Abaya all set to leave Congress for DOTC

NCOMING Transportation and Communications chief Joseph Emilio Abaya is all set to leave the House of Representatives after the third reading approval of the proposed 2013 national budget in Monday’s plenary session.
“All my bags are packed, I am ready to go,” Abaya, the incumbent first district representative of Cavite, said.
As the chairman of the House committee on appropriations, the three-term lawmaker defends the proposed P2.006-trillion budget before the 286-member House of Representatives.
After the third-reading approval of the budget in the House of Representatives and Senate, a bicameral conference committee (bicam) will be created to reconcile the conflicting provisions in their version of the budget bill.

After the bicam report is ratified in both chambers, the proposed General Appropriations Act will be sent to Malacanang for President Benigno Aquino III’s signature.
Abaya was appointed as secretary of the Department of Transportation and Communications replacing Secretary Mar Roxas who transferred to the Department of Interior and Local Government after the tragic plane crash of the late Interior Secretary Jesse Robredo.

Comelec ‘too liberal’ in past party-list polls

THE Commission on Elections (Comelec) “may have been too liberal” in the previous elections, its spokesperson said, after representatives of disqualified party-list groups slammed the poll body for being inconsistent in its rulings.

“The Comelec may have been too liberal in the past. Not anymore,” spokesperson James Jimenez said in a text message.
On Monday, the poll body disqualified 1st Consumers Alliance for Rural Energy Partylist (1-Care) and the Association of Philippine Electric Cooperatives (Apec).
Both groups have sitting members in the House of Representatives.
1-Care has two incumbent representatives, Michael Angelo Rivera and Salvador Cabaluna III, while Apec has one representative, Ponciano Payuyo.

Comelec Chairman Sixto Brillantes Jr. said the commission en banc unanimously voted to cancel the accreditations of the two party-list groups.
“We don’t think there is a sector for electricity consumers,” he said.

In an ambush interview, Payuyo said Comelec should be “decisive.” He said disqualification cases against his group were junked in the past 2001 and 2007 elections.

“We were disqualified before and we were forced to defend ourselves before and yet we were allowed to run. Not just once, but twice, 2007 and 2001,” he said.

Ako Bicol Representative Rodel Batocabe raised the same argument when his party-list group was disqualified last week to join the 2013 party-list race.

Batocabe recalled that two disqualification cases filed against his group in 2010 were both junked by the poll body.
Four Comelec commissioners, namely: Rene Sarmiento, Elias Yusoph, Lucenito Tagle and Armando Velasco, were among the poll body’s officials who upheld the Ako Bicol position in 2010.

Batocabe said Comelec is committing grave abuse of discretion and betrayal of public trust.

1-Care party-list Representative Rivera, for his part, said his group was surprised with the decision of the poll body because they knew they had a good record.

Rivera said “big men” from distribution companies are behind their disqualification.

1-Care, Apec, and Ako Bicol party-list groups vowed to appeal Comelec’s decision before the Supreme Court (SC).

But Jimenez said the poll body is confident that the SC will uphold its ruling.

Gatdula aides: Ex-NBI chief is innocent

FOUR former security agents of dismissed NBI director Magtanggol Gatdula submitted Monday their sworn statements to the Department of Justice (DOJ) corroborating the former bureau chief’s innocence in the kidnapping charges filed by Japanese national Noriyo Ohara.

At the continuation of the preliminary investigation, Gatdula also submitted his rejoinder-affidavit insisting that he has no personal or direct control over the NBI’s Security Management Division, which had original custody of Ohara.
“It is the Deputy Director of Administrative Affairs that has personally and direct control over the SMD, and not the NBI director. Thus, respondent Gatdula cannot be prosecuted for the acts of the NBI agents who are not under his direct control. Besides, herein respondent cannot be charged with a crime which he has no knowledge of,” he said in his rejoinder-affidavit.

Gatdula was sacked from his post by President Benigno Aquino III following the findings of the fact-finding panel of the DOJ that he not only covered up the abduction of Ohara and the P6-million extortion from her by an NBI-SMD team, but that he also was insubordinate when he failed to turn over Ohara to the Bureau of Immigration.

To disprove the allegations, Gatdula submitted the testimony of four witnesses, namely, Jackson Singh Gill, Julian Bautista, Alfonso Albay and Ricardo Martinez, who supported his claim that his supposed appearance at the detention cell of Ohara on October 29, 2011, constituted his complicity in the kidnapping.

Gatdula also said that Ohara was merely assuming that he had knowledge of the SMD operation just because, allegedly, he was not surprised that the complainant was detained in the SMD office.

“The truth is, I did not know she was being detained in the SMD. As per NBI agents, she was being rescued. Moreover, she was not handcuffed or locked in jail while being there at the NBI premises. She is even free to go in and out of the NBI premises,” he said.

“Taking into consideration the allegation of the complainant that the NBI director knew of the operation, it is quite illogical and unreasonable that the alleged mastermind of a crime will meet face to face with the alleged victim. No person in his right mind will face his alleged victim. This runs counter to logic, human reason and experience,” he added.

In the sworn statement of Gill, a security guard at the NBI, he said Gatdula was in his regular, routinary inspection of the NBI at the time of the incident, contrary to the claim of NBI special investigator Jose Odellon Cabillan, that Gatdula “appears to have prior knowledge and participation as well as in its cover-up” in the operation to abduct and extort money from Ohara.

Gill said that on October 29, 2011, Ohara and a Japanese policeman identified as a certain Hiruta were introduced by NBI Deputy Director for Administrative Services Rickson Chiong and Interpol Division chief Jun de Castro to Gatdula.

Gill said the Japanese nationals did not seem to be under duress during their visit to Gatdula’s office, and that they were even happy to see him when they entered Gatdula’s office.

After 15 minutes, Chiong, de Castro, Hiruta and Ohara left Gatdula’s office, with Ohara even smiling. Afterwards, Gatdula already left his office to proceed with his inspection of the NBI premises, which he does even on weekends.

Gill’s statement was corroborated by two other security guards, Albay and Martinez, and Gatdula’s security escort, Bautista, who all said that Ohara was not being held against her will when she and Hiruta paid a visit to Gatdula’s office on the same day that the NBI director supposedly saw her detained at the SMD detention facility.

Martinez further went on to say that he overheard Gatdula reiterating his instruction to NBI-NCR Regional Director Constantino Joson to release the Japanese woman who was brought in by Joson’s team once documentation is done. (JCV/Sunnex)

Recto quits chairmanship, withdraws report on sin tax bill

AFTER drawing flak for allegedly endorsing a watered-down version of the sin tax bill, Senator Ralph Recto told his colleagues on Monday that he has resigned as chairperson of the committee that suggested lower state revenues.
“I would like to apologize to you, Mr. President, and to my fellow senators if this move of mine will affect the flow of business in this chamber. But deep in my heart, this is for the best, for all of us,” Recto, head of the ways and committee, said in a speech.
Saying he doesn’t want to block the agenda of President Benigno Aquino III in reforming the tax scheme imposed on liquors and cigarettes, Recto also withdrew the Committee Report 411 to give the new chairperson a free hand to come up with a rough draft.
“Ang sa akin lang, ginawa ko ang trabaho ko, para masimulan na ang debate, at umusad na ang pagpipinal nito. At gaya ng inaasahan ko, may batikos. Isang malaking milagro na kung ang isang panukalang buwis sa bansang ito ay dededmahin lang ng mga magbabayad nito,” he said.
Under Recto’s proposal, the three-tier tax regime on cigarettes could yield between P9.8 billion to P14.8 billion in additional revenues, while alcohol would contribute by as much as P5.2 billion to P7 billion in the first year or in 2013.
By comparison, the version passed by the House of Representatives in June seeks to generate some P31.5 billion in taxes on its first year of implementation. Malacanang, however, is pushing for P60 billion.
“Kulang pa nga daw ang P60 billion, kung tutuusin ang kailangan nga ay P100 billion. Pero ito ang tanong ko: If you raise that amount, you will have to sell more unhealthy products that will cause more sickness and death,” Recto said.
Health advocates welcomed Recto’s decision to quit, which came after he was accused of favoring the proposal of industry leader Philip Morris Fortune Tobacco, which has a facility in his home province of Batangas.
“It is an honorable decision considering the mounting pressure from the civil society, health advocates and from the government agencies for him to consider the health objectives and revenue targets of the government in this sin tax bill,” said Emer Rojas, president of the New Vois Association.
An official of the Department of Health (DOH), however, said the development is not something to cheer for as they hope that the next panel chair would see the bill as a health measure.
“I’m sad that this has to happen rather than the Senate to move on for greater good of our people,” said DOH consultant for non-communicable diseases Dr. Anthony Leachon.
Recto, who is also chairman of the committee on government corporations and public enterprises, said he was not pressured by the ruling Liberal Party to resign.

PhilHealth signs up 20 hospitals to treat breast cancer

TWENTY hospitals nationwide have forged partnerships with the Philippine Health Insurance Corporation (PhilHealth) in a bid to address the country’s problem on breast cancer.
PhilHealth president and CEO Dr. Eduardo Banzon said they have enlisted the help of the 20 hospitals that have proven expertise in handling the disease.
These are the Jose R. Reyes Memorial Medical Center, East Avenue Medical Center, Philippine General Hospital, Rizal Medical Center, Quirino Memorial Medical Center, Baguio General Hospital, Ilocos Training and Regional Medical Center, Mariano Marcos Memorial Hospital and Medical Center, Cagayan Valley Medical Center, and Dr. Paulino J. Garcia Memorial Research and Medical Center.
Also in the list are the Jose B. Lingad Memorial General Hospital, Batangas Regional Hospital, Bicol Regional Teaching and Training Hospital, Bicol Medical Center; Western Visayas Medical Center, Corazon Locsin Montelibano Memorial Hospital, Vicente Sotto Memorial Medical Center, Northern Mindanao Medical Center, Southern Philippines Medical Center, and the Davao Regional Hospital.
“Negotiations are ongoing with additional public as well as private hospitals to serve as PhilHealth-contracted facilities,” Banzon said.
In the 20 PhilHealth-partner facilities, Banzon said their members in early stages of breast cancer can avail themselves of the breast cancer package amounting to P100,000.
The package, Banzon said, will fully cover the cost of treatment, hospitalization and professional fees.
“Breast cancer is an awfully nasty disease that destroys women at the prime of their lives. We are absolutely determined to help our women fight off the ailment,” said the health official.
Banzon said covering the early stage cancer is also the agency’s way to encourage early and timely detection of the disease since it is the “key to improved survival.”
Department of Health data show that one out of four Filipino women diagnosed with breast cancer die inside five years, and four out of 10 expire within a decade. (HDT/Sunnex)

Filipino boxer Donaire stops Japanese Nishioka in 9th

MANILA (Updated 12:30 p.m.) — “The Filipino Flash” Nonito Donaire stopped Toshiaki Nishioka at 1:54 of the ninth round Sunday (Philippine time), defending his WBO super bantamweight title with a dominant performance in his 29th straight victory.
Donaire (30-1, 19 KOs) was less thrilling but more dominant, patiently waiting for openings against Nishioka (39-5-3) before knocking down the Japanese veteran in the sixth despite hurting his left hand during the bout.
Donaire, the Filipino-born fighter raised in California’s Bay Area, then put him down again with a vicious right hand in the ninth, and referee Raul Caiz stopped it after Donaire landed an uppercut moments later.
Nishioka had won 16 straight fights since March 2004, but couldn’t keep up with Donaire’s combination of power and tactical skill.
Nishioka threw just eight punches in the first round, and the crowd that had just watched Rios’ frenzied slugfest with Alvarado understandably booed the early rounds. Donaire attempted to force the action with little success until the sixth, when he landed a left uppercut, followed by a right hand and another uppercut that put Nishioka on the canvas.

Typhoon ‘Nina’ moves away from Philippines, another storm spotted

MANILA — Typhoon “Nina” has slightly weakened as it continued to move slowly away from the country, the Philippine Atmospheric Geophysical and Astronomical Services Administration (Pagasa) said on Monday.
Pagasa weather forecaster Fernando Cada said the typhoon’s winds strength decreased from 140 kilometers per hour (kph) Sunday to 130 kph on Monday, while its gustiness also fell from 170 kph to 160 kph.
As of 4 a.m., the center of Nina was located at 870 kms northeast of Itbayat, Batanes (23.0°N, 131.2°E) and it is forecast to move northwest at 5 kph.
With this speed, Duran said that Nina will likely exit the Philippine Area of Responsibility (PAR) either Tuesday or Wednesday.
Cada said that Nina’s weakening was still because of a ridge of high pressure area near China as well as vertical wind shear or different directions of winds that drifts into the country.
Since the country is in the transition period from southwest monsoon (habagat) to northeast monsoon (amihan), Cada said that winds in various directions blow off into the country, which affects the circulation of the typhoon.
The southwest monsoon is the prevailing weather system in the country during rainy season or from June to early October.
While the northeast monsoon or the “winterwinds” normally starts during mid-October and ends in mid-February.
This year, Cada said the onset of the northeast monsoon will likely start during later part of this month, which would also signal the termination of the southwest monsoon season.
He added that no storm warning signal has been raised so far, since Nina still remained too far to directly affect any part of the country.
Meanwhile, Cada said the weather agency spotted another tropical storm in Guam with international name “Maria”.
This will most likely not enter the country within two to three days, he said.
But once the storm enter the PAR, it will be called “Ofel”, the 15th tropical cyclone to enter the country this year.
Meanwhile, Cada said Metro Manila and the rest of the country will generally have good weather until Tuesday except for possible brief rainshowers mostly in the afternoon or evening due to localized thunderstorms.
Cada said the regions of Zamboanga and Davao and the provinces of Palawan, South Cotabato, Lanao Del Norte, Lanao Del Sur and Bukidnon will experience light to moderate rains.
Pagasa said strong to gale force wind is expected to affect the seaboards of northern Luzon and the eastern seaboard of central and southern Luzon.
Fishing boats and other small seacrafts are advised not to venture out into the sea while larger vessels are alerted against big waves.
Pagasa said moderate to strong winds blowing from the north to northwest will prevail over northern and eastern Luzon.
The coastal waters along these areas will be moderate to rough.
Meanwhile, winds will be light to moderate coming from the north to northeast over western Luzon and southeast to southwest over the rest of the archipelago with slight to moderate seas. (PNA)

Gunmen kill 7 in Rizal; drug link suspected

MANILA, Philippines — Police say gunmen shot dead seven people in Rodriguez, Rizal in what may be linked to illegal drugs.
Rodriquez town police chief Donato Bait said Monday the house owner, his wife and five other people bore gunshot wounds to the head.
He said the owner had been previously jailed for drug-linked offenses.
Bait said the gunmen barged into the house around 1 a.m. but spared the couple’s two children aged 10 and 13. They were taken into protective custody.
Drug-related violence is not uncommon, and authorities say they are taking measures to curb crime. (AP)

Court grants Arroyo’s plea to reset arraignment over plunder suit

MANILA — The Sandiganbayan on Monday deferred the arraignment of former President and Pampanga Representative Gloria Macapagal-Arroyo over the non-bailable plunder suit filed against her.
Arroyo, through her lawyer Anacleto Diaz, earlier sought the deferment of her arraignment to allow her to seek remedy before the Supreme Court (SC). The arraignment was reset to October 29.
Former Philippine Charity Sweepstakes Office (PCSO) board member Manuel Morato’s arraignment was also reset to October 29. Morato is detained at the St. Luke’s Medical Center in Quezon City due to a heart ailment.
“Their arraignment was reset to October 29 which according to the court would give them sufficient time to secure from the Supreme Court any temporary restraining order,” Sandiganbayan spokesperson Renato Bocar said in a television interview.
Both Morato and Arroyo, who were arrested last week over a plunder case in connection with the alleged misuse of PCSO P366-million intelligence funds, did not attend the scheduled arraignment Monday.
Although moved out of the intensive care unit of the Veterans Memorial Medical Center (VMMC), Arroyo’s doctors advised her not to attend the arraignment.
On Friday, Arroyo was said to show signs of coronary ischemia. She was told to undergo a stress echo test at the Philippine Heart Center or any hospital that offers the test.
Arroyo’s lawyers earlier filed a motion to place the former President under hospital arrest. The court had issued a subpoena to VMMC director Dr. Nona Legaspi to “substantiate” the Arroyo camp’s petition.
Although the prosecution did not object to the motion to place Arroyo under hospital arrest, it said they prefer the former President be detained in the Philippine National Police General Hospital and that she shoulders all hospital expenses.
Prosecution lawyers also insisted on Arroyo’s arraignment even if it had to be conducted inside a hospital.
Before her arrest, Arroyo was out on provisional liberty after a Pasay City court granted her petition for bail over a separate electoral sabotage case.
Meanwhile, former PCSO Chairman Sergio Valencia and PCSO Assistant Manager for Finance Benigno Aguas who was also charged with plunder entered a not guilty plea.

Manila mayor orders arrest of gov’t news team maulers

MANILA Mayor Alfredo Lim has ordered the city police to pursue a group of young men who allegedly ganged up and mauled news crew members of the state-run People’s Television Network (PTV) on Friday.
“[Y]esterday I ordered Col. [Amante] Daro to round up and arrest the suspects on the beating of a Channel 4 reporter the [o]ther day,” Lim said Saturday.
The PTV earlier said that its reporter Bernard Tan and cameraman Dante Morada were driving along Sta. Mesa, Manila, when three to four young men appeared at the corner of Valenzuela and V. Mapa Streets.
The young men, believed to be under the influence of either alcohol or illegal drugs, initially hit the news crew’s vehicle.
When the victims alighted from their car, they were physically attacked by the young men who also stoned them and the car.
In a PTV report, Lim condemned the alleged attack and said the suspects should be held liable for stoning the victims and damaging the government vehicle used by them.
Meanwhile, Daro said an investigation has been launched to identify the suspects and determine the motives of their actions.
