Supreme Court to hear petitions to stop impeachment trial

ALL five petitions asking the Supreme Court (SC) to stop the Senate’s impeachment proceedings against the Chief Justice will be discussed on Tuesday.
The High Tribunal will resume a full-court session and it is expected to rule on whether to grant the common petition seeking a temporary restraining order (TRO) on the Senate impeachment trial of Chief Justice Renato Corona.
The High Court may consolidate the five cases, ask respondents to file comments, and set cases for oral arguments.
Corona will inhibit himself in the Tribunal’s deliberations, SC spokesman and court administrator Jose Midas Marquez said.
The five petitions were separately filed by tax informer Danilo Lihaylihay; former Integrated Bar of the Philippines president Vicente Millora; lawyers Vladimir Cabigao; Oliver Lozano; and the group of Homobono Adaza and Allan Paguia.
Almost all the petitions cited the lack of verification, saying 188 complainants from the House of Representatives signed the complaint without reading it.
For their part, Adaza and Paguia said the Senate abused its discretion when it accepted the “unverified” complaint and set the impeachment complaint for trial.
Speaking to reporters, Corona lead counsel Serafin Cuevas said Corona may still perform his duties and functions as chief magistrate and need not take a leave of absence while his impeachment is being heard by the Senate.
“Hindi po, wala pong obligasyon and hindi tinatakda sa Saligang Batas o sa kahit na anong batas na nagsasaad na kailangan niyang mag-leave,” he said. (JCV/Sunnex)

Penro to assist LGUs without MRF

CITY OF SAN FERNANDO — Pampanga Environment and Natural Resources Officer Arturo Punzalan said the provincial government is willing to assist local government units in putting up their own materials recovery facility (MRF).
“We can provide them the construction materials they need in putting MRFs for their town,” he said.
Punzalan’s statement was in response to the latest report of the Department of Environment and Natural Resources-Environmental Management Bureau (EMB) that six towns in the province failed to build their own MRFs despite the enactment of Republic Act 9003 or the Ecological Solid Waste Management Act of 2000.
Based on the EMB report, the towns of Bacolor, Candaba, Masantol, San Simon, Sasmuan and Sta. Rita do have operating MRFs yet.
“Most of these towns have not yet found a location for their MRF that is safe from flooding during the rainy season,” Punzalan said.
Recently, Punzalan said Bacolor Mayor Jomar Hizon and Candaba Mayor Jerry Pelayo have located possible sites for their respective MRFs.
The other four mayors, Punzalan said, have also coordinated with his office for the creation of their MRFs.
Since Governor Lilia Pineda closely monitored the closure of open dumpsites and the creation of MRFs in the province, Punzalan said waste segregation has improved.
“We have improved in a way that a lot of Kapampangans are now aware of proper waste segregation,” Punzalan said.
Since other towns in the province have their MRFs, garbage being hauled to the Metro Clark Sanitary Landfill in Capas, Tarlac has also decreased.
Punzalan said the provincial government has saved millions of budget for not hauling much garbage to the sanitary landfill.

Pampanga leaders lead re-opening of Bacolor hospital

BACOLOR — Pampanga third district Representative Aurelio Gonzales Jr. and Governor Lilia Pineda led the blessing and re-opening of the Ricardo P. Rodriguez Memorial Hospital in its original location here.
The event was attended by Mayor Jose Maria Hizon, provincial board members of Pampanga and other local officials.
The re-opening is part of the commitment of the Provincial Government to finally operate the district hospital to serve indigents of Bacolor and neighboring towns.
The facility was built on a P25-million budget through the initiative of Gonzales, with an additional P27 million for other equipment and materials. According to Gov. Pineda, they have also spent P5 million for the refurbishing of the hospital along with other equipment to make it fit for operational standards.
“Currently we have a 25-bed capacity and we hope to accommodate patients once the permit to operate is in order,” Pineda said.
To recall, the operation of the district hospital was transferred to the Bulaon Resettlement Area in the City of San Fernando after the eruption of Mt. Pinatubo that devastated the town.
Congressman Gonzales said the operation and re-opening of the district hospital is a sign that Bacolor is coming back on its feet after the disaster. He said that the facility is something that can entice more of the original population of the town to return.

The BRCA, which was signed by then President Gloria Arroyo in September of 2008, was authored by Gonzales in the lower chamber and sponsored by then Senator Benigno Aquino III, chairman of the Senate committee on local government, in the upper chamber.
Meanwhile, Bacolor Mayor Jomar Hizon expressed optimism that the new facility would soon be operational to better address the health needs of residents of the town.

Lawmaker denies accusing Aquino of bribery

REPRESENTATIVE Pastor Alcover Jr. of the Anad party-list group denied accusing President Benigno Aquino III of bribing the 188 lawmakers who signed the impeachment complaint against Chief Justice Renato Corona.
In a December 20 Sun.Star Cebu report – Did pro-Corona impeachment legislators get bonuses from Malacañang? – Alcover was quoted as saying: “Gidawat kuno nila kay maayo nalang kuno ipamasko sa ilang constituents. Pagka-bagag nawong mga tawhana (They said they accepted it because they want to give Christmas presents to their constituents. They’re shameless).”
Alcover was pertaining to the alleged P1-million bribe offered by Aquino to each of the 188 House members. Other Cebuano lawmakers who signed the impeachment complaint denied the supposed claim of Alcover.
In a privilege speech Monday, Alcover said the Sun.Star Cebu report was “instantly played up by media in Manila” and his colleagues were quick to react without “checking the facts” and “extending a simple courtesy of calling me up to hear my side.”
Alcover explained that the Sun.Star Cebu report carried the same statements he made in an earlier radio interview with Elias Baquero in the program “Yagyagan” over DYDD, Cebu City.
Ike Durano, station manager of DYRF, supposedly “inflamed” an already “tenuous situation” when he called up and interviewed Bayan Muna Representative Neri Colmenares, one of the impeachment prosecutors, Alcover said.
“Claiming balanced and fair reportage, Durano called me up and took my side on the issue. Practically, in my interview with Durano, I just repeated the very same things that I’ve said during Elias Baquero’s radio program. Immediately after our interview, Durano ranted with expletives and innuendoes accusing me of things I never committed nor possessed in my lifetime,” Alcover said.
“In all that I’ve said in these interviews, there was no mention, whatsoever, nor even finger pointing and accusing President Aquino III of bribing the 188 congressmen,” he said.
Alcover dared House Majority Leader Neptali Gonzales, Representatives Ben Evardone (Eastern Samar), Roger Espina (Biliran), Rene Relampagos (Bohol), and Cesar Sarmiento (Catanduanes) to make good of their threat to have him investigated by the House Committee on Ethics where he may face possible expulsion from the body.

MANILA — Several House leaders and members who signed the impeachment complaint against Chief Justice Renato Corona are expected to attend the start of the impeachment trial Monday afternoon.
According to Aurora Representative Juan Edgardo “Sonny” Angara, deputy spokesperson of the prosecution panel, House Speaker Feliciano Belmonte Jr. and Majority Leader Neptali Gonzales will attend the trial after they formally resume the legislative session in the House of Representatives.
Congress resumes legislative session today, January 16, after coming from a month long break.
Other House members expected to attend are Batanes Representative Henedina Abad, Quezon Representative Irvin Alcala, and Quezon City Representative Jorge Banal.

Corona lawyer: Don’t belittle objection to ‘unverified’ complaint

MANILA–Chief Justice Renato Corona’s critics cannot dismiss his protest of what he considers an invalid impeachment complaint as just a delaying tactic, one of his lawyers said Monday afternoon. His objection is rooted in the Constitution, and not something plucked from the air, lawyer Dennis Manalo told reporters during the run-up to the impeachment trial scheduled later that day.
“This is not something we just made up. It is in the Constitution,” he said, referring to Corona’s motion to have the complaint thrown out for not being “verified,” and therefore, invalid. Corona’s lawyers contend that under Article XI, Section 3 requires a complaints must be verified before it can be filed and then brought to the House in plenary.
The Chief Justice’s lawyers have said that means signatories should have studied the complaint beforehand.
In their motion asking for a preliminary hearing, they cited the Supreme Court’s decision in Lambino v. Commission on Elections, where 6.3 signatures allegedly in support of a “people’s initiative” petition in 2006 to amend the Constitution, were voided. “With only 100,000 printed copies of the petition, it would be physically impossible for all, or a great majority of the 6.3 million signatories to have seen the petition before they signed the signature sheets,” the Supreme Court ruled then.
He said lawmakers who signed the complaint did not get to read, and therefore verify, the complaint, and that that makes the proceedings that impeached him in December invalid.
Prosecutors have called the motion a dilatory tactic, however, saying parties in the House majority had been given copies beforehand, and that there were “numerous” copies for the lawmakers to read at a majority caucus where the complaint was discussed. Iloilo Representative Niel Tupas Jr. has also said the complaint had more than the required one-third of the House membership to be immediately transmitted to the Senate. In their reply to Corona’s motion, they said that even if some lawmakers were unable to study the complaint, they are outnumbered by those who did.

Clark 2011 exports breach $2-billion mark

CLARK FREEPORT – The Clark Development Corporation (CDC) announced that the value of exports inside this world-class Freeport for 2011 has breached the $2-billion mark, three years earlier than the target date set by the state-owned firm.
CDC president Felipe Antonio B. Remollo said despite an apparent decline in Philippine exports due to a worldwide economic slump last year, Clark-based enterprises were able to ship at least $2.258 billion in exports between January and December 2011.
Comparatively, Remollo said the amount is a remarkable 55-percent increase from the $1.453-billion exports recorded in 2010.
According to Remollo, the $1.573 billion exports from Clark’s electronic sector had helped propel this record surge. This was followed by tire exports at $298 million and garments at $226 million. Manufacturing firms contributed $131 million while aviation-related companies completed the top five exporting sectors with $13 million.
“The country’s export performance may not be altogether bleak as exports of the Clark Freeport Zone exceeded the P2-billion mark a good three years earlier than the target date set by the CDC,” Remollo revealed.
The 2011 record export volume puts CDC on track in attaining the three major performance targets dubbed “3-2-1 Development Roadmap” for Clark where $3 billion is in investments, $2 billion in exports, and 100,000 jobs, which must be achieved by the state-run corporation by the year 2014.
“With these developments in the exports sector, the present trends show that these targets are attainable much earlier than planned,” Remollo said.
Clark’s perennial top exporter, Nanox Philippines, Inc., remains at the top of the CDC’s list with exports of more than $791 million in custom-designed products such as Liquid Crystal Display panels, LCD modules, Monochrome LCDs, and other related electronic parts.
Trailing behind is Phoenix Semiconductor Philippines Corp. (PSPC), a company established only in January 2010 by one of Korea’s leading provider of semiconductor packaging. PSPC exported more than $566 million in electronic parts with DDR3, NAND, Flash Cards and SSD, as well as memory modules for PCs and notebooks.
Last year’s second top exporter, Yokohama Tires Philippines, Inc., is this year’s third largest Clark exporter with over $298 million in tires exports. Notwithstanding the slight drop in ranking, Yokohama’s export value is still 31% higher compared to that of last year.
Two more firms, L&T International and SMK Electronic, complete the list of top five Clark exporters with $145 million and $98 million in garments and electronics exports, respectively.
Moving on to other top performing firms here, HLD Clark Steel Pipe has exported more than $71 million to place sixth on the list of top exporters, a tipoff to the growing significance of the “other manufacturing” sector of Clark. HLD Pipes is a Chinese metal pipe manufacturer which specializes in customized thread end pipes, scaffolding tubes, various weld pipes, and square tubes.
In terms of year-to-year growth, Clark’s “other manufacturing” sector generated the highest rate of increase of 195 percent by exporting $131 million in 2011 compared to only $44 million in the previous year.
Two other firms under this bullish sector, Multi-Tek Fasteners Inc., a Taiwanese firm that is into manufacturing, rethreading, quality checking, repairing, surface treatment, repacking, exporting different types of screws, plugs, sockets, pipes, hubs, fasteners, and other related products, and Aderans Philippines, Inc., a manufacturer of high quality, customized wigs also made strong export contributions.
Other sectors which registered double to triple digit growth rates are Services, Tourism, Aviation-related, Electronics, Tires and Furniture.

Aquino: World Bank complaint shows another flaw in judiciary

PRESIDENT Benigno Aquino III said on Monday the alleged misuse of the World Bank (WB) loan alloted for the projects of the Supreme Cout (SC) is another proof that the judicial system is flawed and in need of reform.
In an interview during his engagement in Tarlac, the President said one could not contest that the WB issue is politically motivated since the complainant is an independent foreign party.
“Dagdag pruweba pa ‘yan ‘nung ating mga sinasabing kakulangan o dapat isaayos ng hudikatura,” Aquino said.
Senate finance committee chairman Franklin Drilon filed a resolution calling for the investigation into the alleged WB fund mess stemmed from the aide memoire dated December 28, 2011 sent by WB acting country director Matthew Stephens to Associate Justice Teresita Leonardo de Carpio, chairperson of the Judicial Reform Support Project (JRSP) management committee.
The aide memoire cited alleged “ineligible expenditures, including those incurred outside the agreed procurement plan.”
The WB told the High Court to refund a total of $199,900 (P8.7 million) comprising ineligible expenditures, adding that 70 out of 133 transactions made using the loan meant for the JRSP were not covered by the loan.
A big part of the loan was supposedly used to purchase computers including P2 million worth of laptops for various SC offices. Part of the money was also allegedly used to pay for the airfare of SC officials.
Drilon earlier pressed the importance of investigating the alleged irregularities, saying it “could prejudice the standing and credit-worthiness” of the SC and the entire Philippines before the international financial institutions.
Aquino, on the other hand, believes that the anomaly would not jeopardize other foreign loans granted to the government.
“Palagay ko ‘pag na-rectify ‘yung mga findings nila dito at ma-rectify rin natin ‘yung ating ginagawa sa ating judiciary system ay magiging kaagapay na naman natin sila sa pagpapaganda ng ating hudikatura,” he said.
Asked if someone should be held liable for the alleged fund misuse, he deferred comments, saying it would be better to wait for the investigation of the Commission on Audit. (Jill Beltran/Sunnex)
