Caguioa-Tenorio tandem shines for Ginebra

Reigning Most Valuable Player Mark Caguioa seems to be playing beautiful music with newly-acquired playmaker La Tenorio.

The dreaded Ginebra backcourt proved that anew against Rain or Shine Sunday night, leading the Gin Kings to a 98-94 victory and a hold of the solo lead in the 38th PBA Philippine Cup at the packed Smart Araneta Coliseum.

The 6-foot-1 Caguioa tallied 22 points while Tenorio, obtained in that megatrade in the off-season, scattered 20 markers, with both scoring 14 of the Gin Kings’ last 16 points to hold off the stubborn Elasto-Painters.

“LA is a big help. He makes it easier for me and the rest of our teammates. He really opens up the court and that’s what I like about him,” stated Caguioa, who fired four triples and hauled down eight boards.

Forward Rico Maierhofer and veteran Kerby Raymundo tallied 12 apiece to provide ample support for Caguioa and Tenorio in the payoff period.

Although the win proved a stark contrast from their resounding 110-90 victory over newcomer GlobalPort in the opener last Sept. 30, Ginebra coach Siot Tangquincen will take it, saying: We didn’t play well but we’re blessed to come up with a win.

“It’s a very good win. It’s interesting how we fare against Rain or Shine. They’re one of the tough teams and they’re very fluid na.”

Sweet-shooting Jeff Chan paced all scorers with 25 points, 12 coming in the payoff period, but his potentially-tying triple in the crunch went way off the mark as the E-Painters, fresh from a clinical 102-86 win over title-favorite Petron Blaze last Wednesday, dropped to 1-1.

After a Jireh Ibanes acrobatic lay-up gave RoS a 90-87 lead, Caguioa drained a triple, followed by a Maierhofer putback before Tenorio split his charities, putting Ginebra ahead 93-90 with 1:43 left.

Ibanes scooped in another lay-up then Norwood, rising over the smaller Caguioa, turned an offensive rebound into a twinner for a shaky 94-93 Ros lead.

Taking advantage of his quickness, Tenorio sank a jumper off RoS center JR Quinahan. Norwood missed in the ensuing play and got whistled for a loose ball against Tenorio, who calmly sank his free throws that gave them a 97-94 cushion with 16.5 ticks to play.

Needing a trey to tie, Chan had a good look but his three-point attempt went off to the left, forcing Norwood to give another pre-emptive foul on Caguioa, who pegged the final count by making the front-end of his two shots.

Earlier, Air21 essayed a morale-booting 88-81 victory over newcomer GlobalPort, giving coach Franz Pumaren his first win in the Philippine Cup.

Former NCAA MVP John Wilson came off the bench and fired 17 points while forwards Mark Isip and Nino Canaleta collected 12 apiece as the Express bounced back from an 87-90 defeat inflicted by Barako Bull last Wednesday while snapping their 14-game losing streak in the tourney.

“We made a lot of mental lapses till the very end. It’s a sign that we’re still in the stage that everybody is still adjusting to each other,” stated Pumaren, who went 0-14 in last season’s Philippine Cup when the team was still known as Shopinas.com. “We’re lucky Global is still in a getting-to-know stage just like our team. They’re still groping for form.”

Willie Miller, a two-time league MVP, churned in 22 points while Gary David scattered 17, but those failed to stop the Batang Pier from absorbing their second straight defeat.

Intriguingly, center Rabeh Al-Hussaini, who got into a heated exchange with David in the midst of a loss against the Gin Kings, was not fielded by coach Glenn Capacio.

A Wynne Arboleda lay-up gave the Express a 77-65 cushion but the Batang Pier clawed back behind Miller and David, moving within 75-79 with 69 ticks to play. But Air21 flashed enough poise to hold on, with Noy Baclao, Wilson and Canaleta making the clutch baskets.

Social media ‘need rules’

CEBU – Governor Gwendolyn Garcia supports the inclusion of online libel in the Cybercrime Prevention Act, saying the law should be enforced and tested before any amendments are pursued.
“I support President (Benigno) Aquino’s stand. Freedom of speech and expression must always be tempered with responsibility and accountability,” said the governor in a text message to Sun.Star Cebu
At least 10 petitions have been filed asking the Supreme Court to strike down Republic Act 101751, which the president signed into law in mid-September. The law also provides penalties for cybersex, identity theft, and online fraud.
Interviewed separately, former Akbayan party-list representative Risa Hontiveros-Baraquiel said the law should be amended right away because of its unconstitutional provisions.
“The cybercrime bill started with a good intention, which was to combat cyber-bullying, crimes in the Internet, including the terrible crime of human trafficking. But what happened is that not only was the provision on cyber-bullying removed, unconstitutional provisions were also inserted,” Baraquiel said in an interview.
“While there is a libel law that can be applied against broadcast or print, the social media are practically unregulated,” Governor Garcia said in an interview after she filed her certificate of candidacy last Friday. She is running for the third district’s congressional seat, which will be her first legislative position if she wins.
The controversial law expands libel, as defined in the Revised Penal Code, to the Internet but provides for penalties one degree tougher. In the code, the penalty for a libel conviction is six months and a day up to six years of imprisonment or fine of P200 to P6,000, or both penalties.
In the Cybercrime Prevention Act, the prison term is six to 12 years in jail, in addition to other penalties.
Garcia said the uproar of the bloggers and users of Twitter and Facebook users is understandable, yet she believes it is time that regulations on social media be introduced. The governor is also a Twitter user (@gwengarcia1ph).
“Perhaps, it’s really (the) time that there must be some form of regulation because while we will always uphold the freedom of expression, such freedom comes with responsibility and accountability,” she said.
“All other freedoms are guaranteed by the Constitution but at the same time, there are laws that define our freedom; we need parameters and standards by which freedom may be exercised,” the governor added.
The governor’s brother, Rep. Pablo John Garcia (Cebu Province, 3rd district), earlier said he voted for the passage of the House’s version of the cybercrime law.
He is favor of amending it to harmonize with the Revised Penal Code and the pending bills to decriminalize libel.
The provision on Internet libel was not included in the House version of the Cybercrime Prevention Act whose main authors included Representative Gloria Macapagal-Arroyo. It was introduced in the Senate.
“Let the law first take its course. Then we will see if amendments are in order,” Governor Garcia said in a text message.
The law took effect last October 3, after the Supreme Court deferred discussion on the petitions filed by different groups.
The petitions questioned some provisions that violate the freedom of speech, right to privacy, illegal searches and seizures and double jeopardy.
Baraquiel, who was in Cebu last Saturday, said that under the law, authorities can access private data or block access to databases even without a court order. The Senate candidate said the law also violates the people’s right to information.
She said that Akbayan has called on President Aquino to convene different sectors to craft the law’s implementing rules and regulations.
“Ang pinakamagandang nangyari in the aftermath of this danger is that ipinakita talaga ng mamamayan lalo na ng mga netizens yong pagpapahalaga sa kalayaan (The best thing that happened is that in the aftermath of this danger, the public, especially the netizens, were able to show how they value freedom),” she said.

Military plane crash in Sudan kills 13

KHARTOUM, Sudan — Sudan’s state news agency says a military transport aircraft has crashed near the capital Khartoum after a mechanical failure, killing 13 people on board. It says nine people survived.
SUNA says the plane went down Sunday about 40 kilometers (25 miles) southwest of Omdurman, Khartoum’s twin city.
Sudanese military spokesman Col. Sawarmy Khalid says the Antonov 12 was transporting military personnel and equipment to Darfur. He says the pilot reported the aircraft’s two engines had failed.
Sudan has a poor aviation safety record, with a large number of accidents. A Sudanese helicopter carrying a government delegation crashed in August, killing all 32 people on board including a minister.

UK, Japan laud PH-MILF peace pact

Manila, Philippines – The British and Japanese governments welcomed the preliminary peace pact reached between the Philippine government and the Moro Islamic Liberation Front (MILF), saying that the deal was a huge step towards lasting regional peace and stability in Mindanao.
“This is a testament to the commitment and vision of the parties. The agreement has the potential finally to end the long-running conflict,” British Foreign Secretary William Hague said in a statement after President Benigno Aquino III announced Sunday the drafting of a framework agreement between the government and the MILF.
“Full implementation of the agreement by 2016 can bring about peace, security, and development. That will be good not only for Mindanao, but for the whole of the Philippines,” Hague said.
British ambassador to the Philippines Stephen Lillie underscored the importance of commitment to peace, citing as example his country’s experiences in negotiating a peace deal with Northern Ireland.
“We have shared many experiences from that process with the parties here. One of the most relevant lessons at this point is to recognize that even after an agreement, it won’t all be plain sailing, and there will still be challenges, Lillie said.
“But with commitment and hard work, these will be far outweighed by the benefits of peace, as our own experience since the Good Friday Agreement was signed 14 years ago shows,” the envoy added.
Japan also hailed the deal and recognized the efforts made by the Philippine government, the MILF, as well as the Malaysian government for its role as facilitator in the peace talks.
“Japan strongly hopes that both parties will steadily implement the contents of the Framework Agreement and continue their persistent negotiation efforts towards the early realization of the final agreement,” said a statement issued by the Japanese embassy.
Both governments also vowed to continue their support for the Mindanao peace process, noting the issue was an important point of discussion on the relations between the Philippines and their respective countries.
Both Japan and the UK are members of the International Contact Group (ICG) which monitors the developments in the peace talks.
“We have been showing our support since the ICG was formed in 2009, and we will continue to be supportive,” said Lillie.
Japan, in its statement, noted that it would continue with funding development projects to help develop Mindanao, particularly through sending of experts on development to the International Monitoring Team (IMT), economic cooperation projects such as extending Grassroots Grant Assistance for Human Security in former conflict-affected areas under the Japan-Bangsamoro Initiatives for Reconstruction and Development (J-BIRD), and continued participation in the ICG.

MMDA, police: No bomb explosion at LRT Recto station

MANILA — Authorities dismissed earlier reports that a bomb exploded at the Recto station of the Light Railway Transit (LRT) on Saturday afternoon.
In his Twitter account, Rodan Erolin, navigator team supervisor of the Metro Manila Development Authority (MMDA), said policemen clarified that the reported explosion was probably the controlled detonation of three suspicious boxes found in the area.
The MMDA earlier reported the alleged bomb explosion.
“As of 2 p.m. positive bombing at LRT Recto Station; Recto toward Divisoria closed to traffic; expect heavy in the area,” the MMDA said in its Twitter account. The said post was later deleted.
Yves Gonzales, MMDA traffic director, also denied the unconfirmed bomb explosion.
“As head of @MMDA twitter team, I take full responsibility for the wrong tweet posted awhile ago. Initial info should always be verified before posting,” Gonzales said in his Twitter account.
Radio reports said the Manila police received a call regarding the suspicious package. A bomb disposal unit rushed to the area and blasted it in a controlled detonation.

5,686 aspiring lawyers to take 2012 Bar exams

MANILA — A total of 5,686 people had been admitted by the Supreme Court to take the 2012 Bar examinations on all four Sundays of October at the University of Santo Tomas in Manila.
Bar Confidant Ma. Cristina Layusa said this year’s edition is back to the original schedule where there will be two exams of the eight Bar examination subjects per Sunday unlike last year where the exam coverage was drawn up by topics and sub-topics.
The order of the exam is as follows: first day (October 7): Political Law (morning) and Labor and Social Legislation (afternoon); second day (October 14): Civil Law (morning) and Taxation (afternoon); third day (October 21): Mercantile Law (morning) and Criminal Law (afternoon); fourth day (October 28): Remedial Law (morning) and Legal Ethics and Practical Exercises (afternoon).
Scores in the multiple-choice questions will carry a weight of 60 percent, while those of the essay-type examinations will be given a weight of 40 percent in computing a candidate’s final grade.
Takers will also be required to prepare a trial memorandum on October 28.
In determining the average, subjects in the examinations are given the following relative weights: Political and International Law, 15 percent; Labor and Social Legislation, 10 percent; Civil Law, 15 percent; Taxation, 10 percent; Mercantile Law, 15 percent; Criminal Law, 10 percent; Remedial Law, 20 percent; and Legal Ethics and Practical Exercises, 5 percent, for a total of 100 percent.
Of the total 5,710 petitions to take the Bar exams, five had been denied, and 19 have been withdrawn, reducing the number of examinees to 5,686.
“I want perfect, flawless Bar Exams,” said Associate Justice Martin Villarama Jr., this year’s Bar exam chairperson.
Meantime, Manila Mayor Alfredo Lim issued Executive Order 32 prohibiting the sale and distribution of beer, wine and other intoxicating liquor on the four Sundays of October around the perimeter walls of UST.
The liquor ban is from 4 a.m. to 8 p.m. within 200 meters from the premises of UST along España Boulevard, Lacson Avenue (formerly Governor Forbes), Dapitan Street and P. Noval Street.
Those who failed to follow the order will be meted a fine not exceeding P200 or a jail term of not more than six months or both depending on the decision of the court.
A total of 6,200 law graduates were admitted to the exams last year but only 5,990 showed up.
Ateneo de Manila’s Raoul Angelo Atadero led the 1,913 passers of the 2011 edition, which was taken in four Sundays of November also at UST. He was followed by fellow Atenean Luz Danielle Bolong.
The Rules of Court provide that “a candidate may be deemed to have passed his examination successfully if he has obtained a general average of 75 percent.” The rule disqualifying applicants having grades in any subject falling below 50 percent has been abolished since 2010, said Layusa.

Anti-trafficking, money laundering bills top Senate agenda

MANILA — Senators have roughly two weeks to tackle several priority measures, among them the remaining amendment to the anti-money laundering law and the anti-trafficking in persons act before they go on a Halloween break.
Up for third and final reading is the Expanded Anti-Trafficking Act of 2012, which aims to strengthen and amend certain provisions of Republic Act 9208, while the Anti-Money Laundering Act will be debated on the Senate floor.
“We will do our best to ensure the passage of the last remaining amendment to the Anti-Money Laundering Act before we adjourn again in two week’s time, but we must also be careful not to rush into approving this measure just to meet a deadline,” Senate President Juan Ponce Enrile said.
The Paris-based Financial Action Task Force (FATF) is set to review before its annual meeting on October 15, anti-money laundering laws being implemented by non-compliant countries.
FATF is an inter-agency governmental policy-making body tasked to combat money-laundering and anti-terrorist financing.
The Philippines was earlier upgraded from the group’s dark grey list after both houses of Congress passed in June two AMLA measures, listing terrorist financing as a predicate crime and allowing authorities to freeze suspected bank accounts without a court order.
Set to be taken up in the next few days as well are Senate Bill 1198 (media absentee voting), Senate Bill 1030 (biometrics registration of voters), Senate Bill 3002 (Special Education Act), Senate Bill 2918 (strengthening conciliation-mediation as a voluntary mode of dispute settlement for all labor cases), Senate Bill 2921 (strengthening tripartism in the Labor Code) and Senate Bill 2838 (strengthening workers’ right to self-organization).
Moreover, the Senate will continue to discuss the controversial House Bill 4820, which seeks to carve a new province out of Camarines Sur, naming it Nueva Camarines.
The bill has been strongly opposed by reelectionist Senator Antonio Trillanes IV, who accused Senate President Juan Ponce-Enrile of conniving with local politicians to have the measure approved as soon as possible.
Enrile, in turn, slammed Trillanes for his role as backdoor negotiator for the Philippines in its conflict with China in the West Philippine Sea.
Meanwhile, the period of interpellations and introduction of individual amendments on the Reproductive Health Bill is expected to continue. Plenary deliberations on Senate Bill No. 3208, otherwise known as the People’s Ownership of Government Information Act of 2012, will also start soon.
The Senate is set to adjourn its session on October 20 and resume on November 5 before it adjourns for a one-month Christmas break.

Australia cites abduction threat in Philippines

MANILA — The Australian government advised its nationals in the Philippines to exercise a high degree of caution against possible threats of terror attacks including abduction.
In its travel advice update on October 5, the Department of Foreign Affairs and Trade of Australia cited a recent warning supposedly issued by local authorities.
“[T]he Philippines government warned that an armed group may be planning to abduct foreign nationals, including workers of international non-government organisations undertaking field visits and other humanitarian activities, in some areas of Maguindanao and Cotabato provinces,” the travel advice update said.
The Australian government added that “there is a danger of kidnapping throughout the Philippines” particularly in the southern part of the country including places frequented by tourists such as coastal and island resorts, dive sites, and remote locations in the Sulu Sea.
“Terrorists have kidnapped foreigners from these areas in the past. If you decide to travel to an area where there is a particular threat of kidnapping, you should ensure you have personal security measures in place, seek professional security advice and take out kidnapping insurance,” the Australian government said in its travel advice update.
Last February, two foreign nationals were kidnapped in the Sulu Archipelago, close to the border with Malaysia.
In December 2011, an Australian citizen was kidnapped in Zamboanga Sibugay while two American citizens and their Filipino relative were kidnapped from an island near Zamboanga City in July of the same year.
The Australian government also advised its nationals not to travel to central and western Mindanao, including the Zamboanga Peninsula and Sulu Archipelago, due to the very high threat of terrorist attack, kidnapping, violent crime and violent clashes between armed groups.
It even claimed that terrorist attacks could happen “anytime, anywhere” in the Philippines, including in Manila.
“We continue to receive credible reports indicating terrorists are planning attacks against a range of targets in a variety of locations, including places frequented by foreigners,” the Australian government said in its travel advice update.
Australia’s travel advice update comes a week after the United States Embassy issued a similar warning to its nationals in the Philippines for a possible security threat in Metro Manila, particularly in the Pasay City neighborhood.
The threat remains in effect until October 10.
But Malacañang has since assured that law enforcers have tightened security measures for the alleged threats in the country.
The Armed Forces of the Philippines also said last week that the military has not monitored any “significant threat” against foreign nationals.

Another tropical cyclone may enter Philippines Monday

MANILA — The state weather bureau is keeping an eye Sunday on a new tropical cyclone near the east of Northern Luzon that has a high chance to enter the Philippine Area of Responsibility (PAR) by Monday.
In an interview, Philippine Atmospheric, Geophysical, and Astronomical Services Administration (Pagasa) weather forecaster Jori Loiz said based on models, the tropical cyclone is still very far to affect the country but once it enters the Philippines, it will be called “Nina.”
Loiz said Pagasa expects two to three tropical cyclones to enter PAR this October. Nina is the 14th tropical cyclone to enter the country this year.
He added that the Intertropical Convergence Zone (ITCZ) will continue to affect Palawan, the Visayas and Mindanao, bringing cloudy skies with light to moderate rains in these regions.
An ITCZ is a merge of winds from different directions, which is also a breeding ground for a low pressure area.
Metro Manila and the rest of Luzon would still experience passing rains mostly in the afternoon or evening due to localized thunderstorms, while sunny to cloudy weather will be experienced in the morning, he said.
He said temperatures in Metro Manila and many parts of Luzon will range from 23 to 32 degrees Celsius for Sunday.
In its advisory, Pagasa said that Palawan, Visayas and Mindanao will have occasional light to moderate rains or thunderstorms while Metro Manila and the rest of Luzon will be partly cloudy with brief rainshowers or thunderstorms.
Moderate to strong winds blowing from the northeast to north will prevail over the Cordillera Administrative Region, Cagayan Valley, Ilocos region and Bicol region and from the southwest to west over the rest of Luzon. The coastal waters along these areas will be moderate to rough.
Elsewhere, winds will be light to moderate coming from the southwest to west with slight to moderate seas. (PNA)
