinloc, which was the center of a months-long standoff between China and the Philippines.

The standoff ended in mid-June when President Benigno Aquino III ordered the pull out of Philippine vessels from the shoal.

On June 21, China announced the establishment of Sansha City, which is a prefectural-level city that administers the three disputed island groups of Nansha (Spratly Islands), Xisha (Paracel Islands), and Zhongsha (Macclesfield Bank) as well as their surrounding waters.

The three island groups, which are purportedly rich in oil and mineral reserves, are being claimed by five other Asian countries.

“The Philippines reiterates that the Kalayaan Group of Islands and Bajo de Masinloc and the waters and continental shelf around them form an integral part of the Philippine territory and maritime jurisdiction,” Hernandez said.
