Homeowner to file suit vs Sta. Lucia Realty

MEXICO — A homeowner at Beverly Place here is set to file a P25-million suit against subdivision’s developer Sta. Lucia Realty Development Corporation for lapses in the Doctrine of Premises Liability Rule.
Beverly Place Homeowners Association legal counsel Edgardo Era over the weekend said the non-compliance of the developer on its obligations, particularly in securing the village with such essentials as the perimeter fence, has led to a series of robberies and killings of its residents.
Last year, a security guard and the brother-in-law of a British national residing in Beverly Place were killed by still unidentified suspects.
Five suspected robbers wearing bonnets robbed the home of Roy Thompson where the lone unnamed security guard at Phase 8 of the village was shot dead, along with the brother of Thompson’s Filipina wife. An estimated P100,000 worth of jewelry, cellular phones and cash were taken by the suspects.
In a meeting with the homeowners at the Beverly Place Clubhouse Sunday morning, Era said that Sta. Lucia Realty Development Corporation “continuously fails to protect the lives and properties of homeowners” as it signified in its contract with them, allegedly in violation of the Doctrine of Premises Liability Rule.
“The incident is already the fifth of its kind that transpired here in Beverly Place. During our investigation of the cases, we have discovered the lapses of the developer and Sta. Lucia Realty never even participated in the investigation conducted by authorities,” said Era, adding “the developer has done little to address the concerns of the residents on security, lighting and the much needed perimeter fence.”
Beverly Place Homeowners Association president Engr. Alan David told Sun.Star Pampanga that they are now awaiting the decision of the Housing Land Use and Regulatory Board, which has also been pursuing to get the response of Sta. Lucia on the case elevated to them by the homeowners.
“This is what we have been telling Sta. Lucia Realty all along. The Thompson robbery and the killing of two people is already the fifth case, after two frustrated homicides and the serious physical injury of a 73-year-old whose home was similarly burglarized,” David said.
“The developer has promised to complete the perimeter fence but nothing has happened. They also promised to beef up security by augmenting the guards watching over the 700-hectare village but it has done very little about these that homeowners here are constantly living in fear. And because of their non-compliance, the homeowners are compelled to sue and ask authorities to revoke or suspend its license,” said David.

8 robbers arrested in Angeles City

ANGELES CITY – Police authorities here on Saturday collared members of the notorious “Burnok Group,” allegedly involved in the series of robbery incidents in Central Luzon, in a rob try in Barangay Balibago.
The eight suspects were identified as Mark Anthony Elizalde alias “Jason”; Joshua Luntao alias “Buggy”; Solomon Diaz alias “Mon”; Abraham Desaca alias “Russel”; Cesar Baldonado; Cesar Baldonado Jr.; Jonas Alegria; and, Ronnie Morneo alias “Burnok,” believed to be the leader of the group.
The “Burnok Group” was also allegedly involved in gun-for-hire operations, according to police.
The group was neutralized by joint elements of the Criminal Investigation and Detection Group (CIDG)-Regional Office 3, Pampanga Criminal Investigation Team and Angeles City Police.
Recovered from the suspects were four firearms, two grenades, one rifle grenade, bladed weapons and several cellphones.
According to CIDG Director Chief Supt. Francisco Uyami the robbers were behind the double homicide case in Mariveles, Bataan last July 14, 2012 and in the frustrated homicide case of ABS-CBN technical director Crisologo Pangan last February 25, 2012.

Clark firm reorganizes key offices

CLARK FREEPORT–The Clark Development Corporation (CDC) is currently undergoing organizational restructuring, officials of the state-owned firm announced yesterday.
The intention of restructuring was to align the organization towards the thrust of the CDC, which is to further enhance the corporation’s performance in addressing the needs of both local and international investors and locators inside this Freeport.
What used to be five groups are now merged to three, namely Administration and Finance Group, headed by Vice President Noel F. Manankil; Business Development and Enhancement Group led by Officer-in-Charge Mariza O. Mandocdoc; and Operations Group under the management of Vice President Franco Alejo L. Madlangbayan.
The office of the Vice President for Legal Affairs, which has long been vacant, will now be filled with the appointment of Atty. Vitaliano Aguirre.
Other personnel movement included the following:
• Evangeline G. Tejada as Assistant Vice-President for Marketing;
• Perlita M. Sagmit concurrent as Corporate Secretary and Manager for Marketing Services;

4 in the hook for stolen fuel

CAMP OLIVAS, Pampanga–Four persons were arrested for illegally transporting and trading petroleum products in Limay, Bataan last Sunday.
Arrested were Joener Fabida, 36, driver; and truck helpers John Lee Delgado, Michael Cervantes and Rogelio Bolo.
Police said they received an information about an Isuzu tanker loaded with diesel illegally taken from a barge at Barangay Sisiman, Mariveles, Bataan.
The informant told police that the truck is engaged in illegal trading and transporting of petroleum without licence or authority from the government.
Police authorities immediately set up an “Oplan Sita” checkpoint along Roman Super Highway in Sitio Tundol, Barangay Reformista, Limay town.
At about 3 a.m., the truck driven by Fabida was flagged down but the driver refused to stop.
A hot pursuit ensued until, finally, the truck was intercepted along the Roman Super Highway by pursuing police personnel.
During the investigation, police learned that the tanker truck is registered to Marilou Aquino Valeriano of Katrina Village, Dona Francisca, Balanga City and owned by ELOMAR Trading.
Police said the truck was loaded with approximately 5,000 liters of diesel.
Police said the suspects could not present documents, such as permit to transport from the Bureau of Fire protection and licence to operate from the Department of Energy to sell or distribute petroleum products.
Police said another vehicle, which served as a security escort of the tanker, evaded the pursuing policemen.
The men in the other vehicle were later identified during investigation as Rodolfo Cuevas, Mandy Valeriano and Jayson Cortez, all residents of Limay, Bataan.
Also recovered from Fabida were bullets of a caliber .45 handgun.
Police said the suspect will be charged with violation to certain prohibited acts inimical to the public interest and petroleum products.

3 jailed for obstructing police arrest in Guagua

CAMP OLIVAS, Pampanga–Three persons were arrested when they tried to prevent police authorities in arresting a wanted man in Guagua, Pampanga on Saturday.
Arrested were Annabel Guinto, Rowel Guinto and Ramon Guinto, residents of Barangay Sto. Nino, Guagua, Pampanga.
Police said they were in a manhunt operation against Bernardo Guinto, 49, a resident of the same barangay and relative of the three arrested individuals, who has a pending case of violation of the Anti-Dangerous Drug Law.
Armed with a warrant of arrest, issued by Presiding Judge Jesusa Mylene Suba-Isip of Regional Trial Court Branch 49 of Guagua, the police were about to arrest Bernardo, who was spotted in the area when the arrested individuals intervened.
Police said the three attacked and assaulted arresting officers, PO1 Carding Unding Batoto, PO1 Romeo Latag and PO1 Romy Apiles while in the process of arresting the wanted man.
Police said the three suspects together with person with warrant of arrest were all arrested and brought to the Guagua Police Office for proper disposition.
Cases of obstruction of Justice and direct assault upon an agent or person in authority will be charged against Annabel Rowel and Ramon, police said. •Froilan E. Magtoto

2 teenagers nabbed for theft

CAMP OLIVAS, Pampanga–Two teenagers robbed the house of a police officer in the City of San Fernando over the weekend.
The suspects were identified as Collins Soriano, 18, and one 15-year old minor named only as “Mark.” Both suspects are residents of Sta. Monica Village in Barangay San Nicolas, City of San Fernando.
According to police investigation, the two entered the house of SPO1 Anna Victoria Gonzaga-Due, 35, of the same barangay by detaching the glass window when the house was left unattended at about 4 p.m.
The suspects took cash and jewelleries from the victim’s bedroom.
When Due arrived home she discovered that her money and jewelleries were missing.
After the discovery of the theft, the policewoman immediately inquired to her neighbors until she reached a sari-sari store.
Due accidentally got a clue when she learned from the store owner that two young men bought items in the amount of P250 from her store.
After learning about the two young men, they were immediately picked up for questioning.
During the investigation, Soriano and Mark admitted to the crime and surrendered the remaining cash loot in the amount P3,120.
Soriano was detained pending filing appropriate charges against him while Mark was turned over to the custody of the city social welfare and development since he is a minor. ●Froilan E. Magtoto

Comprehensive database of C. Luzon LGUs mulled

CITY OF SAN FERNANDO–Department of Interior and Local Government (DILG) has begun the initial planning stages for the establishment of a comprehensive database for all local government units (LGUs) in Central Luzon.
“This project is an initiative of the Regional Office. We seek to have a database that is not only limited to basic, socio-economic, environment, and administrative profiles of LGUs but other vital information as well that can be utilized in crafting a program or in providing technical assistance and other related services” DILG Regional Director Florida Dijan said.
Dijan added that a Technical Working Group has already been created that is chaired by Assistant Regional Director Abraham Pascua.
Per DILG data, Region 3 has a total of 7 provinces, 14 cities, 116 municipalities, and 3,102 barangays. ●

The Gay Phenomena

The whole neighborhood is full of them. They could be seen everywhere and I totally accede to their presence because I admire some gay people. I envy them actually. The fact that they could easily reveal their emotions without reservation is a very courageous act of being committed to yourself. Their feisty and fearless characteristics make them the governess of their own world. Whenever I am with gay persons, I see him/her with dreams and goals just like everyone else. Their sexual orientation and preference might be different from us and yet, as a human being, they are also prone to vulnerability. They cry when in pain and rejoice even in a slightest touch of success.
A world without gay people is a colorless place to live in. Their presence makes the society far more interesting and fascinating to deal with. Their proliferation signifies their total invasion in our society.
Gay men and women soar high in the entertainment industry. Some adopt a different course and manage to excel in their field of chosen careers. Rumor has it that even in politics, gay men and women are in total control of their constituents. Gay people have become world-famous fashion designers, make-up artists, journalists, photographers, doctors, engineers, and other enriching careers.
Gay men, lesbians, bisexuals and transgenders (LBGT) openly express their desire to be acknowledged, to gain absolute respect and they clamor to be treated equally. Many of us are not aware of their experiences and struggles in their lives and that is the logical reason of not condemning or discriminating them for their outlandish appearances.
Some gay people face total rejection from their families. Some gay people remain behind the curtain because of fear and embarrassment. Others are fortunate enough to be accepted and feel the love of their families.
I know a lot of gay people who made a mark in our society. Ricky Reyes aka “Mama Ricky” is a self made man, famous for his “Gandang Ricky Reyes” show which helps a lot of aspiring hairdressers and his philanthropic contribution to the society made him the mother of all.
Boy Abunda, the poor boy from Borongan, Eastern Samar, is a successful TV host and product endorser.
Danton Romero, a poet, published author and a professor in Ateneo de Manila. He is also a political activist fighting for the rights of the gay community.
Vice Ganda made a mark as an artist.
As for us ordinary people, we are attracted to their bizarre way of expressing themselves to the society. From the flamboyant cross dresser men to the conservative and manly dressed women, we find the enthrallment quite interesting and comical.
The phenomenal increase of gay people does not alarm me. I could not get enough of their lively shenanigans. I see a positive vibe. I feel relaxed and sometimes I unleash the gay persona inside of me when I am with them.

DENR to election bets: Spare trees

CITY OF SAN FERNANDO–Environment authorities here appealed to political parties and candidates in the May elections to mind their garbage and avoid nailing campaign materials on trees.
Maximo Dichoso, executive director of the regional Department of Environment and Natural Resources (DENR) in Central Luzon, said candidates should stick to environment-friendly campaigning to ensure clean and orderly elections in the coming polls.
He said well-meaning candidates and their supporters, even as they run on environmental platforms, should be mindful of the environment and resort to using recyclable and biodegradable campaign materials.
“The idea is to minimize garbage and to inflict as little damage on the environment and trees toward the end of the elections,” he said.
DENR Secretary Ramon Paje has earlier called on political candidates to put waste avoidance and reduction at the heart of their strategy to win, and to stick to earth-friendly campaign practices to ensure a waste-free election.
“Let us change the face of Philippine politics with clean elections defined not only by an intelligent electorate, but a trash-free one as well,” Paje said in a statement.
He also reiterated a long-standing appeal to spare the trees of campaign materials, saying trees are also living creatures that could get hurt or sick from infection, or die if left untreated for a long time.
Under Commission on Elections Resolution No. 6520, or the Implementing Rules of the Fair Election Act, common poster areas shall be allowed by the Election Officer only in public places such as plazas, markets, or barangay centers where posters may be readily seen or read.
Lawyer Lydia Pangilinan, Pampanga provincial election supervisor, has earlier warned that Comelec rules prohibit the posting of campaign materials on trees, schools, shrines, pedestrian overpasses and underpasses, flyovers, bridges, and islands of roads and highways, including waiting sheds, sidewalks, street and lamp posts, and electric posts, among other places.
Candidates of parties are also prohibited from sticking campaign materials on ambulances, patrol cars, and government vehicles, particularly those bearing red license plates.
Violation of these rules would constitute an election offense punishable under Sec. 264 of the Omnibus Election Code, she added.
