Aquino wants Arroyo back in jail for plunder

MANILA (Updated) – President Benigno Aquino III wanted his predecessor, Gloria Macapagal-Arroyo, back in jail for a separate case of plunder filed against her by the Ombudsman last week
Arroyo, who is now Pampanga second district representative, was released from hospital detention Wednesday after the Pasay City Regional Trial Court (RTC) Branch 112 allowed her to post bail on electoral sabotage case filed against her by the Commission on Elections (Comelec) in connection with alleged fraud in the 2007 midterm elections.
The former President posted a P1-million bail.
Arroyo on Thursday went to Tagaytay City to seek alternative treatment for her ailments from Dr. Antonia Park. The former President will stay in Tagaytay until Sunday, according to her camp.
“She’s left with no choice at this point. With all the legal limitations, this (alternative treatment) is the only thing she can pursue,” Arroyo spokesperson Elena Bautista-Horn said Thursday.
Aquino said, however, that Arroyo is not a free person yet since she has to face a non-bailable charge of plunder before the anti-graft court Sandiganbayan.
“Hinihintay natin ‘yung desisyon ng Sandiganbayan (We are waiting for the decision of the Sandiganbayan),” Aquino said.
The Ombudsman case is in connection with the alleged misuse of P365-million confidential and intelligence funds of the Philippine Charity Sweepstakes Office from 2008 to 2010. It was filed days before Aquino was set to deliver his third State of the Nation Address (Sona).
Arroyo’s camp criticized the timing of the filing of case, saying it was meant to “demonize” the Pampanga lawmaker on the Sona.
Several groups also lambasted the Aquino administration for filing a “rushed” electoral sabotage complaint against Arroyo that allowed her to escape jail.
Bayan Muna party-list Representative Teddy Casiño said Arroyo’s release from hospital detention is a “big slap on the face” of Aquino, who boasted the administration’s efforts to hold the Pampanga lawmaker accountable just two days ago in his third Sona.
“The court decision was made apparently because the government’s complaint of electoral sabotage was rushed, owing to its failure to build up any of the major cases filed earlier by various citizens’ groups,” Casiño said.
But Aquino submitted to the decision of Pasay City RTC Branch 112 Judge Jesus Mupas finding no corroborative evidence to pin down Arroyo for poll fraud.
He said it would be impossible for Arroyo and her co-accused, former Maguindanao governor Andal Ampatuan Sr., to testify against each other.
Emerging from a meeting with Comelec Chairman Sixto Brillantes, Justice Secretary Leila de Lima said the prosecution will now focus for the pre-trial set next month.
“We are moving forward. The DOJ (Department of Justice) and the Comelec will work closely together. The Comelec will still be the lead prosecutor in the electoral sabotage cases but during the trial proper, the DOJ would take a more active role in handling the case,” she told reporters.
Brillantes said it is important to realize that Arroyo has not yet been cleared of the case and that the Comelec remains determined to make her accountable of her supposed crimes.
“If that is what the court believes, we cannot do anything about it but remember that it was only on the bail hearing, which is only an incident of the entire case,” he said. “We agreed that we will now proceed with the presentation of evidence on the trial on the merits.”
For the trial on the main merits of the case, the poll chief noted that their camp will insist on the credibility of the testimonies of their star witness, Norie Unas, over the role of Arroyo in the 2007 Maguindanao polls.
Among these, he said, are the findings of Mupas that Unas’s testimony is uncorroborated and that the latter is not a credible witness.
Brillantes said he does not agree that Unas’s statement should be corroborated since it was only him, Arroyo and Ampatuan that were in the said incident, where the supposed instruction from the Chief Executive to rig the poll results were given.
Aside from backing Unas, Brillantes also noted that they will enhance their line-up of witnesses that will stand in the trial on the merits of the case.
Still, he instructed the Comelec law department to hasten the filing of motion for reconsideration over the decision to allow Arroyo to post bail.

Insider needed for wounded Supreme Court—Justice Abad

A wounded Supreme Court may need one of its own—not an outsider—to lead in the healing process.
Associate Justice Roberto Abad told the Judicial and Bar Council (JBC) on Wednesday that the ouster of Chief Justice Renato Corona had damaged the high tribunal.
“We have a wounded court after the impeachment trial,” the 68-year-old Abad said on the second day of the nationally televised hearing to choose Corona’s successor.
One of the senior justices of the Supreme Court, Abad said that if he were chosen Chief Justice, he would begin the process of reconciliation.
“You cannot have healing without forgiveness,” he said under questioning by Representative Niel Tupas, the much-criticized head of the House prosecution team.
Tupas said he thought the impeachment was a healthy exercise because it allowed the prosecution team to elicit evidence against Corona during his trial, referring to the statement of assets, liabilities and net worth that a senator-judge, Franklin Drilon, drew from a Supreme Court witness.
Presidential spokesperson Edwin Lacierda said Abad’s statement was a “sales pitch from an insider,” dousing speculation that a senior justice at the helm of the high tribunal over the short term could defuse the debilitating fallout from the ouster of Corona.
“Are we prepared to accept the premise that it is a wounded court? From the point of view of the executive branch, I think we reformed (the Supreme Court). It is the first step in judicial reform. So, we don’t necessarily follow that it is a wounded court. In fact, it’s part of our advocacy for reform,” Lacierda said.
Also interviewed Wednesday were Associate Justice Arturo D. Brion, Election Commissioner Rene Sarmiento, veteran lawyer Rafael Morales, former University of the Philippines law dean Raul Pangalangan and retired Bulacan Judge Manuel Siayngco.
2 disqualified
The JBC announced Wednesday that it had disqualified former Immigration Commissioner Rufus Rodriguez and private lawyer Vicente Velasquez as nominees for their failure to comply with documentary requirements, cutting the number of nominees to 20.
Six nominees, including Justice Secretary Leila de Lima, were interviewed on Tuesday, leaving eight more to undergo questioning. The council is expected to recommend a short list of three candidates from which the President will chose the country’s 24th Chief Justice.
Abad said that while he was appointed by then President Gloria Macapagal-Arroyo to the high court, he said he had voted against her, pointing out that he was among the minority who upheld President Benigno Aquino’s executive order creating the Philippine Truth Commission. The order was declared unconstitutional.
He also said he joined the Masses expressing support for Corona during his impeachment trial and that he visited him when he was hospitalized after his testimony in the Senate in May for hypoglycemia, a dizziness spell symptomatic of a diabetic. “I’m a person who does not discard a friend when he is in trouble,” he said.
Abad dismissed Tupas’ suggestions that the Supreme Court under Corona was bedeviled by factionalism. “Even when the Chief Justice takes a position, he loses a lot of cases,” he averred.
Graft and corruption
Brion, 65, acknowledged that the Supreme Court was hobbled by perceptions of graft and corruption and inefficiency.
Corruption is not only purely a judiciary problem but a societal problem, he said. “There are a lot of very ‘clean’ ones in the judiciary,” he said, adding that the problem of corruption must be addressed by the three branches of government working together.
Brion admitted that the backlog of cases, some pending for as long as 10 years, was a “serious problem” that contributed to the erosion of public trust in the judiciary.
“Our old cases are frightening. You’ll get an asthma attack just by opening (the files),” he said.
Morales and Pangalangan told the JBC that their experience made them capable of being at the helm of the high tribunal.
With 37 years in legal practice and 15 years as law professor, Morales said he was “willing, ready and able to go to public service.”
Morales, 61, said that if he were appointed Chief Justice, his priorities would be to fill up vacancies in the judiciary which he described as “undermanned,” raise salaries to attract more people and work for the increase of the budgetary allocation of the judiciary.
“I will approach each of the justices and appeal to their sense of patriotism and extend their cooperation to me in the interest of the country and the judicial system.”
Changes since ouster
Pangalangan, 53, noted changes in the judiciary since Corona’s ouster.
“Just to show the effect of the impeachment trial: Had it not been for that event, no outsider will be even sitting before the JBC to be considered for this office. No outsider would have the nerve to accept the nomination because it’s too much of a burden … but because of those events, here we are,” he said.
Sarmiento shrugged off allegations that he was involved in cheating in the 2007 senatorial elections in Mindanao, saying he had been cleared by Commission on Elections Chairman Sixto Brillantes and the justice secretary.
Asked why he was vying for the Chief Justice position, he said this would be a “big chance to serve the country,” adding that the job called for not only “a visionary but a leader and CEO, an all-out and all-seasoned public servant.”
Sarmiento said he had practiced law for the past 26 years, handling criminal, civil and labor cases.
On his independence, he said he had given dissenting opinions on six to seven cases, including one involving Juan Miguel “Mikey” Arroyo, a son of former President Arroyo, as head of the party-list group Ang Galing Pinoy. He said he did not believe Mikey was a representative of security guards in the country.
“I stopped dreaming of a promotion in the Court of Appeals and Sandiganbayan after six attempts,” Siayngco told the council. He said contending for the post of chief magistrate would be a chance for him to show “moral integrity, probity, independence.” He said the chief magistrate “should also have a heart that bleeds for the miseries of the people.”
“I do believe that I have that from my experience as a lower court judge,” Siayngco said.

Palace, Comelec caught off-guard by Arroyo bail

Like the rest of the country, Malacañang was taken aback by the decision of Judge Jesus Mupas of the Pasay City Regional Trial Court (RTC) granting the petition for bail of former President and now Pampanga Representative Gloria Macapagal-Arroyo.
However, presidential spokesperson Edwin Lacierda lost no time in passing the buck to the Commission on Elections (Comelec), which filed the case for electoral sabotage against the former President on Nov. 18, 2011.
“It’s Comelec that filed the case, not us,” Lacierda said in a briefing at the Palace.
The Comelec said it would ask Mupas to overturn his ruling.
“We will file a motion for reconsideration if it’s not too late because we know that the order is immediate and executory,” said Comelec Chairman Sixto Brillantes Jr.
He acknowledged that he was not expecting the decision of the court but expressed confidence that the case would prosper.
He said the “setback” was merely on the bail petition and not on the main case.
“It’s OK. The fight is not over yet. There is still a trial on the merits of the case,” said the Comelec chief.
Also caught off-guard by Mupas’ ruling, Justice Secretary Leila de Lima said she would meet with Brillantes and the panel of the Comelec and Department of Justice (DOJ) to discuss the government’s next move.
“I’m going to discuss that with Chairman Brillantes and we will see what remedy we can do. Of course we did not expect it. If the bail was granted there’s only one meaning: the judge was not convinced that the evidence was strong. But of course, we disagree. We will look at the basis of his decision and we will take the appropriate remedy,” De Lima told reporters.
“We are of the different view that even if there’s only one witness who pointed at the former President, for us it’s enough. Because when Unas [the government’s lone witness] testified, he really stood pat on his testimony that he himself heard the instruction of the former President to former Governor Ampatuan to rig the 2007 elections,” she said.
PCSO plunder case
Lacierda also invoked the separation of powers between the executive and judiciary to explain the unfortunate turn of events for the 2-year-old Aquino administration, which has made the prosecution of Arroyo the centerpiece of its anticorruption drive.
Lacierda said the executive branch had no control over the workings of the judiciary.
Although its most prominent detainee is now out on bail, the Aquino administration still vowed that the “fight against corruption continues.”
Lacierda cited the plunder case recently filed by the Office of the Ombudsman against Arroyo in the Sandiganbayan in connection with the misuse of P366 million in funds of the Philippine Charity Sweepstakes Office (PCSO).
“And that’s the reason why there is a PCSO case still in the Sandiganbayan. This will not dampen our resolve to file and to continue to institute corruption cases against responsible officials,” he said.
Reconsideration
He said the election body could not understand why Mupas of the Pasay RTC Branch 112 granted Arroyo’s petition for bail on the electoral sabotage filed against her involving the senatorial elections in Maguindanao in 2007.
“I really don’t get it why Judge Mupas granted the petition when no evidence whatsoever was presented. [Arroyo’s] camp also didn’t even reply or rebut the statements of our witnesses during the bail hearing,” Brillantes said.
While maintaining that the Comelec has a strong case against Arroyo, allowing her to walk out of hospital detention would somehow “imperil” its bid to make the former President accountable for the allegedly rigged 2007 balloting.
“The judge might be saying that the evidence is weak and so we need to get more,” Brillantes said.
Lone witness
Norie Unas, the election supervisor of Maguindanao during Arroyo’s term, is the Comelec’s main witness.
During a hearing on Arroyo’s petition for bail last month, Unas claimed that Arroyo had instructed then Maguindanao Governor Andal Ampatuan Sr. to deliver a 12-0 vote in Maguindanao in favor of Team Unity senatorial candidates during a meeting in Malacañang two weeks before the elections.
Hold order
The Senate blue ribbon committee chairman, Teofisto Guingona III, and other senators said they were at least consoled by the fact that when the Office of the Ombudsman lodged the plunder charge against Arroyo et al. in the Sandiganbayan, a hold-departure order (HDO) was immediately issued against the former President.
Senator Francis Pangilinan said the HDO would at least assure the people that Arroyo remained in the country to face the charges against her.
Guingona agreed, noting Arroyo’s “propensity to invent reasons to justify her grand plan to leave the country and escape prosecution for her crimes.”
The Sandiganbayan said there was no legal impediment yet that would require Arroyo’s detention.
“There is no conflict since the Sandiganbayan has not issued any warrant of arrest (against her),” Sandiganbayan’s executive clerk of court and spokesperson Renato Bocar said in an interview.
He said a warrant of arrest may be issued only after the determination of probable cause in the pending cases against Arroyo in the Sandiganbayan.
Blame game
Senator Panfilo Lacson blamed the DOJ and Comelec for the ill-prepared electoral sabotage complaint that he believed forced Mupas to grant bail to Arroyo.
“Bail posits the existence of a weak electoral sabotage case filed by the DOJ and Comelec. One lesson learned here is—we cannot build up a strong case through press releases and media interviews,” he said.
Senator Antonio Trillanes IV also blamed the DOJ for not ensuring the protection of witnesses who could have bolstered the “hearsay testimony” of Unas.
But Senator Aquilino Pimentel III, poster boy of the 2007 electoral fraud victims, said he could not blame Mupas for his decision to grant bail.
“Since there was only one witness against her, an alleged eyewitness, then the grant of bail means that the judge isn’t convinced that the evidence (against Arroyo) is strong,” Pimentel said.
“I respect the judge’s decision and it’s a good sign that the judicial processes are working in our country,” he added.
A big slap
In the House of Representatives, Bayan Muna Representative Teodoro Casiño said the granting of Arroyo’s petition for bail was “a big slap on the face of President Benigno Aquino, who had been actively campaigning against his predecessor.
In his State of the Nation Address on Monday, Mr. Aquino “boasted of his administration’s efforts to hold Arroyo accountable for her crimes.”
Former President Joseph Estrada criticized the “rush” with which the electoral sabotage case against Arroyo had been filed.
“That only goes to show that the prosecution did not study the case very well,” Estrada told the Philippine Daily Inquirer in a phone interview.

Palace pushes for Human Security Act amendment

MALACAÑANG has urged Congress to amend the Human Security Act of 2007 to further strengthen government efforts in fighting and defeating terrorism.
Speaking to participants of the 7th Asean-Japan Counter-Terrorism Dialogue in Cebu City on Wednesday, Executive Secretary Paquito Ochoa Jr. said a proposed bill seeking changes to the anti-terror law is one of the key measures the Executive branch has asked lawmakers to prioritize, as part of its global commitment to counter terrorism.
“The goal of these amendments is to strengthen the law so that it can be used as a tool by law enforcement agencies to thwart terrorism,” Ochoa said.
He said although the capability of terror organizations has waned and the number of militants has decreased, the world must still keep its vigilance because the threats of terrorism remain.
As part of the administration’s contribution to the global response to terrorism threat, President Benigno Aquino III has signed last week two laws – An Act to Further Strengthen the Anti-Money Law and the Terrorism Financing Prevention and Suppression Act of 2012.
Ochoa said the said laws aim to boost domestic capability in identifying and preventing financial transactions related to illegal activities and those that undermine global security.
He said the government has put in place a three-pronged strategy to combat terrorism within the Philippine borders, which is aligned with the frameworks adopted in other countries.
These steps include: Effective law enforcement by strengthening the regulatory regimes for firearms and explosives and financing terrorism, and the arrest and neutralization of the human tools or perpetrators behind terrorist acts; Stronger institutional mechanisms and enhanced capabilities of law enforcement agencies and security agencies, and active participation in international cooperation against terrorism; and De-radicalization or counter-radicalization of the intent to commit terror acts by addressing poverty and poor education, which are considered roots of the problem.
“In these initiatives, you are guaranteed of the support of our President who recognizes the importance of addressing the threat of terrorism and is aware that a holistic approach to the problem will produce positive results,” Ochoa said.
Meantime, the Executive Secretary lauded Japan and Asean member-states for taking the lead in organizing the dialogue on counter-terrorism to put forward the implementation of joint projects in transport security, border control and immigration, maritime security, public involvement in countering terrorism, and capacity building on legal affairs.
“Without a doubt, all of the nation-states here possess the political will to defeat terrorism; all of us want to secure borders and ensure the safety of our people,” he said.
“What is necessary is improved counter terrorism capacity, and this is where efforts like this dialogue is crucial,” he added.

CJ nominees live interview won’t factor in Aquino’s decision-making

LIVE interviews of the candidates for the next Chief Justice will not affect the decision-making of President Benigno Aquino III, a Malacañang official said Wednesday.
“The President will base his decision on the constitutional requirements as provided by the Charter and that would be his sole basis for making a decision,” presidential spokesperson Edwin Lacierda said.
He noted that while there are some nominees who might become popular after the live interview conducted by the Judicial and Bar Council (JBC), the decision as to who should sit as next Chief Justice is still with the President.
“It’s not a Filipino Idol form,” Lacierda said.
He said the Chief Executive has no time to watch the live panel interview, which started a day after his third State of the Nation Address (Sona) on Monday.
Aquino has until August 27 to appoint the successor of former Chief Justice Renato Corona, who was ousted by the Senate impeachment court last May 29 due to culpable violation of the Constitution and betrayal of public trust.
The first six aspirants interviewed by the JBC on Tuesday were Presidential Commission on Good Government (PCGG) Chairman Andres Bautista, lawyer Soledad Cagampang-de Castro, Justice Secretary Leila de Lima, De La Salle University law founding dean Jose Manuel Diokno, Solicitor General Francis Jardeleza and women’s rights lawyer Katrina Legarda.
Interviewed on Wednesday were Supreme Court Associate Justices Roberto Abad and Arturo Brion, lawyer Rafael Morales, former University of the Philippines law dean Raul Pangalangan, Elections Commissioner Rene Sarmiento and retired Bulacan judge Manuel Siayngco Jr.
The JBC will finish the interview on all 20 candidates for the top judicial post on Friday.
Lacierda said he is certain that the JBC interview will not influence the President’s decision in the event the three names are submitted to him.
He said the President will still conduct his own interview with the persons who will be included in the JBC’s shortlist.
Senator Edgardo Angara said the JBC should look beyond the political affiliations of candidates and focus instead on other qualifications.
“We ought not to stigmatize the person because of his relationship to the appointing power. If you review the appointment of chief justices in the country, many were political appointees but many of them turned out to be outstanding choices,” he said.
Angara, a former president of the Integrated Bar of the Philippines, said whoever will be appointed must have wide experience in handling court cases and in dispensing justice.
“The next Chief Justice must be upright and above all visionary – a person who can see the problems of our country beyond his own tenure,” he said.

JBC member: SC justices don’t have the edge

MANILA — Incumbent justices of the Supreme Court may not necessarily have the upper hand in the race to be the next Chief Justice despite being familiar with the workings of the judiciary, a member of the Judicial and Bar Council (JBC) said Wednesday.
“Even the aspirants who are outsiders said that all things being equal the insider has an inside track but then again we’re saying that could be outplayed by other factors that might be considered,” academe representative Jose Mejia told reporters.
Associate Justice Roberto Abad, who kicked off the second day of public interviews, did not hide his preference for a fellow magistrate to lead the High Court, whose image severely tarnished by the ouster of then Chief Justice Renato Corona on May 29.
Abad, who will turn 70 in 2014, said President Benigno Aquino III should choose among the six nominees from the Supreme Court to succeed Corona because doing otherwise would mean a case of mistrust.
“If later on, he turns out to be mediocre, a show-off, lazy, ineffective, he has to commit an impeachable offense to get him out and you would have then bound the country to a Chief Justice for 20 years. So that is why I have a bias for insiders, not necessarily myself,” he said.
Besides Abad, nominated from the Supreme Court are Senior Associate Justice Antonio Carpio and Justices Presbitero Velasco Jr., Teresita Leonardo-De Castro, Arturo Brion and Maria Lourdes Sereno.
But law professor Rafael Morales, another nominee to the post, said only an outsider can help regain public confidence in the judicial system.
“The first step towards that is for the President to appoint an outsider who will give a fresh and impartial approach to the judiciary. I bring the perspective of an academic, and my managerial skills are an edge,” he said.
The 62-year-old Morales said he will bring with him 37 years of legal experience and administrative skills being the current managing partner of the noted Sycip Salazar, Hernandez and Gatmaitan law firm.
Among his priorities if named as top jurist are the following: fill up vacancies for trial judges, swift resolution of cases, shorter decisions, beef up research staff, higher budget for the judiciary and increase salaries for judges and court staff.
Retired Bulacan judge Manuel Siayngco Jr. said his spiritual foundations and experience as judge will help him do the job.
“It’s not only moral integrity, probity, competence and independence that should be the characteristics of the next chief justice, he should also have a heart that bleeds with the miseries of our people but also rejoices for their victories,” he said.
Talking about his edge over other nominees, Raul Pangalanan said “the luxury of a professor is that he can have a broad view of things.” The former University of the Philippines law dean was once involved in making changes to the format of Bar examinations.
The face of a Pangalanan court, he said, would be a court that spoke a clear voice and brought colleagues together in most important issues.
Charter Change
During the grilling, candidates were also asked about their position on the proposal by leaders of Congress to revisit the 1987 Constitution to accommodate changes in the alleged restrictive economic provisions.
Abad, Associate Justice Arturo Brion and Elections Commissioner Rene Sarmiento cited the cap on foreign ownership of corporations that could be changed. They said the move will help invite more investments that could bring jobs to the people.
Senate President Juan Ponce-Enrile and House Speaker Feliciano Belmonte Jr., proponents of Cha-Cha, earlier called for the relaxation of the 40-percent limit on foreign ownership in the exploration, development and utilization of natural resources.
Malacañang has been cool to the proposal, which was validated last Monday when President Benigno Aquino III never mentioned anything about it in his third State of the Nation Address (Sona).
Sarmiento, who was one of the framers of the Constitution, is in favor of a constituent assembly to approve the changes in the Charter but both houses of Congress should vote separately.
If appointed, Abad said he will extend the hand of reconciliation to the President and Congress following a divisive Corona impeachment trial.
“We have a wounded court. The way I look at it, if I become Chief Justice, the first thing to do is to forgive. There is no healing if there is no forgiveness. I hope the President will forgive us also and the legislature and we can reconcile,” he said.
Abad agreed the impeachment trial has not been in any way clipped judicial independence saying it is Congress’ job to initiate removal cases against constitutional officers.
The magistrate, however, criticized the “indecent” preparation of the complaint against Corona, whom he considered as a close friend.
Scheduled for interview Thursday are University of the East law dean Amado Valdez, former Ateneo de Manila law dean Cesar Villanueva and Associate Justices Carpio and De Castro.

SBMA gives bigger space for special school

SUBIC BAY FREEPORT – The Subic Bay Metropolitan Authority (SBMA) recently signed an agreement with the Quiz Bee Early Learning Center, giving it bigger facilities to address the school’s rapid growth.

The Quiz Bee Early Learning Center is run by the Quiz Bee Foundation, which is the proponent of the annual National Quiz Bee, a prestigious scholastic competition participated in by some of the brightest students in the country.

The SBMA agreed to give the school the rights to lease Bldg. 1154, located on Palm Street at the Gateway Park here, to provide more room to accommodate 50 students.

SBMA Chairman Roberto V. Garcia and Gloria Palarca-Tayag, president of the Quiz Bee Foundation, signed the lease agreement.

The school previously occupied four rooms at Charlie Bldg. of the Subic International Hotel within the free port’s central business district, but continuous growth in its enrolment necessitated a bigger venue, said Gloria Linda Tayag, the school directress.

Tayag said that they immediately grabbed at the opportunity to relocate when the SBMA offered them the building.

Tayag also said that the relocation would help the school attract more students, since it will be able to provide them with better learning environment.

She added that the Quiz Bee Early Learning Center will give residents in the Subic Bay area an alternative institution where their children can avail of quality education.

“Our school promotes quality academics and values formation, and we are at par with the existing schools here in the Freeport in terms of quality, but not as expensive,” she noted.

The school was founded in 2010 with 15 students. It now offers pre-school courses up to Grade 3.

DINALUPIHAN, Bataan- Masuwerteng walang grabeng nasugatan matapos magbanggaan ang dalawang mala-higanteng oil tanker sa kahabaan ng Roman Superhighway sa Balanga City, Biyernes ng gabi.

Wasak ang dalawang sasakyan at kailangan pa ang isang malaking wrecker upang itabi ang mga ito at hindi makasagabal ng matagal sa daloy ng nagsikip na trapiko.

Bumalabag sa highway ang ulo ng isang tanker na papunta pa lamang upang magkarga ng krudo sa oil depot sa Mariveles. Nagmistulang hugis siyete na wasak ang unahan at ibang bahagi nito.

May mga yupi at gasgas sa tagiliran at hulihang bahagi naman ang kasalubong na oil tanker din na kargado at pauwi na sa Angeles City.

Tanging si Feliciano Raparos ng Nueva Ecija, driver ng naghugis-7 oil tanker, ang nasaktan at ginamot sa Bataan General Hospital sa Balanga. Nakalabas na rin siya sa ospital bagama’t iika-ika sa paglakad.

Ayon kay PO2 Alfad Jumiri, Balanga City police investigator, dalawang tanker na magkasunod ang papunta sa Mariveles. Nang magpreno ang nauunang tanker, nagpreno rin ang kasunod na minamaneho ni Raparos.

“Sa pangalawang pagpreno ni Raparos, umi-slide ang tanker dahil madulas ang daan at nag-siyete at nakabanggaan ang kasalubong na oil tanker,” sabi ni Jumiri.

Kinumpirma ni Raparos na sa pangalawang pagpreno ay umi-slide ang sasakyan niya dahil sa dulas ng kalsada at nakabanggaan niya ang kargadong tanker na minamaneho naman ni Joiny Manaloto ng Tarlac.

“Mistulang nagbulagaan ang dalawang oil tanker at hindi nakaiwas sa isa’t-isa,” sabi ni Darwin Pulaan, pahinante ni Raparos.

OMB conducts lightning raid at Dinalupihan public market

DINALUPIHAN, Bataan- Agents of the Optical Media Board on Friday afternoon conducted a lightning raid and hauled sackloads of pirated CDs and DVDs from some stalls at the public market in Dinalupihan, Bataan.

The raid was so quick. The agents came and left at the wink of an eye so to speak.

Sacks of pirated stuff were loaded in a waiting vehicle that immediately sped away.

NBI nabs Fontana golf exec

CLARK FREEPORT – A top executive of the Fontana Golf Club Inc. here was arrested Friday by government agents for alleged falsification of public documents, authorities announced Monday.

Kwang-Rae Jo, chairman and president of Fontana Golf Club Inc., did no resist when apprehended in his office by agents of the National Bureau of Investigation-Central Luzon Regional Office (NBI-Celro) headed by Atty. Ric Diaz.

Diaz said Kwang-Rae was arrested on the strength of warrant of arrest issued by Judge Ruben Hilario, of Municipal Trial Court of Clarkfield, 3rd Judicial Regional, Angeles City.

Kwang-Rae, according to sources is charged with falsifying a Statement of Management’s Responsibility which he submitted to the Bureau of Internal Revenue (BIR) and Securities and Exchange Commission (SEC).

“Kwang-Rae made it appear in the Statement that the Board of Directors of the Fontana Golf Club Inc. reviewed the financial statement before it was submitted for approval by the stockholders,” said the source, a member of the Fontana Golf Club Inc.

Diaz said his men served the warrant of arrest against Kwang-Rae at FA Korea Golf and Country Club situated along Prince Balagtas Avenue, Clark Freeport Zone here.

Kwang-Rae, being a Korean, reportedly admitted that the Board of Directors did not review the financial statement. He was said to have signed the documents without fully understanding its content.

“The Korean signed the documents even though he didn’t understand the content as he hardly understands English,” said the source adding the documents were written in English and not in Korean.

Kwang-Rae was held overnight at the NBI-Celro office in the City of San Fernando and was released on order of the court after posting P12,000 cash bail bond.

The release order was issued and signed by Regional Trial Court (RTC) Judge Omar Viola. A copy of which was furnished to NBI-Celro.
