Prosecution hits Corona ‘media blitz’

MANILA (Updated 5:06 p.m.) — House prosecutors criticized impeached Chief Justice Renato Corona for resorting to “defense by publicity” after he accepted three separate interviews in a giant television network on Wednesday.
Corona made the rounds on broadcast channel GMA-7 barely a week before his defense lawyers are set to present their evidence and witnesses to the Senate impeachment court.
“As can be seen with the latest media blitz of Chief Justice Corona, the defense will maximize the media in trying to defend their client and shift public opinion,” Bayan Muna partylist Representative Neri Colmenares said in a text message.

Colmenares is the lead prosecutor of Article 7 of the impeachment complaint, which tackles Corona’s alleged partiality in the issuance of a temporary restraining order (TRO) in favor of former President Gloria Macapagal-Arroyo and her husband.Colmenares added that if the Chief Justice is “all too willing” to answer questions from the media, he should also take the witness stand in the impeachment court and answer the charges against him point by point.

In an interview with GMA News TV, Corona said he is willing to face the impeachment tribunal but the legal strategy would still depend on his lawyers. The defense panel is led by former Supreme Court associate justice Serafin Cuevas.

House Deputy Majority Leader Romero Frederico “Miro” Quimbo, one of the spokespersons for the prosecution team, said Corona’s interviews only show that he is facing damning evidence.

Corona is accused of betrayal of public trust and culpable violation of the Constitution on three grounds — non-disclosure of assets (Article 2); failing to show independence, integrity and probity for flip-flopping in final and executory cases (Article 3), and the issuance of a TRO in favor of the Arroyo couple (Article 7).

The 188 lawmaker-complainants in the impeachment complaint against the Supreme Court chief have called for the respondent to testify before the court.

House Minority Leader Danilo Suarez, a close ally of former President Arroyo, is also in favor of Corona being presented as a witness by the defense panel but cautioned that the senator-judges may also use their power to grill the Chief Justice.

“I’m not a lawyer but I think it would help (the defense) if he testifies. My only concern is the attitude of some senator-judges who will really grill him in the trial,” Suarez said.

If ever Corona and his lawyers decide to let him face the impeachment court, lead prosecutor Niel Tupas Jr. said the prosecution is prepared to conduct the cross-examination.

212 welcome 2012 with HIV

TWO hundred twelve people were found to have acquired the human immunodeficiency virus (HIV) in just the first month of 2012, according to the Department of Health (DOH).
Based on its January 2012 Philippine HIV and Aids Registry report, 203 males and nine females were found to have HIV cases.
“This was 39 percent higher compared to the same period last year, which was 152,” said the DOH report.
The report also noted that four of the 212 cases have already developed into full-blown acquired immune deficiency syndrome (Aids) along with one death.
Of the four, three had acquired the infection through homosexual contact, and one through mother-to-child transmission.
“Of the Aids cases, there was one reported death for the month: a seven-year old male,” said the report.
Sexual contact remains the most common mode of transmission after it accounted for 208 of the new HIV cases.
One hundred five got it from homosexual contact, 82 from bisexual contact, and 21 from heterosexual contact.
Three people also acquired the infection through injecting drug use while the other one was the lone death recorded this month after acquiring it from his mother.
Bulk of the new cases were found in the National Capital Region (NCR) with 123 or 58 percent followed by Calabarzon with 25 (12 percent); Central Luzon with 17 (eight percent); Davao Region with 15 (seven percent); and Western Visayas with 13 (six percent).
Overseas Filipino workers (OFWs) accounted for 32 of the new cases, including 30 males and two females.
All cases were acquired through sexual contact with 16 from bisexual, 12 homosexual, and four heterosexual.
Since 1984, there are now a total of 8,576 HIV cases recorded in the country with 975 developing into Aids cases, of which 342 have died. (AMN/Sunnex)

DTI-Bulacan warns ‘guerilla’ glass retailers

CITY OF MALOLOS, Bulacan – The Department of Trade and Industry (DTI)-Bulacan conducted recently a seminar on how to detect fake flat glass to warn consumers as reports cited that hundreds of “guerilla” glass retailers are operating in the province.

DTI-Bulacan director Rhine Aldana said many flat glasses which are used in making windows, doors and high-rise buildings are substandard and pose hazard to consumers especially to children.

“Many flat glasses are imported and there is no problem if they were, but if they are smuggled, the consumers will be left pitiful. They will just be surprised that their glasses will fall and children might be hit,” said Aldana in the seminar which was first conducted in Bulacan among Central Luzon provinces.

According to Virna Liza Villareal, press relations director of Flat Glass Alliance of the Philippines, Inc., there were reports that poor quality flat glasses in malls had fallen and injuries were cited.

Villareal said that they had apprehended fake retailers in Central Luzon and had sealed their products with the help of DTI.

“A glass cooked less is sensitive to temperature that it could break. They might have distortion in the surface, blemishes, thickness and low transmittance of light,” said Villareal.

A fake glass, she added, has defects like chipping, scratches, bubbles and stones.

Oscar Caluag, president of Bahay Bulacan Hardware Association, Inc., said hundreds of guerilla glass retailers or those who contract and install aluminum and glass at a cheaper price are difficult to apprehend.

He said the underground contractors could operate with the use only of “simple equipment” like screwdriver, glasscutter, saw and electric drill.

With this, Aldana said they would coordinate with local government units and monitor glass retailing shops which would be followed by inspection and confiscation operations when found culpable of selling substandard glasses.

“Legal vendors and consumers could contact DTI. We want to educate not only the retailers but the consumers,” said Aldana. (CLJD/JMG)

Poll watchdog seeks ban of Smartmatic in 2013 elections

A POLL watchdog has opposed the looming return of Smartmatic International in the 2013 midterm elections as technology partner of the Commission on Elections (Comelec).

In a letter sent to the Comelec Monday, the multi-sectoral organization Automated Election System Watch (AES Watch) said it would be best if the Venezuela-based firm would be totally out of the picture in next year’s exercise.

The group said Smartmatic, as the contracted technology provider in the May 2010 elections, “did not deliver the goods fully and well, and in fact disabled major security features in the system.”
It said the Smartmatic and its Filipino partner is far from proving it met the standard provision in Sec. 10 (12) of Republic Act (RA) 9369 with regard to demonstrated capability and “thus failed in meeting the mission-critical requirements for its entire claim of meeting the 99.9 percent accuracy target in the last elections.”
“The election technology provider in the May 2010 polls, Smartmatic-TIM (Total Information Management), should, therefore, no longer be an option and should be disqualified altogether from participating in the 2013 elections,” it added.

To note, the Comelec is reportedly looking to exercise its “option to purchase” agreement with Smartmatic of the Precinct Count Optical Scan (PCOS) machines used in the 2010 polls instead of holding a new bidding for either the lease or purchase of new ones.

Smartmatic, the service provider in the 2010 polls, has not been black listed by the Comelec despite its several boo-boos in the conduct of the presidential elections.

But according to AES Watch, the option to purchase Smartmatic’s PCOS machines is no longer available as its coverage has long expired.

It added that this is aside from the fact that the previous contract is no longer being honored after the firm also informed Comelec that there will be a 20 percent price increase.

“Based on the aforesaid facts, it is clear that the Smartmatic proposal is totally different from the terms and conditions under the original Option to Purchase stipulated in the Comelec-Smartmatic-TIM Corp. Contract. As such, it is a totally new contract proposal altogether and, if accepted by Comelec, will be a clear violation of the rules on procurement which require public bidding,” the group said.

Similarly, the poll watchdog said Smartmatic should not be allowed to participate in the event that a new bidding is held and subsequently disqualified.

It said the impaired the accuracy, security, and auditability of the May 2010 elections should be a ground for disqualifying the company.

“Incidents during the last automated election show the many faults in the system, not to mention acts inconsistent with good faith by Smartmatic, for which it should be blacklisted,” said the AES Watch.

They said that only through the elimination of Smartmatic can the country move forward with the change promised by the Aquino administration.

“The Comelec should open wide its doors to all other technology providers that can comply with the highest standards of transparency, accountability and Philippine laws as well as help provide the best suitable technology system at the most affordable cost to Filipino taxpayers,” said AES Watch.

State prosecutors bungle case vs Marcos, PCGG says

THE government is losing cases to fully recover the ill-gotten wealth of former President Ferdinand Marcos and his family due to the bungling of the prosecutors in the previous administrations, the Presidential Commission on Good Government (PCGG) said.

PCGG Chairman Andy Bautista made the admission after a recent ruling of the Supreme Court (SC) ordering the Commission and the Office of the Solicitor General (OSG) to conduct an investigation of the prosecutors assigned to go after the Marcoses and their dummies.
The order was contained in a resolution by the High Court ordering the reinstatement of Senator Ferdinand “Bong Bong” Marcos and his sisters, Irene Marcos-Araneta and Ilocos Norte Governor Imee Marcos as defendants in the P200 billion ill-gotten wealth case filed by the government in 1987.

The SC said the prosecutors handling the case disregarded procedures and failed to present available crucial evidence that could have proven the guilt or innocence of the Marcos siblings.

Bautista said they were surprised at the apparent bungling of the prosecutors from the previous administrations, adding the Commission would support any investigations against them.

Asked if there were orders coming from above for the prosecutors to do that, Bautista said he could not say for sure but he added the mistake is glaring, citing the recent SC order.
A study funded by the United States Agency for International Development (USAid) and conducted by the American Bar Association (ABA) released last year showed that there are still 84 cases pending before various courts.

Likewise, the study showed that live cases stay pending before the Sandiganbayan for an average of nine years while those appealed from the Ombudsman to the SC remain for at least six years.

It added that litigation at the anti-graft court usually takes 20 years.
But the study placed more of the blame on legal maneuverings by the defendants rather than the bungling of the prosecution.
Bautista’s immediate predecessor at the PCGG, Camilo Sabio pointed to the first Commission’s chairman, Jovito Salonga for the government’s failure to fully recover the Marcos ill-gotten wealth.

Sabio said that contrary to common knowledge, it was Salonga that should be blamed for the Commission’s failure to recover the ill-gotten wealth despite the powers at his disposal in the aftermath of the 1986 Edsa People Power uprising that toppled the Marcos dictatorship.

He said President Corazon “Cory” Aquino has dictatorial powers at that time that Salonga could have utilized to recover all documents, traced the ill-gotten wealth and recover it if he “had only the political will” to do so.

The former PCGG chief said this resulted in the succeeding administrations being blamed by the public for the failure to fully recover the ill-gotten wealth.

At the same time, he also said the Commission’s meager resources are hampering its efforts to recover the ill-gotten wealth which authorities said could reach as much as $3 trillion.

Roxas: LRT rehab project a go

MANILA — The bid to rehabilitate the 30-year-old Light Rail Transit (LRT) Line 1 is proceeding apace, the Department of Transportation and Communications (DOTC) said Monday.
Transportation Secretary Manuel Roxas II said the lowest bid is at P260 million or less than the P381 million budget of the project.
Roxas said the most extensive of the rehabilitation project is the replacement of train tracks from Baclaran, Paranaque to Roosevelt, Quezon City, a distance of about 23 kilometers.
He said the replacement of the train tracks is needed considering that some are suffering from corrosion due to long use.
But he added that even with the current state of the train tracks, the mass transit system is still very much safe for use explaining that safety and maintenance checks are rigorously done before they are allowed to ply their trade.
The second phase of the rehabilitation project involves the replacement of corroded gantry anchor bolts, which hold up the overhead cables that deliver power to run the trains.
Also part of the rehabilitation is the purchase of modified chassis that supports that train coaches, braking and other systems.
Overall, the projects for the rehabilitation of the entire LRT Line 1 costs about P1.06 billion.
Among the companies participating in the bidding were DM Consunji Philippines, Joratech Corporation, Jorgman Development and Planning Corporation, Pilipinas Hino Incorporated and Miescorrail Inc.
Miescorrail is a subsidiary of Manila Electric Company, which is controlled by telecommunication czar Manuel Pangilinan.

PRC medicine board rejects ‘periodic’ tests for doctors

AN OFFICIAL of the Professional Regulation Commission (PRC) opposed the proposal to have a periodic testing for medical practitioners in order to gauge their competence amid the changing medical practices.
In an interview at the sidelines of the Interscholastic Medical Debate Competition (IMDC) in the University of the Philippines (UP) Manila, Board of Medicine Chairman Dr. Jose Cueto said they do not believe that resorting to a periodic testing is the best way to gauge the competitiveness of the doctors.
“There is obviously a need for evaluation but not necessarily an examination because in an examination, you may be able to answer that correctly but sa amin, what we need to do is protect the patients more,” said Cueto.

He said it would be better if the evaluation will just be through practice evaluation, which means medical doctors will be evaluated based on how they actually perform in their clinics or hospitals.

“If you listen to the Continuing Medical Education (CME) sessions, how can we know if you learn something? The best way is still through practice-based. Meaning, six months after you attended the CME session, we will evaluate how you are practicing. Has there been a change? Example, what is the latest management of a certain disease based on what you got from the session, when you go back to your place, can you apply what you learned from the CME? If you are not applying the CME, what’s the use of the CME?” Cueto said.

To note, medical practitioners licensed by the PRC are required to attend CMEs organized by different organizations in a bid to update the medical practices as suggested by newly established medical standards.

CMEs are normally organized annually or semi-annually by the different medical associations or organizations.

The suggestion for periodic examinations for medical practitioners was one of the points raised during the IMDC organized by the UP College of Medicine and the Philippine Health Insurance Corporation (PhilHealth).

The suggestion opined that there is a need for the periodic examinations in order to gauge whether medical doctors really use their CMEs to update themselves of medical practice or not.

Cueto admitted there are indeed some medical practitioners that don’t really attend the learning sessions despite registering for them.

“Many practitioners are registering then going out and just getting their certificates of attendance. We will have to address what learning they have acquired from the sessions. Because this is supposed to be continuing medical education. This is supposed to be updating your knowledge and skills,” said Cueto.

Meanwhile, UP College of Medicine Social Medicine Unit Chairman Dr. Alvin Caballes said they organized the inter-school debate in order to highlight the need for more socially conscious medical doctors in the country.

“We want to have a new generation of doctors that are not just good in issuing prescription to patients,” said Caballes in a separate interview.

Among the participants in the one-day event held at the Buenafe Auditorium are the Ateneo School of Medicine and Public Health, Emilio Aquinaldo College School of Medicine, University of Perpetual Health Rizal Jonelta Foundation School of Medicine, and UP Manila College of Medicine.

Palace downplays coup rumors

MANILA — Malacañang shrugged off on Tuesday the coup rumors against President Benigno Aquino III.
Presidential Spokesperson Edwin Lacierda, in a news briefing, believe that the Armed Forces of the Philippines (AFP) is a professional organization and the administration has been addressing the concerns and welfare of the military as well as the police personnel.
“We are not bothered by any rumors of a coup. It will abide by the commander-in-chief,” he said, citing that the AFP leadership has already issued a statement denying the rumors.
He added that those coup rumors could just be “noise.”
“How can it be successful—assuming, for the sake of argument, if there is one—when the President has launched his several programs for the benefit of the soldiers and the policemen?,” he said.
He cited the housing programs that the government has been implementing for the men in uniform, as well as the increased combat pay and essential equipment for them.
“So all these programs necessary to ensure the benefits of those who are protecting and serving us are being ensured by the President in his various programs towards the AFP and the PNP (Philippine National Police),” he said.
Senator Antonio Trillanes IV has raised the issue on coup attempt against Aquino.
He has said that some retired military officers were trying to recruit the active military personnel to oust the President.
But he said the move to recruit failed.
“The retired military officers have forgotten that this is already a professional organization. This is no longer the organization that they were used to,” he said.
Lacierda, however, said that Malacanang will not ask Trillanes to shut up.
“We will leave it with him to speak about these things. As a senator, we cannot impose on the good senator,” he said.
