THE Supreme Court (SC) will hold oral arguments on the motions that sought the reversal of its landmark decision last year that redefined the term “capital” in the constitutional provision, which limits to 40 percent the foreign ownership of public utilities.

Court administrator and spokesman Jose Midas Marquez said the oral arguments will be held at 2 p.m. of April 17 in Baguio City, where magistrates regularly hold their summer sessions.

The hearing was in connection with the June 28, 2011 en banc decision that granted the petition filed by lawyer Wilson Gamboa, who sought to annul the sale of the government-acquired 111,415 Philippine Telecommunications Investment Corporation (PTIC) shares in the Philippine Long Distance Telephone Co. (PLDT) to the Hong Kong-based First Pacific Co. Ltd. in the amount of P25.2 billion.

Gamboa, a stockholder of PLDT, said in his petition that the sale of PTIC shares to First Pacific violates the constitutional limitation on foreign ownership of a public utility.

The SC, through the ponencia of Associate Justice Antonio Carpio, claimed the term “capital” in a public utility corporation refers only to shares of stocks entitled to vote in the election of directors or the so-called “common shares,” and not to the total outstanding capital stocks composed of “common” or voting shares and “preferred” or non-voting shares.

It then directed the Securities and Exchange Commission (SEC), one of the parties in the case, “to apply this definition of the term ‘capital’ in determining the extent of allowable foreign ownership in respondent PLDT and if there is violation of Section 11, Article XII of the Constitution, to impose appropriate sanctions under the law.”

The Court further ordered SEC to look “only to common shares, and not to the total outstanding, capital stock” in the case of PLDT.

PLDT chair Manuel Pangilinan, its president Napoleon Nazareno, the Philippine Stock Exchange (PSE), and the SEC have since filed separate motions asking the Court to abandon its June 28 ruling.

Pangilinan warned of “a very serious adverse repercussions on the country’s economy if the ruling will not be reversed.”
PSE also echoed the businessman’s sentiments, saying the country’s economy stands to lose more than P630 billion in allowable foreign investments in PSE-listed shares or equivalent to a loss of nine percent of the current total fair market value of the PSE-listed shares if the decision is implemented.

Earlier, Chief Justice Renato Corona claimed the Court’s ruling is “purely legal,” as he admitted that the Court did not consider the economic implications of its ruling on the PLDT case as none of the parties raised the same in their pleadings.

Corona said it was only after the Court released its ruling on the PLDT case that concerned parties have come forward to warn about its possible economic repercussions.

Corona was among those who dissented from the majority decision penned by Carpio.

THE Metropolitan Manila Development Authority (MMDA) said Tuesday that Metro Manila can be at par with progressive metropolis in East Asia in the coming years with an environment that is more conducive for investors, entrepreneurs, and innovators and more livable for its residents.

MMDA Chairman Francis Tolentino said a framework dubbed “Metro Manila Green Print 2030”, which was formally launched Tuesday, would bring such dream into fruition, though he added this can be only achieved if the 17 local government units (LGU) in the metropolis would think beyond their boundaries.
“It’s a long process but Green Print 2030 is one big step towards this direction,” Tolentino said during the program’s launch at Edsa Shangri-La hotel in Mandaluyong City.

According to Tolentino, the program will develop a common vision for Metro Manila’s future, propose institutional reforms to improve coordination among key players and provide spatial strategy that will guide the urban form of the metropolis, primary infrastructure, green system and the clustering of economic activities to improve livability.

The program will also identify key factors that will contribute to Metro Manila’s improvement as an urban system. These factors include economic clustering, neighborhood scale development, overall physical structure, and transportation access, which the MMDA believes will unleash Metro Manila’s considerable latent economic potential and human talent.

“Of special considerations are factors including climate change, the increasing vulnerability of the metropolis to natural disasters, rising demand for affordable housing close to places of work and livelihood,” the official said.

Tolentino said the World Bank (WB) will give $200,000 in initial funding for the conduct of the study with technical support coming from the Australian Agency for International Development (AUsAID) and urban poverty reduction advocate Cities Alliance.

The program will incorporate an earlier study crafted in 1999 which the MMDA said is in need of revision in view of the significant changes in the economic, social and environmental conditions in the metropolis.

The Green Print according to the agency will also complement the NCR Regional Development Plan 2011-2016, the Metro Ko, Metro Love Ko’ urban renewal program, the Metro Manila Re-Greening Program, the Metro Manila Open Spaces Program (MOSS) and other similar projects.

The MOSS program is designed to provide Metro residents to enjoy urban living side-by-side with gardens and parks to serve as “environmental sinks” and recreational areas.

Tolentino said providing residents with such “green” amenities will result in a higher standard of living as envisioned in the Green Print but so far only nine LGUs (Caloocan, Makati, Manila, Marikina, Muntinlupa, Navotas, Pateros, Taguig and Las Pinas) have submitted their proposed open spaces for the program.

For his part, WB Country Director Motoo Konishi said Greenprint 2030 fits well in the institution’s broader commitment to help address urban development challenges in the Philippines.

“Our role in this endeavor is to help facilitate the conversation among key stakeholders to achieve a common vision for Metro Manila as well as bring in international experience and expertise from where this kind of planning process has worked very well,” Konishi said.
“This process will require the active support and participation of the private sector, civil society and the academe to ensure success. And the success of Metro Manila Greenprint 2030 in addressing key challenges will unlock the growth potentials of the entire country,” he added.

MANILA — The House leadership is determined to finish debates on the highly divisive reproductive health (RH) bill before it goes on Lenten break at the end of the month.
Majority Leader Neptali “Boyet” Gonzales II said the voting on the termination of debates will be a “test vote” on the RH bill, now pending for second reading approval in the House of Representatives.
“You cannot make the RH bill suspended in animation,” Gonzales said Tuesday.
Congress will go on a six-week break starting May 24 to May 6. Plenary sessions will resume May 7.
“If the termination of debate will win, then the bill has hope,” Gonzales added.
Plenary debates on the RH bill started March last year. The controversial measure was first filed in the eighth Congress (1987-1992).
Less than 20 House members are still lined up for debate.

ANGELES CITY – A multi-sectoral group asks Malacañang to replace Clark International Airport Corporation (CIAC) president Victor Jose Luciano instead of pushing for the retention of the name of the Diosdado Macapagal International Airport (DMIA).
The Angeles City Multi-Sector Consultative Council (ACMSCC) in a manifesto denounced the move to rename the airport. It also requested President Benigno Aquino III to remove Luciano from his post as CIAC head.
According to the group, Luciano is being insensitive to the feelings of the Kapampangans and the Filipinos, who respect and hold high regards to the legacy of the late President Diosdado Pangan Macapagal.
In their manifesto, the group appealed to President Aquino not to be swayed by the proposals of Luciano.
“Rather than changing the name of the airport, the president should definitely consider replacing Luciano himself,” the group said.
“Ang panukalang ibalik sa Clark International Airport ang pangalan ng DMIA ay produkto ng sagad-sagarang kaisipang kolonyal (The move to restore the name Clark International Airport from DMIA is a product of colonial mentality) ,” Bhot Mangulabnan, a spokesperson of the group, said.
The group added that Clark Air Base is a former military installation of the United States, which became a symbol of incursion and American supremacy here in the Philippines and in Asia.
Covering 2,500 hectares, the Clark Aviation Complex used to be the central facility in the Clark Air Base of the United States Air Force until 1991 when the Senate ordered all US military bases in the Philippines closed and American troops pulled out.
Clark Air Base was named in honor of Major Harold Clark of the US Army Signal Corps who died in a seaplane crash in Panama Canal in 1919. In honor of this aviation pioneer, the American government changed the name of Fort Stotsenberg into Clark.
“Napalayas na natin ang mga Kano, kaya walang dahilan na panatilihin pa natin ang pangalang Clark hindi lamang sa airport, kundi sa buong lugar na ngayon ay ginawa na nating isang malayang kalakalan o Freeport zone (We have sent the Americans out, that is why there is no reason to keep the name Clark not just for the airport and for the place as well which is now a Freeport zone),” the group stressed.
At the same time, the multi-sectoral group said they will also conduct protest rallies and mass actions to prevent Luciano from implementing the CIAC board resolution renaming DMIA to CIA.
The CIAC board during its 10th special meeting on October 14, 2011 approved the resolution restoring the name of CIA.
The resolution states that it will restore the name “Clark International Airport” to refer to the Clark Civil Aviation Complex within the Clark Freeport Zone to enhance its international acceptance and to preserve its historical significance.
CIAC however clarified that it did not drop Macapagal’s name in the airport, noting that the Terminal 1 will be named as Diosdado Macapagal Terminal (DMT) to recognize the legacy of former President Diosdado P. Macapagal as the first Kapampangan to become the President of the Republic of the Philippines.
Clark International Airport was renamed to DMIA in July 2001 through a board resolution in honor of the late President Macapagal.

MANILA — President Benigno Aquino III led on Tuesday the ringing of bell in the Philippine Stock Exchange (PSE) in Makati City to formally open the stock trading after the local bourse closed at a historic high of 5,030.80 points on Monday.
The President was joined in expressing the nation’s exuberance during the event by Finance Secretary Cesar Purisima, PSE chairman Jose Pardo and PSE director Eusebio Tanco.
In his welcome remarks, Pardo said this robust performance of the Philippine Stock Exchange index (PSEi), the barometer of the country’s economic health, was a direct result of the optimism the country’s investors see and feel about the Philippines under the current administration.
“This historic rise of the index is a strong testament to the growing investor interest in the Philippines, the continued strengthening of our macro-economic fundamentals, positive outlook on the growth of our listed companies and more importantly, confidence in the administration’s good governance drive, among others, have been catching the attention of investors in both local and global markets,” Pardo said.
He added that since Aquino took over the reins of government in 2010, the PSEi’s historic rise “marks the 11th time this year and the 19th time under the present administration that the index has set new highs.”
“Since the first day of the President’s administration or in a matter of only 20 months, this index has already climbed by 52 percent,” Pardo said.
He vowed to work towards inviting more investors to invest in the Philippines in order to improve the index’s performance to breach the 6,000 point mark.
“Moving past the 5,000 (mark) signals the beginning of our journey to what I understand, Mr. President, was your requested commitment from our (PSE) Director (Eusebio) Eusi Tanco for the index to breach, not the 5,000 (mark) but the 6,000 level,” Pardo said.
