NOMINEES for the Chief Justice position should not be denied a chance to vie the post just because they are facing a disbarment case, a senator said.
Some disbarment cases are only used for harassment, Senator Aquilino Pimentel III said, especially in the case of Justice Secretary Leila de Lima, who was put to task for calling then Chief Justice Renato Corona a tyrant who is beyond justice and accountability.
“The disbarment complaint against Secretary de Lima is a classic case of political harassment and meant to deter her from performing her duties,” Pimentel said.
The senator asked the vetting body Judicial and Bar Council (JBC) to study the complaints carefully.
Rule 4, Section 5 of JBC excludes applicants from being nominated if they have pending criminal or regular administrative cases, pending criminal cases in foreign courts or tribunals and have been convicted in a case where the penalty was over P10,000 unless granted judicial clemency.
Election lawyer Romulo Macalintal earlier clarified that under existing Uniform Rules on Administrative Cases in the Civil Service, the phrase “pending administrative cases” means there is already a formal charge leveled against a person.
At present, there are already 65 nominees for the Chief Justice post but only 13 nominees have accepted and 12 nominees turned down, including Executive Secretary Paquito Ochoa Jr.
De Lima has until July 2 to accept or reject the nomination.
“Technically, she can be disqualified but that will change if her disbarment case is favorably resolved before the (JBC) voting,” lawyer Jose Mejia, the JBC member representing the academe, told Sun.Star.
The justice chief’s case is still with the Integrated Bar of the Philippines (IBP), whose Zambales chapter nominated her to the highest post in the judiciary two weeks ago.
The eight-member JBC will try to submit a shortlist of nominees to President Benigno Aquino III on July 30, giving him less than a month to choose Corona’s replacement.
Corona was removed from office by the Senate impeachment court last May 29 for betrayal of public trust and culpable violation of the Constitution when he failed to report multi-million-peso cash deposits in his asset statement.

PRESIDENT Benigno Aquino III assured on Monday necessary assistance to the victims of reported collision between a Philippine boat and a Chinese fishing vessel in Bolinao, Pangasinan.
President Aquino refused to blame China on the incident, saying he is still waiting for the result of the investigation.
“There is an investigation, determination of cause, determination of who is at fault. Then after all of this investigation, then that tells us where we will proceed,” Aquino said in an interview in Benguet.
“So now, let us not pinpoint to anyone while there is no sufficient evidence,” he added.
The National Disaster Risk Reduction and Management Council (NDRRMC) reported Sunday that a Filipino fisherman died while four of his colleagues remain missing after a Chinese vessel allegedly rammed their boat.
The fisherman who died in the incident was identified as Christopher Carbonell from Bolinao, Pangasinan, while the four missing fishermen were identified as Fred Celino, Arnold Garcia, Domy de los Santos, and Amante Resonable.
The Chinese Embassy denied on Monday the incident, saying it has not received any report about the collision last June 20.
Aquino vowed justice for the victims of the collision.
“If there was a ramming incident and you left the fishermen in the middle of the sea — that is in clear violation of the laws governing the seas. That is actionable. We can go to the appropriate fora to file the necessary charges for justice for our fishermen,” he said.
Aquino said the government is rendering assistance to the three fishermen who were rescued, namely: Edimio Balmores, Herman Balmores, and Celino Damian.
The three are currently confined at Gabriela Silang General Hospital in Vigan City, Ilocos Sur.
Aquino said there is still no definite plan if he will visit the three survivors, noting they are being assisted by the Department of Social Welfare and Development.
“The authorities could not get statements from them because they are still suffering from hypothermia, rapid loss of body warmth. So, they still could not talk. There is no point if I go there because I cannot speak to them,” he said.
Aquino, meanwhile, said that the Philippines will not be sending back ships to the Panatag Shoal anymore because there is no presence of Chinese vessels in the area.
“If all the ships are no longer there, there is no purpose for them to be there,” he said.
He refused, however, to say if the return of ships means the end of the standoff, saying he is still waiting for the result of the latest survey of the Philippine Coast Guard.

CITY OF SAN FERNANDO – Mayor Oscar Rodriguez has made it to the final list of awardees for the 2012 Civil Service Commission’s (CSC) Search for Outstanding Public Officials & Employees.
This was disclosed by the CSC Monday being the Honor Awards Program (HAP) secretariat that conducts the annual search for public service exemplars based on the 1987 Philippine Constitution and as provided by law.
Public Employment Services Offices (Peso) Manager Donny Sayre also made as finalist.
The CSC described the annual nationwide search as the agency’s advocacy of promoting excellence, recognizing and rewarding civil servants for their outstanding performance, contribution and achievements or consistent manifestation of exemplary ethical behavior in public service.
It is also deemed as the highest and most coveted recognition to be conferred by no less than the President of the Philippines.
Rodriguez will compete in the finals with eight other outstanding civil service officials, among them Mayor Edward Hagedorn of Puerto Princesa City, Palawan; Jose Garcia of Balanga City, Bataan; and Governor Vilma Santos-Recto of Batangas.
Sayre on the other hand was included in the top 12 individual finalists for the CSC “Pag-asa” Awards for his exemplary service in the local government unit. He was also conferred Best Peso Manager in 2011 along with Rodriguez as Best Peso local chief executive.
During the Monday flag rites at City Hall, Rodriguez expressed happiness for being a step away from winning the prestigious award. “It is really overwhelming to know that two civil servants here in San Fernando are again recognized as the best public servants in the country,” he said.
The criteria for the Lingkod Bayan and CSC Pagasa Awards include noteworthiness of outstanding performance or contributions; impact of performance or achievement; reliability and effectiveness; consistency of performance; demonstration of teamwork; cooperation; and camaraderie and cohesiveness.
The awards will highlight the annual celebration of the Philippine Civil Service Anniversary in September.

CITY OF SAN FERNANDO – Governor Lilia Pineda told officials of the nine district and provincial hospitals on Monday that patients afflicted with dengue should be properly treated for free.
“Sinabihan ko na yung mga hospital chiefs natin na kapag pasyente sa dengue ay gamutin nila ng maayos at walang babayarang bill,” she said.
This came amidst reports that dengue cases are rising in the province despite its reported 500 decrease during the first quarter of the year.
“No need to be complacent with the remarkable decrease in dengue cases and other related diseases as the rainy season has started this month,” the governor said.
Pineda added, “We have to be more cautious and vigilant as these diseases may hit when we least expect it.”
Dr. Marcelo Auchico, provincial health officer, said there is also a need for an intensified information dissemination campaign on the importance of clean surroundings and good health care.
Auchico said he has coordinated with various schools throughout the province regarding the said possible spread of the dengue virus.
“We have also joined the ‘Brigada Eskwela’. Together with the barangay health offices, we helped clean schools and their surroundings and premises,” Auchico added.
Auchico said the Provincial Government’s current strategy is to focus on areas with high incidences of dengue and distribute larvicide in said areas.
