House to oppose Recto’s version of sin tax bill

THE House of Representatives vowed to oppose the “watered down” version of the sin tax bill proposed by Senate ways and means committee chairman Senator Ralph Recto.

Recto received criticism from his colleagues and several health advocates for recommending a sin tax measure that would raise only P15 billion to P20 billion in government revenues. The amount is half of the expected P31 billion from the House version.
“Recto’s proposal is watered down. We will stick to the House version,” Western Samar Representative Mel Senen Sarmiento, one of the authors, said in a text message.

“The campaign of the government for good health and universal health care will fail if we adopt the Senate version. We should not back down on our position,” Eastern Samar Representative Ben Evardone, chairman of the House committee on public information, added.

Recto’s proposal uses a three-tier tax rate for tobacco and alcohol products while Malacanang is pushing for a uniform tax rate. The government’s original proposal seeks to increase revenues to P60 billion. The revenue will be used for healthcare projects.

Recto said his committee’s version of the bill is “realistic.” He said high taxes on sin products could lead to smuggling.

Davao City Representative Isidro Ungab, chairman of the House committee on ways and means, said that although his colleagues reject Recto version of the sin tax bill, he would rather wait for the final version of the Senate.

“The committee report will still undergo debates and perhaps amendments at the plenary,” Ungab said.

House Deputy Speaker Lorenzo Tañada III also urged senators to scrutinize the Recto version of the bill.

“Health of the majority of the poor trumps revenue anytime. It is not a question of revenues, it is a question of health,” he said.

The House of Representatives has already found an ally in Senator Miriam Defensor-Santiago who earlier called on university students and social media netizens to join the war against the committee version of the sin tax bill, which she calls “the death star bill.”

“I am gobsmacked – speechless with amazement – at the committee report. It bears no recognizable resemblance to my bill. Government to appeal estafa case vs Globe Asiatique official

TATE lawyers are set to ask the Court of Appeals (CA) to reconsider its decision to dismiss the criminal charges against one of the accused in the P6-billion housing anomaly involving developer Globe Asiatique.
Justice Secretary Leila de Lima said the Office of the Solicitor General will immediately file a motion for reconsideration before the CA’s Special 10th Division on the decision that cleared Christina Sagun, head of GA’s documentation department, of charges of syndicated estafa.
“The DOJ will definitely take further issue on that ruling by filing motion for reconsideration through the OSG,” she said, adding she ordered Prosecutor General Claro Arellano to coordinate with the OSG on the matter.
Sagun was among those whom the DOJ found probable cause in connection with the alleged irregular housing project in Pampanga, along with Delfin Lee, president and chief executive officer of GA Holdings Corp.; his son Dexter, executive vice president, chief finance officer and treasurer; Cristina Salagan, head of the accounting department; and lawyer Alex Alvarez, an employee of Home Development Mutual Fund’s (formerly Pagibig Fund) legal department.
With the ruling of the CA, it put in jeopardy the syndicated estafa charge also lodged by DOJ prosecutors against the four other accused in the case, since for the case of syndicated estafa to prosper there has to be at least five respondents acting in conspiracy with one another.
De Lima said she will not allow the syndicated estafa charge against Lee and his co-respondents to be downgraded to simple estafa, which would enable them to post bail. All the respondents are currently at large upon the filing of the case before the Makati regional trial court.
De Lima said the ruling of the CA is not yet final, thus its effect will not immediately impact in the ongoing trial at the Makati court.
She also pointed out that Lee remains to be a fugitive from justice, despite the arrest warrant issued by the Makati RTC last year. His continuing evasion of his arrest, she said, would have legal implications in his bid to convince the court of his innocence, de Lima said.
“The charge against Delfin Lee, et al. remains to be syndicated estafa, hence, non-bailable. The CA decision has not attained finality yet,” she added.
The government has offered a reward of P2 million for the arrest of Lee.
In clearing Sagun, the CA said she is only liable for simple negligence, since based on evidence presented, her duties are ministerial in nature and do not require the employment of much discretion or discreet judgment.
The appellate court said that petitioner’s duties, as found by the DOJ, are confined to collating and checking if the documents submitted by borrowers/buyers, through GA’s marketing department, are complete and duly accomplished, and verifying from Pag-Ibig whether or not buyers have updated contributions and are qualified to apply for housing loans.
“Except for her negligence, the (DOJ) has not demonstrated how petitioner could have been privy to the creation of the so-called ‘special buyers’ such that she was conscious all along that she was committing a serious non-bailable crime as syndicated estafa,” the CA ruled.

Malaysian leader to meet Aquino over economy, defense

MALAYSIAN Prime Minister Najib Razak and President Benigno Aquino III will have a bilateral meeting in Malacañang hours before the signing of the draft framework agreement forged by the Government of the Philippines (GPH) and the Moro Islamic Liberation Front (MILF) on Monday.
“In the morning of October 15, they shall discuss the political, economic, and defense and security cooperation between the Philippines and Malaysia,” the Department of Foreign Affairs (DFA) said.
Najib was scheduled to arrive in the country Sunday afternoon with spouse, Datin Paduka Seri Rosmah Mansor, and the Malaysian ministers of foreign affairs, defense and international trade and industry.
This is the first visit of Najib to the Philippines since he assumed office in 2009.
Aquino will host a luncheon in honor of Najib and Datin Rosmah Mansor.
The framework agreement is scheduled to be signed at 1:30 p.m. Monday by the government’s chief negotiator Marvic Leonen and his MILF counterpart, Mohagher Iqbal.
Malaysia has been the third party facilitator of the GPH-MILF peace talks since 2001 and the head of the International Monitoring Team since 2004.
Officials from the Autonomous Region in Muslim Mindanao (Armm) are hoping that the draft agreement will lead to the eradication of such notorious crimes as kidnapping, banditry and extortion in the area.
“We hope that once the peace and order situation in these areas are normalized with the elimination of kidnapping, extortion and plain banditry, we can do away with those negative travel advisories from foreign countries that is giving Mindanao a bad image here and abroad,” said a police official who requested anonymity.
For his part, Armm Regional Governor Mujiv Hataman said the breakthrough in the 15-year-old peace negotiations with the MILF “only indicates that the Bangsamoro people will soon harvest the seed of a lasting peace in Mindanao.”
Vice President Jejomar Binay, now in Belgium for a European business summit, said the agreement will likely bolster investments in Mindanao because of expected improvement in security.
“I also hope the agreement will serve as proof that we are serious in our efforts towards creating a peaceful and progressive Mindanao and this, in turn, will encourage the European community to continue to provide ODA (official development assistance) to the Philippines,” he said.
After the signing of the framework agreement, an Executive Order will be issued by the President to constitute a 15-member Transition Commission (TC), eight of which will be coming from the MILF.
The TC will draft the Bangsamoro Basic Law, which will be certified as urgent bill by the President and passed by Congress. It will then go through a plebiscite and ratified by people in the proposed Bangsamoro areas.
Aside from his visit to Malacañang, Najib, along with the Malaysian business delegation, will also be meeting top Filipino business executives under the auspices of the Philippines-Malaysia Business Council.

Lawmaker’s generosity reaches Guagua

GUAGUA — Third district Representative Aurelio Gonzales Jr.’s generosity has reached students of a high school in this town.
Although not part of his district, Gonzales on Friday responded to the need of some 50 students and their parents for educational assistance at Betis High School.
The aid came after the lawmaker awarded livelihood assistance to entrepreneurs under his STRA-DG or “Sulong Trabaho ng Dong Gonzales” the afternoon of the same day.
Officials of Betis High School said their appeal was immediately attended to by Gonzales.
“We would like to thank Cong Dong so much for his generosity which has transcended boundaries. We know that Guagua is not part of his district anymore but because it is for the education of our children, he did not even think twice about extending assistance,” the school officials said.
Gonzales for his part, told the students — which are now part of his 27,000 scholars — to study hard and value education.
“I come from a poor family who value education. I urge you to study hard as education is the key to success. Through it, you will be able to help your families and others someday,” said Gonzales.

Senators deny oust-Enrile plot after Palace dinner

MANILA — Senate President Juan Ponce-Enrile may still hold on to his post as the third highest official in the land after his colleagues denied rumors of removing him soon.
Senators Franklin Drilon, Edgardo Angara and Alan Peter Cayetano said they don’t see any chance for a leadership change to prosper even as Senator Antonio Trillanes IV earlier admitted of working for Enrile’s ouster.

The private gathering had been long overdue, said Drilon, and should not be given political color.
“Can we guarantee that there will be no leadership change? No one can guarantee that because that is a prerogative of the majority of the members. But right now, I have always said, from a much-ignored minority of three, we have become a much-feared minority of four. Just you wait when we become five,” Minority Leader Alan Peter Cayetano said.
Cayetano and sister Pia, Trillanes and Senator Joker Arroyo compose the minority bloc. At least 13 votes of the 23-member chamber are needed to elect a Senate President.
“Right now, there is no truth to those. In the Senate, in the event that this happens, it is sudden. The more public it is, the more it will be discussed, the more that those who don’t want a coup to occur will talk to others. The mere fact that it is being discussed means there is no coup,” Cayetano said.

Reports: Smaller iPad to be revealed Oct. 23

APPLE Inc. is set to reveal a smaller, cheaper version of the iPad at an event on Oct. 23, according to several reports published Friday.
The reports from Bloomberg News, Reuters and the AllThingsD blog are based on unnamed sources “familiar with the plans.”
Apple Inc. hasn’t said anything about a smaller tablet, a concept company founder Steve Jobs derided two years ago. But company-watchers have assumed for months that an “iPad mini” will appear before the holiday season.
The screen is reportedly about half the size of the iPad’s, which measures 9.7 inches diagonally. Analysts speculate the starting price of the device could be about $299.
With the device, Apple could close an opening in the tablet market for rivals like Amazon.com Inc., whose Kindle Fire is half the size of the iPad and starts at $199. Google Inc. and Barnes and Noble Inc. also sell tablets in the same size and price range.
Apple’s event would occur three days before Microsoft Corp. releases Windows 8, the new version of its operating system. Microsoft will be releasing its “Surface” tablets with the software.

Preparations for framework deal signing in full swing

MALACANANG said on Saturday that preparations for the formal signing on Monday of a framework agreement between the Government of the Philippines (GPH) and the Moro Islamic Liberation Front (MILF) are in full swing.
In an interview over dzRB Radyo ng Bayan, deputy presidential spokesperson Abigail Valte said that the MILF alone will be represented by 200 people led by its chairman Al Haj Murad Ebrahim.
“The preparations are in full swing for the ceremony on Monday. We were told yesterday that the signing of the framework agreement will be in the afternoon. The exact time is 1:30 (p.m.) at (the) Rizal Hall in Malacanang,” she said.
“So again, this is historic because it’s the first time that the MILF will ever be inside the Palace,” Valte said.
Prior to the signing of the framework agreement, she said that President Benigno Aquino III and Malaysian Prime Minister Najib Razak will have a bilateral meeting in the Palace.
The Malaysian leader will arrive in Manila on Sunday. Kuala Lumpur has been facilitating the peace negotiations between the Philippine government and the Muslim rebels.
Valte said that the Presidential Security Group had a run through on Saturday for the arrival honors for the visiting Malaysian official, and on Sunday, there will be a walk through at 3 p.m. for the signing of the framework agreement.
Razak, Organization of Islamic Conference (OIC) secretary-general Ekmeleddin Ihsanoglu, representatives of the International Contact Group, the International Monitoring Team, and the then secessionist Moro National Liberation Front, will witness the signing ceremony of the framework agreement, Valte said.
She said that the GPH and the MILF have adopted security and diplomatic protocols for the October 15 event.
After the signing of the document by GPH panel chair Marvic Leonen and MILF chief negotiator Mohagher Iqbal, they will hold a joint press briefing at the New Executive Building in Malacanang.
At the same time, Valte expressed hope that those civil society organizations participating in the peace caravan called as “Lakbay Kalinaw,” which was launched in Mindanao and on their way to Manila in time for the signing of the framework agreement, would have a “safe journey.”
She said that the groups will also be witnessing the event on Monday.

2 cops injured in Iloilo grenade blast

MANILA — Two police officers were injured in a predawn grenade explosion in Jaro district in Iloilo City on Saturday.
In a text message, Western Visayas police director Agrimero Cruz Jr. said the grenade blast occurred while police personnel were conducting a checkpoint along Jalondoni street around 1 a.m.
An unidentified motorcycle driver who was flagged down in the checkpoint fled to a residential area but was chased by Police Officer (PO) 1 Christian Valerie Lava and PO2 Fidel Mosquito.
When the two police officers cornered the fleeing motorist, the grenade explosion was heard.
The motorist died on the spot while Mosquito sustained major injuries on both legs. Lava also incurred a minor injury on his left leg.
Recovered from the suspect was a .45 caliber pistol and ammunition, a knife, a cellphone, and cash worth P29,000.
Authorities are still conducting an investigation regarding the incident.

Palace says security measures place following san juan blast

MANILA — Malacañang said the government is exerting all necessary efforts to maintain peace and order in the country following a blast in San Juan City, on Saturday morning.
In an interview over government-run radio station DzRB Radyo ng Bayan, Saturday, Deputy presidential spokesperson Abigail Valte assured that the Philippine National Police (PNP) is conducting a thorough investigation to identify those responsible for the latest violent incident and ensure the safety of the people.
“Ang magandang balita po diyan ay negative na nagkaroon ng injuries to persons, damage to property po ang meron doon. Nagco-conduct na ang explosive division ng San Juan ng kanilang investigation,” Valte said.
When asked on the government’s security preparations for the upcoming visit of Malaysian Prime Minister Datuk Seri Najib Tun Razak in the country, Valte said that although there are no terror threats gathered, the PNP has been on full alert status to ensure the safety of the visiting head of state.
“Katulad po nang sinabi ng spokesperson ng PNP, si General (Generoso) Cerbo, ay walang information that there are threats but that is the standard procedure that we conduct whenever we have heads of state or foreign officials who will be visiting the country. So naka-alerto ang PNP ready to provide the security that is necessary,” Valte noted.
Prime Minister Rajib will be arriving in the country on Sunday to meet with President Aquino and to witness the historic signing of the Framework Agreement between the government peace panel and the Moro Islamic Liberation Front (MILF) for the creation of the Bangsamoro on Monday afternoon.
Recent reports revealed that a fragmentation grenade exploded 1:15 a.m. Saturday at the basement office of LK Global Holdings Corp. in Bonaventure Plaza, Ortigas Avenue in San Juan.
Initial investigations by the police claimed that the explosion is an isolated case and the intention to cause panic especially to Greenhills shoppers is far-fetched.

Coast Guard: 9 missing fishermen allegedly sighted in Mindoro

MANILA — The nine fishermen who were earlier reported missing off the Scarborough Shoal in the West Philippine Sea were allegedly found stranded in an island in Occidental Mindoro, the Philippine Coast Guard (PCG) said.
The PCG Southern Tagalog District received a report from the Philippine National Police Maritime Group that a stranded motor banca with nine passengers was sighted at the Cabra Island of the said province last Wednesday.
The PCG also received information that a certain Rolly Claro, brother-in-law of one of the missing fishermen, reported the sighting.
After verifying the reported sightings and gathering more information, the PCG learned that M/Bca Jericho, the boat which carried the nine fishermen, took shelter in an uninhabited place near the said island because its astern part was damaged.
Authorities scoured the area and even conducted a seaborne patrol operation at the nearby waters but reported negative results.
Residents near the scoured areas and owners and operators of fishing and motor bancas were urged by authorities to be on the look-out regarding the missing and now allegedly stranded nine fishermen.
The nine fishermen were reported missing since October 1 after they failed to return from their fishing venture off the Scarborough or Panatag Shoal.
The missing fishermen were identified as: Ricky Quidez, Mac Mac Quidez, Melbert Quidez, Joven Cervantes, Glen Reyes, Gardo Docusin, Rogelio Elesterio Sr., Joseph Valdez, Bibiano Dela Peña III.
