Renaming of airport an insult to Kapampangans

CLARK FREEPORT, Pampanga — Members of the Clark Development Corporation (CIAC) board should apologize to Kapampangans for renaming the Diosdado Macapagal International Airport (DMIA), a former Clark official said.
Alex Cauguiran, former CIAC vice president for operations, lambasted the board, including CIAC president Victor Luciano and Clark Development Corporation (CDC) president Felipe Antonio Remollo, for approving a resolution renaming DMIA to Clark International Airport (CIA).
The CIAC board during its 10th special meeting on October 14, 2011 approved the resolution restoring the name of CIA.
The resolution states that it will restore the name “Clark International Airport” to refer to the Clark Civil Aviation Complex within the Clark Freeport Zone to enhance its international acceptance and to preserve its historical significance.
CIAC clarified, however, that it did not drop Macapagal’s name in the airport, noting that the Terminal 1 will be named as Diosdado Macapagal Terminal (DMT) to recognize the legacy of former President Diosdado P. Macapagal as the first Kapampangan to become the President of the Republic of the Philippines.
Clark International Airport was renamed to DMIA in July 2001 through a board resolution in honor of the late President Macapagal.
Cauguiran said the CIAC board resolution is deceptive and defective.
“[All members] of the CIAC board are all accountable for their action, I think for not making a thorough research before they approved the resolution [renaming the airport],” Cauguiran said.
He said legalities and guidelines were not studied well, and how the Kapampangans would react to the collective action was also not considered.
“Status quo (DMIA) should be maintained for now. CIAC should make public apology to the Kapampangans,” he added.
Cauguiran also stressed a guideline of the National Historical Commission of the Philippines that prohibits the renaming of the airport if it is already named after a former President.
“The tourists and investors will not come here because we have a good name. In the first place, who is Harold Clark as compared to former President Diosdado Macapagal? They will come here because the labor is cheap, the place is secured, and people are kind,” Cauguiran told Luciano.
Some members of the Pampanga Mayors’ League (PML) also said the initiative to rename the airport is an insult to the intellect and dignity of the Kapampangans.
“Isang kabastusan at pagyurak sa dignidad ng mga Kapampangan ang alisin ang pangalan ng dating Pangulong Diosdado sa ating airport kapalit ng pangalan ng isang dayuhan (It’s an insult to the dignity of Kapampangans to remove the name of former President Diosdado Macapagal in exchange for a name of a foreigner),” PML president Jerry Pelayo said.
Pelayo also questioned the loyalty of Luciano to the Kapampangans, after the latter openly admitted that he favors the renaming of the airport.
Cauguiran, now the chief of staff of Angeles City Mayor Edgardo Pamintuan, also criticized a story of Sun.Star Pampanga, saying it did not reflect what really transpired during the dialogue on the airport renaming where Pampanga mayors echoed their strong objection against the CIAC resolution.
“It (story) focused on Ping Remollo’s role. Luciano, I think, is even portrayed here na parang hindi accountable sa ginawa nila. Him, being president of CIAC should know better,” Cauguiran said.
Luciano is the one peddling CIAC justifications on DMIA renaming in his press releases, said Cauguiran.
“Luciano even admitted that their board action overlooked the points raised by the mayors. In other words, admitting CIAC board’s mistakes. Luciano, Remollo, et al should all be made accountable,” Cauguiran said.
Luciano met with the local officials led by Pampanga Mayors’ League President Jerry Pelayo last Friday here.
The mayors informed Luciano that majority of their constituents are opposed to the renaming of DMIA.
Luciano also vowed to relay to the CIAC board the sentiments of the Pampanga mayors who are objecting the renaming of the airport.
Various groups in Pampanga reportedly threatened to stage mass actions if CIAC would implement the resolution.
Angeles City Councilor Willie Rivera, meanwhile, said he will file a resolution in the City Council declaring Clark officials persona non grata if they implement the renaming of the airport to CIA.
Meanwhile, Bacolor Mayor Jomar Hizon told Luciano to reconsider their decision as it could set a precedent in the future.
“Baka magpapalit-palit ang pangalan ng airport tuwing nagbabago ang administrasyon (Renaming of airport might happen as administration changes),” Hizon said. (Sun.Star Pampanga/Sunnex)

Corona may not be able to testify in his own trial

MANILA — The defense panel may think twice of bringing Chief Justice Renato Corona to the witness stand in his impeachment trial after the Supreme Court maintained that confidential information should not be disclosed by magistrates, court officers and employees.
In a resolution, the Supreme Court said “it cannot waive the privilege that belongs to the Court as an institution, not to any individual Justice, official or employee who may disclose these documents without the Court’s authority.”
“It is this sense that dictated the issuance of this Resolution, as well as the Court’s intense desire to fully be mindful and compliant with the separation of powers that the Constitution mandates for the three branches of government — the Executive, the Legislative and the Judiciary,” the five-page resolution read.
Corona’s lawyers, however, believe that their client can choose to defend himself before the senator-judges and his accusers from the House of Representatives.
“He is the one charged [with] an impeachable offense, hence, due process requires that he be heard if he feels he needs to testify,” defense spokesperson Tranquil Salvador III told Sun.Star.
Lawyer Ramon Esguerra echoed Salvador’s statement, saying Corona “should not be denied the right to defend himself.”
Lead defense counsel Serafin Cuevas said in a television interview last week that Corona should not testify since he could be subjected to grilling by the senators and objections will easily be thrown out.
“I believe this is not good because the members of the impeachment court can examine him on all angles and Justice Cuevas cannot object,” he said.
Earlier, the Court said in its February 14 resolution that the House prosecution panel cannot look into the records of pending cases that cast doubt on the impartiality and integrity of Corona.
Specifically, the Internal Rules of the Supreme Court prohibits the disclosure of the result of the raffle of cases, actions taken by the Court on each case included in the agenda of the en banc session and deliberations on pending cases and administrative matters.
Exempted from the guidelines, meanwhile, are cases and matters classified as public record such as the official appointment of Corona as Chief Justice in May 2010, and the resolution that allowed former President Gloria Macapagal-Arroyo to leave abroad despite being placed under the government watchlist.
“The judicial privilege in the February 14, 2012 SC resolution refers to the internal deliberations and workings of the Court. I believe that the prohibition does not cover the CJ in this case,” Esguerra said in a text message.
Clerk of Court Enriquetta Vidal admitted that she failed to strictly follow the Court’s February 14 resolution after she furnished the Senate impeachment court with documents such as the logbook showing the date and time of Justice Lourdes Sereno’s dissent on the travel clearance given to Arroyo.
While this is considered confidential, Vidal said the document was submitted even before the Court released the guidelines.
Sereno’s dissenting opinion alleged that certain infirmities or irregularities attended the issuance of the temporary restraining order, such as the fact that it was implemented despite the failure of Arroyo to comply with all the conditions before the order could be fully effective. Manila orders probe into property of Corona wife’s family

THE Manila City Government has ordered an investigation on the supposed expropriation of the 1,020.7-square-meter property of the Basa-Guidote Enterprise Inc. in Sampaloc, Manila entered by former mayor Lito Atienza with Cristina Corona, wife of Chief Justice Renato Corona.
Talks about the expropriation of the BGEI property, located along Legarda street and covered by Transfer of Certificate of Title (TCT) no. 76220, was approved by the City Government in a letter to BGEI in January 2000 to pave the way for the relocation of stallholders of the old and new Sampaloc markets who were displaced by the construction of the Metro Rail Transit Line 2.
The City Hall had made a last and final offer to buy the property at the price of P34,000 per square meter.
The agreement was finalized through a Deed of Absolute Sale dated March 26, 2011, signed by Atienza, Cristina, former secretary to the Mayor Emmanuel Sison, and former city legal officer Melchor Monsod.
However, in a two-page letter dated March 1, 2002, City Legal Officer Renato dela Cruz said the title to the property has not been transferred to the city’s name, as no record including TCT no. 76220 on file with the Register of Deeds would show any transfer.
Dela Cruz wanted to know the answers to the following questions: “Which department is in possession of the original deed of sale and to which department was the owner’s duplicate copy of the TCT surrendered? Was the title transferred to the city? If so, where is the new title? If not, why was the title not transferred?”
If the property has not been transferred to the City Government, dela Cruz said that capital gains tax should have been filed by the company, but the Bureau of Internal Revenue should have possession of the official receipt for such payment.
“We, therefore, request that efforts be exerted to determine what transpired after the execution of the deed and to locate the original copy of the deed, owner’s duplicate copy of TCT 76220, official receipt of payment of capital gains tax and other information relative thereto,” he said.
The letter was addressed to the heads of the City General Services Office, Office of the City Treasurer, Market Administrator and the City Engineer’s Office, copy of which was furnished to Manila Mayor Alfredo Lim.
Dela Cruz further warned that those who failed to comply with the City Hall’s directive may be charged with violation of Republic Act 3019 (anti-graft law) and gross neglect of duty.
According to de La Cruz, the investigation was ordered by Lim upon learning that the title of the BGEI lot had not been transferred to the city despite the payment it made worth more than P34 million over a decade ago.
He said the mayor wanted to find out whether the supposed deed had actually been executed, especially since the BGEI property has been dragged in the impeachment trial of Chief Justice Corona in the Senate.
Lim also noted that the property remained to be under the name of BGEI despite the full payment made by the City Government for the purchase of said property.
If there were violations in the execution of the deed of sale, dela Cruz said the city may file appropriate legal actions against Mrs. Corona and certain city officials involved in the sale of the property.
House prosecutors earlier made an issue of the BGEI property, alleging before the Senate impeachment court that the Chief Justice could not have received an P11-million cash advance from BGEI, a company owned by his wife’s family, in 2003 because its certificate of registration was revoked that same year.
Last February 16, a Philippine Savings Bank official testified in the Senate that Corona, through his wife, closed three accounts — whose opening balances totaled P32.6 million — on December 12, 2011, the same day House lawmakers filed the impeachment complaint against him.
Sought for comment, defense lawyer and spokesman lawyer Ramon Esguerra said the money in the Corona bank accounts was held in trust by BGEI, but that “the money is still intact.”
“Mrs. Corona received it in trust for the corporation. The check says so. She appears to be the administratrix of the estate of the Basa matriarch, and the city government paid the check to her in that capacity,” he said.
Esguerra said that while the defense panel has not officially considered adding Atienza in its list of witnesses, the lawyers have decided on presenting as witness the records custodian of the Manila City Hall, for whom they will ask the impeachment court to issue a subpoena duces tecum.
“In our list is the records custodian of the city of Manila simply to produce certified true copies of pertinent documents on the expropriation of BGEI property where the Sampaloc market is presently located. The check evidencing payment of the compensation is certainly relevant vis-a-vis the cash advances made from that fund by the couple Chief Justice and Mrs. Corona,” he said in a text message. Senate may admit bank records as evidence

THE Senate is inclined to admit evidence that the House prosecution has offered against Chief Justice Renato Corona, including details of bank accounts that his lawyers want stricken off the record, a senator said Monday.
Senator Panfilo Lacson said the general sentiment in the Senate is to admit as much evidence as the prosecution has marked and offered that they can, “and we will leave it to the defense panel to answer point by point all issues and pieces of evidence presented so far.”
He made clear, however, that that is still subject to discussion.
“That sentiment can change depending on jurisprudence,” he said.
The defense panel has asked the Senate to remove from the record evidence on Corona’s bank accounts at Philippine Savings Bank (PSBank) that the lawyers said the prosecution obtained through illegal means.
The prosecution has said photocopies it attached to a supplementary request for subpoena were from an anonymous source. Prosecutors also said on the request that they could not vouch for the authenticity of the photocopies.
Defense lawyers said details of the bank accounts should be disallowed since the photocopies on which the Senate based its subpoena violate bank secrecy laws.
Senator Antonio Trillanes IV, meanwhile, said the admissibility of the bank details as evidence should not be debated anymore.
“(Admitting) that should be automatic already,” he said. “The entire country has seen the bank accounts by now, he (Corona) should just explain.”
The bank records were presented in connection with Article 2 of the impeachment complaint against Corona. Prosecutors said Corona did not declare money in the accounts on his Statements of Assets, Liabilities, and Net Worth.
The Senate committee on banks has been holding a separate investigation on whether Corona’s bank records were leaked, or whether the documents submitted by the prosecution are fake.
“Of course, that will be relevant to the discussion to determine whether we will admit that as evidence,” Lacson said. He stressed, however, that it has yet to be proven whether PSBank or the Bangko Sentral ng Pilipinas was the source of the leak.
PSBank has said the photocopies from the prosecution were fake. The BSP, meanwhile, has denied touching Corona’s records.
One BSP examiner, Jerry Leal, is facing a contempt citation at the Senate for supposedly lying about having access to Corona’s records but has been given time to explain himself. (Jonathan de Santos/Sunnex)

High Court asked: Allow partial execution of land to farmers

A GROUP of Hacienda Luisita farmers asked the Supreme Court (SC) Monday to allow a partial execution of its November 2011 decision ordering the distribution of the 4,915.75-hectare sugar land estate of the Cojuangco family in Tarlac.

In a three-page motion, the farmers led by Noel Mallari said the execution of the land distribution despite the pendency of the motion for reconsideration filed by petitioner Hacienda Luisita Inc. (HLI) should be ordered considering that the issue on distribution was no longer being contested by HLI.
Mallari is the leader of a breakaway group of the bigger farmworker and beneficiaries (FWBs) called Alyansa ng mga Manggagawang Bukid ng Hacienda Luisita (Ambala), which has been regularly staging activities in front of the SC building to call of the High Court to already rule with finality on their case by dismissing HLI’s appeal.

Joining Mallari in his motion were 17 other FWBs. The farmers, however, filed their motion without the concurrence of a lawyer.
He said in their motion that HLI only raised issues on just compensation and stock distribution option for FWBs in their motion for clarification and partial reconsideration; thus, there should be no more legal impediment for awarding of land to FWBs who are no longer interested in the SDO.

“Apropos of the foregoing disquisition, the matter with respect to the placement or acquisition of the subject land under the Carp (Comprehensive Agrarian Reform Program) through the compulsory or mandated land acquisition scheme is no longer a bone of contention so to say,” the group said.

“Absent any question about the acquisition and redistribution of the land under the Carp, the matter is therefore deemed resolved and it can now be considered executory,” it added.

Mallari said the SC may use its power to order partial execution of its orders under Section 2 (b), Rule 39 of the Rules of Court despite pendency of other issues raised in the appeal filed by HLI.

In its November 22 resolution, the Court affirmed its July 5 decision that the just compensation for HLI’s agricultural land that will be transferred for land distribution to the farmer-beneficiaries should be computed based on the valuation of the land in 1989, when the Presidential Agrarian Reform Committee (PARC) approved its SDP.

The Court said when PARC approved HLI’s SDP, it was only the time that farmer-beneficiaries were considered to own and possess the agricultural lands in Hacienda Luisita.

The justices also unanimously agreed that the contested land should be distributed by HLI to the original 6,296 farmer-beneficiaries pursuant to an order of the PARC in December 2005. The court likewise directed HLI to pay the original FWBs with over P1.33 billion it earned from selling the 500-hectare converted portion of the land estate. (ECV/Sunnex)

State commission opposes Allied Bank-PNB merger

THE Presidential Commission on Good Government (PCGG) said it will pull all stops to prevent the merger of Allied Bank with the Philippine National Bank (PNB), saying the move could jeopardize the government’s stake at the private bank.
PCGG Commissioner for Legal Affairs Gerard Mosquera said the commission has asked the Securities and Exchange Commission (SEC) and the Bangko Sentral Pilipinas (BSP) to do everything to prevent the merger.
In a letter to SEC chair, Teresita J. Herbosa and BSP Governor Amado Tetangco, Mosquera said the commission’s opposition to the proposed merger of the two banks is anchored on the following grounds: non-compliance with Section 77 of the Corporation Code, violation of Section 2 of Executive Order 2 series of 1986, and absence of specific approval from the Sandiganbayan.
Mosquera said Section 77 of the code provided that the merger should have approval by majority vote of the Board of Directors or Trustees of the corporation, which should be submitted for approval by the respective stockholders or members of the said corporations
The same law mandated that notice, either personally or by registered mail, shall be given to all stockholders for the said purpose two weeks prior to the date of the meeting.
The affirmative vote of stockholders representing at least two thirds of the outstanding capital stock of each corporation is needed for the approval of the merger while Section 2 of EO 2, “prohibits any person from transferring, conveying, encumbering or otherwise depleting or concealing such assets” that are the subject of litigation.
The PCGG official expressed belief that the absence of specific approval from Sandiganbayan, on the other hand, “will compromise the ability of the GRP (government of the Republic of the Philippines) to recover the subject Allied shares and will constitute a deprivation of the GRP’s right to property without due process of law.”
“The shares of stock owned by Mr. Lucio Tan and other principal stockholders of Allied Bank are presently under litigation and are the subject matter of an action for reconveyance pending before the Sandiganbayan,” Mosquera’s letter read.
“The PCGG is seeking the recovery of the shares of stock in Allied Bank on the ground that this is part of the ill-gotten wealth (of the late dictator, former President Ferdinand Marcos which was acquired through Lucio Tan when he acquired General now known as Allied Bank),” Mosquera said.
“To allow the merger involving shares which are under litigation is not only un-procedural, it infringes upon the substantive right of the GRP to recover ill gotten wealth,” he said.
He stressed that “at the very least, the merger should be held in abeyance until judgment in Civil Case 005 is rendered and attains finality.”
Allied Bank is about 75 percent controlled by Tan. He also controlled about 67 percent of PNB, which has a total assets of P240 billion.
The official admitted that the government would have a hard time recovering its Allied shares if the merger is allowed since the PNB, if the latter is the surviving entity, could argued that it was not the subject of a pending case.
At the same time, he said no government representative has ever sat on the board of Allied Bank.

CA upholds Palace termination of Arroyo ‘midnight deal’

THE Court of Appeals (CA) has upheld a decision of Malacañang to annul the “midnight deal” between the Arroyo administration and a nickel mining consortium in Palawan over allegations of violations of several mining laws in three mining sites in the province.

In a 12-page decision penned by Associate Justice Samuel Gaerlan, the CA’s Fifth Division denied the petition filed by Narra Nickel Mining and Development Corporation, Tesoro Mining and Development and McArthur Mining Inc., seeking a reversal of the resolution rendered by the Office of the President on July 6, 2011.

The consortium had been granted a Financial or Technical Assistance Agreement (FTAA) to operate large-scale exploration, development and utilization of minerals in the towns of Rizal, Bataraz and Narra in Palawan.

President Benigno Aquino III cancelled the mining firms’ FTAA based on the complaint filed by another mining firm, Redmont Consolidated Mining Corporation, which alleged that the recommendation and approval of the FTAA in favor of the petitioners were done with grave abuse of discretion.

Redmont said there were violations of the mining law, its rules and regulations, as well as other applicable laws connected with the conversion of petitioners’ mineral production and sharing agreement (MPSA) and exploration permit applications filed in 1991 and 2001, respectively, to FTAA applications in 2007.

But according to the CA, the petitioners failed to substantiate its claim that the Office of the President committed grave abuse of discretion in ordering the revocation of the mining firms’ FTAA on April 6, 2011, and denying their motion for reconsideration in a resolution issued on July 6, 2011.

The CA turned down the argument of the petitioners that the FTAA can no longer be cancelled since it had already been approved by former President and now Pampanga Representative Gloria Macapagal-Arroyo.

It also claimed petitioners cannot argue that the OP cannot cancel their FTAA being one of the contracting parties, citing Section 17.2 of the FTAA, which stated that the same may be cancelled by either party if there was violation of its terms and conditions, failure of the contractor to pay taxes and fees due the government.

“The subject agreement is not merely a contract between private individuals but one entered into by the Republic… As such, public interest demands that a more liberal stance be taken in determining whether respondent (Redmont) possesses locus standi, which is exactly what the OP had done,” the CA ruled.

The CA also said that factual findings made by quasi-judicial bodies and administrative agencies when supported by substantial evidence are accorded great respect and even finality by the appellate courts. This is because administrative agencies possess specialized knowledge and expertise in their respective fields.

“As such, their findings of fact are binding upon this Court unless there is showing of grave abuse of discretion, or where it is clearly shown that they were arrived at arbitrarily or in disregard of the evidence on record,” the Court said.

Likewise, the appellate court did not give credence to the claim of the petitioners of violation of their right to procedural due process.

The fact that petitioners was given the chance to file a motion for reconsideration of the April 6, 2011 decision of the President, although it was eventually denied, only proved that they were not denied due process.

Records showed that the FTAA was approved in favor of MBMI Resources, a Canadian mining firm and its local partners covering four properties located in the municipalities of Rizal, Bataraz and Narra, all in Palawan, on April 5, 2010, just two months before Arroyo bowed from office.

Meanwhile, Redmont, also an applicant of mining exploration permit, filed a petition for cancellation/revocation of FTAA before the OP, citing violations of the mining law and other applicable laws committed by the petitioners.

Petitioners then moved for the dismissal of the petition on the grounds that there is no rule of law that grants an appeal from a memorandum issued by the Department of Environment and Natural Resources; that the appeal was filed beyond the reglementary period; that there was no proper service of appeal on petitioners; and, that respondent, as an applicant for a mineral agreement, is not a real party-in-interest for the revocation of an existing mineral agreement.

P500M allotted for airports security upgrade

THE Department of Transportation and Communications (DOTC) will purchase P500 million worth of equipment, including passenger and cargo screeners, to upgrade security in 45 airports in the country.
DOTC Secretary Mar Roxas said the 45 airports constitute the bulk of passengers and cargo traffic of the 86 airports nationwide.

We will install, upgrade and layer the security screening for all 45 airports that presently have commercial flights. Of those 45, less than half or only 21 have a security screening facility,” Roxas said in a press briefing Monday.
He said they will start the bidding for the supply of the equipment, which includes nine cargo X-ray screeners, 46 passenger screeners and 59 closed circuit television (CCTV) cameras next month.
“The bidding process will start on the first week of April with the first deliveries to be made within 60 days so that by the end of the year, all will be delivered and installed. By the end of the year, all the 45 airports will have appropriate security facilities,” the official said, adding they will also repair 22 non-operational X-rays.
Roxas said the DOTC wants one bidder to supply all the requirements to ensure uniformity and synchronization of the equipments.
He said of the 21 airports with security screening facility, only the Ninoy Aquino International Airport, as well as airports in Mactan in Cebu and Davao have layered security measures.
He stressed that international standards called for a layered screening, one when the passenger arrived or enter the terminal, and for baggage that are subjected to multiple screening to check for metallic objects, explosives and organic matter such as illegal drugs.
This does not mean, however, that cargoes passing these airports, including NAIA, are not subjected to rigorous screening, Roxas said, adding they want to ensure a seamless screening process.
He said the move to beef up security is also not due to pressure from abroad, particularly the United States.
“In fact, the TSA (Transportation Security Administration), which runs airport security in the United States, gave us a very good mark the last time they were here last December,” he said.
The TSA’s status’s Annual Security Assessment covered airport ID processing and access controls, airport security program, quality control program, airport contingency and emergency plans, cargo security, perimeter and terminal access control systems, passenger and cabin baggage screening system.
But the country’s aviation sector has yet to recover its Category 1 status after the US Federal Aviation Administration downgraded it to Category 2 in 2007 because of safety issues and lack of technical personnel. (AH/Sunnex)
