CITY OF SAN FERNANDO – Flood-affected barangays in the province have been reduced to 98, said the Provincial Disaster Risk Reduction and Management Council (PDRRMC).
PDRRMC reported several communities in the towns of Sta. Ana, Apalit, Candaba, Macabebe, Masantol, Minalin, San Simon, Sto. Tomas, including this city remain inundated, even as the water level at the Pampanga River is going back to its normal level.
Hundreds of families, who stayed along the Arayat-Apalit setback levee, have started returning to their respective houses located along the Arnedo Dike of the Pampanga River.
In Candaba town, all major roads are now passable except the Baliwag-Candaba-Sta. Ana road along the San Agustin section. In Masantol, meanwhile, the barangay road along the stretch of Alauli, Bagang, Balibago, Sagrada and Sta. Lucia Anac is still not passable to all types of vehicles.
The Provincial Government and other concerned groups have also sponsored free medical consultations to provide the immediate health needs of the flood-hit residents.
The residents are also being given free medicines and those who opted to stay at evacuation centers are being provided with relief goods.
During the recent habagat (Southwest Monsoon), all barangays in the 4th district adjacent to this river were submerged in floodwaters. Thousands of families were displaced and forced to temporarily leave their houses.

CITY OF SAN FERNANDO — Labor Secretary Rosalinda Dimapilis-Baldoz urged private sector employers on Friday to observe the proper pay rules for their workers regarding this month’s holidays.
In a statement furnished to Sun.Star Pampanga, Department of Labor and Employment (Dole) regional labor communications officer Jerry Borja said Baldoz cited Monday, August 20; Tuesday, August 21; and Monday, August 27 2012, as the proclaimed holidays.

August 20 is a regular holiday in view of the celebration of Eid’l Fitr, or Feast of Ramadan, while August 21 is a special non-working day, it being “Ninoy Aquino Day.” August 27, meanwhile, is a regular holiday in commemoration of National Heroes Day.
The said dates are holidays pursuant to Proclamation 295 and 495 issued by President Benigno Aquino III on November 24, 2011 and August 13, 2012, respectively.
Baldoz has issued Labor Advisory 2, Series of 2012, “On the Payment of Wages on Tuesday, 21 August 2012, Special (Non-Working) Day, and on Monday, 20 and 27, 2012 Regular Holiday, Pursuant to Proclamation 295” and a Question and Answer periodical that provides clear explanation, with illustrative examples of computation, to facilitate proper wage payments for those dates. Both the advisory and the Q&A are in Dole’s website at http://www.dole.gov.ph.
The advisory stipulates that employers should abide by the guidelines on holiday pay like for regular holidays [Monday, 20 and 27 August] such that “if the employee did not render work during the regular holiday, he/she shall be entitled to 100 percent of his/her salary for that day [(Daily Rate + Cola) x 100 percent];” or “If the employee reported for work on such day, he/she shall be entitled to 200 percent of his/her regular salary for that day for the first eight (8) hours [(Daily Rate + Cola) x 200percent];” and “for overtime work rendered during this regular holiday, he/she shall be entitled to an additional 30 percent of his/her hourly rate on said day (Hourly Rate x 200 percent x 130 percent x Number of Hours Worked).”
It also notes that “if the employee worked during a regular holiday that also falls on his/her rest day, he/she shall be entitled to an additional 30 percent of his/her daily rate of 200 percent [(Daily Rate + Cola x 200 percent) + 30 percent (Daily Rate x 200 percent)]; and for overtime work rendered during the regular holiday that falls on his/her rest day, he/she shall be entitled to an additional 30 percent of his/her hourly rate on said day (Hourly Rate x 200 percent x 130 percent x 130percent x Number of Hours Worked).
As to August 21, which is a special non-working holiday, the advisory states that if the day is unworked, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day.
If worked, the employee shall be entitled to an additional 30 percent of his/her daily rate on the first eight hours of work (Daily rate x 130 percent); or if the employee worked during a special day, he/she shall be entitled to an additional 30 percent of his/her hourly rate on such special day (Hourly rate x 130 percent x Number of Hours Worked).
If the employee worked during the special day that also falls on his/her rest day, he/she shall be entitled to an additional 50 percent of his/her daily rate on first eight (8) hours of work (Daily Rate x 150 percent).
Baldoz’s advisory stressed that “in excess of eight hours, the worker shall be entitled to an additional 30 percent of his/her hourly rate on such special day (Hourly Rate x 130 percent x 150 percent x Number of Hours Worked).
“I urge our private sector employers to comply with the labor advisory on the payment of correct wages and benefits on these holidays. We owe it to our workers, who will be required to report for work and, therefore, must receive the correct wages and benefits,” said Baldoz.
She also directed concerned officials of the Dole, including the Bureau of Working Condition and the Dole regional offices to widely disseminate the correct information on the computation of holiday pay of all workers in the private sector.

MANILA (Updated) — Authorities had a hard time locating the wreckage of the plane carrying Local Government Secretary Jesse Robredo because its emergency location transmitter (ELT) failed to function on impact.

Civil Aviation Authority of the Philippines (Caap) Director General William Hotchkiss III said that prior to the accident, the Piper Seneca plane’s ELT was functioning well when his office conducted regular routine check.
An ELT is a plane device that automatically activates when a plane encounters emergency landing or any disaster. Caap last checked the plane’s ELT on November 21, 2011, and is valid for operation within a year.
“It is too early to speculate. Our investigating team is still examining the plane wreckage to determine the cause of the accident,” Hotchkiss said.
The ELT was found with the plane wreckage last Wednesday but the right engine of the plane is yet to be recovered.
The three-man Aircraft Accident Investigation and Inquiry Board (AAIIB) investigating team of Caap started its inspection on the plane immediately after the bodies of Robredo and pilots Captain Jessup Bahinting and Nepalese Kshitiz Chand were recovered off Masbate.
The plane crashed last August 18, some 800 meters from Masbate shoreline, due to engine failure. Only Robredo’s aide, Police Senior Inspector Jun Abrazado, survived in the accident.
Robredo’s remains, as well as the plane wreckage were found at a depth of 150 meters.
The plane wreckage is now under tight security at Masbate airport, Hotchkiss said, adding that search and retrieval of the plane engine is ongoing.
“The engine is a key part of our investigation. This will determine if indeed it was due to technical or mechanical problem that caused it to fail,” he added.
He also dismissed speculations that diluted aviation fuel was used by the plane that caused the fatal crash. He said premature conjectures like this will not help Caap’s investigation.
The former elite fighter jet pilot added that part of their investigation is to check the fuel used in the engine and trace where the plane last refueled prior to its flight from Cebu to Naga City.
The AAIIB is also reconstructing the flight path of the ill-fated plane including communication between control towers and the pilot. Caap has also taken the statements of key witnesses and will issue subpoena to others to shed light on the incident.
“It will not be an easy investigation, but as directed by (Transportation) Secretary (Mar) Roxas, we will not leave any stone unturned to find out the real cause of the accident,” Hotchkiss said.
He said Caap will look into the unsafe practices of aviation firms that enable them in the past to continue operating in spite of getting involved in previous plane accidents.
Hours after the accident last Saturday, Roxas immediately directed Caap to dispatch a Go Team composed of aviation experts to conduct investigation of the incident. He also ordered the suspension of Aviatour Air, the operator of the Piper Seneca plane.
Caap also formed a composite team last Wednesday to serve as AAIIB headed by Captain Amado Soliman, an aviation industry expert in flight safety for over four decades, Captain Ramon Flores, and Captain Elmer Pena. (SDR/Sunnex)

MANILA (Updated) — The new Chief Justice of the Supreme Court (SC), Maria Lourdes Sereno, vowed on Friday to stay true to her oath “until the end of her term.”
Sereno was named Friday by President Benigno Aquino III as the 24th Chief Justice of the SC and the first woman to hold the highest position in the country’s judiciary.

Upon knowing her appointment, Sereno thanked the President for giving her the chance to lead the judiciary in the next 18 years.

“First of all, I give all the glory to God. To the President, I thank you very much,” she said.
She also thanked the media for “partnering with us in the judiciary” as she vows to give more lengthy statements in the next days.
Sereno will serve a term that will span four Presidents, including Aquino, because she will reach the mandatory retirement age of 70 on July 2, 2030.
She replaced Renato Corona, who was impeached and convicted by the Senate last May 29 for betrayal of public trust and culpable violation of the Constitution for his failure to truthfully declare his assets.
Sereno’s appointment came hours after she met Aquino in Malacañang at 3:30 p.m. Friday, said presidential spokesperson Edwin Lacierda.
She is scheduled to take her oath of office before the President in Malacañang at 10 a.m. Saturday.
On September 3, Sereno will preside the next meeting of the Judicial and Bar Council (JBC) to discuss the vacancy in the SC as a result of her ascension to the highest post in the judiciary.
“The President believes that after the assessment and evaluation, Justice Sereno is the candidate who is most able to institute reforms in the judiciary. That is the only consideration that the President had in appointing the next Chief Justice,” Lacierda told reporters, adding the President also interviewed other candidates the past two days.
Barring impeachment, resignation or death, Sereno may go down in Philippine history as the second longest serving Chief Justice next to Cayetano Arellano, the country’s first top magistrate.
Arellano was at the helm for almost 19 years from June 1, 1901 to April 1, 1920.
Before her appointment as associate justice in August 2010, Sereno was executive director of the policy think-tank of the Asian Institute of Management in 2009; professor of law at the University of the Philippines for almost 20 years, and consultant for judicial reform of the United Nations Development Program, the World Bank, and the United States Agency for International Development.
She handled various international trade and investment law disputes in the World Trade Organization in Geneva, International Centre for Settlement of Investment Disputes in Washington D.C., and in International Chamber of Commerce’s International Court of Arbitration in Singapore and in Paris, employing bilateral dispute resolution mechanisms.
She was co-counsel for the Philippine government in its cases involving the bidding and construction of the Ninoy Aquino International Airport (NAIA) Terminal 3.
During the public interviews last month, Sereno mentioned God several times as bedrock of her work ethic as she summed up her judicial philosophy in three words: vision, courage, accountability.
She said her leadership will be marked by willingness to create generation of judges who will commit themselves to life of uprightness.
Sereno, a mother of two, said her life has been fruitful and exciting because of God.
“I rely completely on God. I cry out to him for strength, to be a public servant after God’s own heart. It all depends on God whom I see from an eternal perspective,” she told the screening body JBC on July 27.
Members of the Corona prosecution team, meanwhile, welcome the appointment of Sereno, who was supposed to testify in the Article VII of the impeachment complaint against Corona last May.
Sereno, however, turned down the invitation of the prosecutors, citing a February 14 SC resolution disallowing justices and court staff from responding to summons of the Senate impeachment court.
Cibac party-list Sherwin Tugna, a member of the 11-man prosecution panel, said “the appointment is a welcome development for reforms and transparency in the judiciary”.
House Deputy Speaker Erin Tanada and Deputy Majority Leader Romero Frederico Quimbo, who were the prosecution’s spokespersons, said President Aquino’s “bold” decision is a logical choice considering the government’s “daang matuwid” (straight path) campaign.
“Her unquestionable integrity and intelligence certainly makes her a logical choice in the President’s pursuit of his ‘daang matuwid’ program. We support the President’s choice,” Quimbo said in a text message.
For his part, Tanada said, “It is a good choice. There will be stability in the SC for at least 18 years and true reforms may be implemented. I congratulate CJ Sereno as the first female CJ.”
Zambales Representative Mitos Magsaysay, a staunch critic of the Aquino administration, said the next 18 years will determine whether the President made a good decision or not.
In a text message, Corona said the appointment “speaks for itself.” He did not elaborate.
Kabataan party-list Representative Raymond Palatino raised fears, however, that Sereno’s appointment will pave the way toward the creation of an “Aquino court.”
Lacierda brushed off the speculation, saying it is the prerogative of the President to appoint who he believes should lead the Supreme Court and carry out reforms.
“On the fears that it will become an Aquino court, remember the appointees of the President are only Justice Sereno, Justice (Bienvenido) Reyes and Justice (Estela-Perlas) Bernabe, there are only so far three,” he said.
Palatino said Sereno voted for higher compensation for Aquino’s maternal relatives, the Cojuangcos, in the SC decision ordering the distribution of the Hacienda Luisita in Tarlac to over 6,000 farmers. Sereno has since denied the charge.
Lacierda also dismissed fears that Sereno lacks enough experience in heading the judiciary.
“The Constitution mandates that for a member of the Supreme Court he or she should have the minimum age of 40 years old and retire at the age of 70. The Constitution anticipates the possibility of someone being appointed at an early age,” he said.
He said the President considers the age of Sereno as an advantage in leading the Supreme Court as she has longer years to institute reforms in the judiciary. However, he stressed, age was not a factor when Aquino chose Sereno to lead the Supreme Court.
Sereno finished her economics degree one year ahead than Aquino at the Ateneo de Manila University in 1980. She then took up law at the University of the Philippines, where she graduated valedictorian in 1984.

MANILA — Leaders of the House of Representatives have filed a resolution conferring a posthumous Congressional Medal of Achievement to the late Local Government Secretary Jesse Robredo.
The distinction is sought for Robredo’s “immeasurable contributions in promoting good governance and practicing the tenets of a real democratic and participatory government.”

The Congressional Medal of Achievement seeks to “honor political, economic, and cultural leaders who have distinguished themselves through their life work and their vision.”
House Resolution 2687 was authored by Speaker Feliciano Belmonte Jr., Deputy Speaker Lorenzo Tañada III, Majority Leader Neptali Gonzales II, Minority Leader Danilo Suarez, and Representatives Joseph Emilio Abaya (Cavite) and Henedina Abad (Batanes).
The legislators took note of the accomplishments of Robredo, who was the mayor of Naga City for 18 years before being appointed as DILG Secretary by President Benigno Aquino III.
“Robredo is regarded as a pillar of good governance, introducing participatory democracy, enabling breakthrough improvements in local governance,” the resolution states.
The authors said Robredo’s reforms, including the Full Disclosure Policy (FDP), have inspired not only government workers in the DILG but also other state agencies.
The FDP requires local government units to disclose documents that show how funds are spent.
“He personified rare qualities of integrity, ethical leadership and transparency in government service worthy of the acclamation bestowed upon him by the Filipino people,” the resolution said.
In the present Congress, the House of Representatives also awarded its member, boxing icon and Sarangani Representative Manny Pacquiao, the same distinction.
On Wednesday, Malacañang welcomed the proposal for the Commission on Appointments to confirm Robredo as head of the Department of Interior and Local Government posthumously.
The Senate, however, is yet to study if a posthumous confirmation is possible as it has never been done before.
The posthumous confirmation was proposed by Alagad party-list Representative Rodante Marcoleta hours after Robredo’s body was retrieved three days after the crash.
Robredo was first appointed as acting secretary of DILG on July 19, 2010.
President Benigno Aquino III subsequently issued an ad interim appointment for Robredo from June 13, 2011 extended to October 13, 2011. It was again extended from December 15, 2011 to March 24, 2012, and June 7, 2012, said Lacierda.
