MANILA (Updated 9:50 a.m.) — Senator Francis Escudero is open to the idea of giving up his seat in the Judicial and Bar Council (JBC) after the Supreme Court ruled last week that only one member of Congress should sit in the body.
The JBC is a constitutional body tasked to screen and submit a shortlist of nominees from which the President will make appointments to vacant judicial posts, including the position of Ombudsman.
Saying he has no plans of clinging to the post that allows him to screen nominees for the next Chief Justice, Escudero said insisting on the post may only affect the credibility of the JBC.
“Prudence is the better part of valor sometimes. I will also follow whatever decision the Senate, House and Congress as a whole will come out in regard to this matter,” Escudero, chairman of the Senate committee on justice and human rights, told radio dzBB.
While this admission did not automatically mean he would resign before the JBC grills candidates on Tuesday, the lawmaker said he will continue to do his duties alongside counterpart Iloilo Representative Niel Tupas Jr.
Tupas earlier said he might appeal the decision soon even as the leaderships of the House of Representatives and the Senate have yet to tackle the option.
Escudero presented at least three choices as to how Congress can fulfill its role in the multi-sectoral council, namely: term sharing, alternately sitting in the body at any given point in time and half a vote each in decisions.
The Supreme Court had already junked the idea of employing half vote each to the representatives of Congress after it agreed with the arguments presented by former Solicitor General Francisco Chavez, a previous nominee for top magistrate.
According to the decision penned by Associate Justice Jose Mendoza, the JBC was designed to have seven members only, thus “any inclusion of another member, whether with one whole vote or half of it, goes against that mandate.”
“Section 8(1), Article VIII of the Constitution, providing Congress with an equal voice with other members of the JBC in recommending appointees to the Judiciary is explicit,” the decision read.
Escudero has been a member of the JBC since 2008.

MALACAÑANG slammed on Saturday critics of the government’s conditional cash transfer (CCT) program and the universal health insurance for allegedly being “myopic” for linking those projects to 2013 elections.
In an interview over dzRB Radyo ng Bayan, presidential spokesperson Edwin Lacierda wondered why the Aquino administration has been accused of politicking whenever it has been pushing for social programs to alleviate the lives of the Filipinos.

“It’s very saddening. Who is engaged in politicking? Why do the militants usually look on politics?,” he said, referring to allegation of Gabriela Representative Luz Ilagan that the distribution of 5.2 million health insurance cards worth P12 billion for the poorest of the poor households would be for the 2013 polls.
He said CCT and health insurance programs of the government are for the people.
“Can they (militants) not distinguish what is politics and what is for the people? We are serving the people. Our promise is we are going to alleviate poverty,” Lacierda said.
“Our friends from the left seemed to be myopic,” he added.
He said the basis for selecting the beneficiaries of the health insurance and the CCT programs was the National Household Targeting System and not politics.
“This is based on the National Household Targeting System where we are able to identify the poorest of the poor. And we’re using this particular survey on CCT (program) and on PhilHealth (insurance),” he said.

MANILA — Mindanao, which currently has the lowest ratio of paved roads to overall road infrastructure among the country’s regions, is now set to get a larger allocation from the National Government’s proposed annual budget for infrastructure.
Secretary Rogelio Singson of the Department of Public Works and Highways (DPWH) announced this at a roundtable discussion among business leaders and senior officials on Mindanao infrastructure policy held recently at the Traders Hotel.
“Sixty-nine percent of national roads in Mindanao are unpaved. Mindanao has the lowest paved road ratio. It is clear that Mindanao should get a bigger share of the budget,” Singson said.
Under the proposed 2013 budget, Mindanao will receive P27.62 billion, or 26.1 percent of the national infrastructure budget, up from P20.4 billion the previous year.
Infrastructure budget allocations for the other regions are as follows: Northern Luzon – 24.1 percent; Southern Luzon – 20.4 percent; National Capital Region – 14.6 percent; and Visayas -19.4 percent.
“Our objectives are to improve the country’s attractiveness as an investment destination by enabling seamless connectivity, and to lower the costs of communication and transportation,” said Angelito Colona, Philippine Chamber of Commerce and Industry (PCCI) vice president for transportation and logistics, who attended the discussion.
Singson also noted the bottlenecks in implementing road infrastructure projects in Mindanao, including right-of-way and security issues, shortage of cement suppliers in parts of the region, practice of truck overloading that results in faster road deterioration, and the need to integrate ports and airports with road systems.
The meeting included a presentation by the Philippine Inter-Island Shipping Association, on issues affecting freight rates in domestic shipping, focusing on Mindanao.
The roundtable was part of the run-up to the 21st Mindanao Business Conference, or “MinBizCon,” which will be held August 2-4 in Butuan City.
The roundtable was organized by PCCI and the Mindanao Development Authority (MinDA) with support from the US Agency for International Development, through its Growth with Equity in Mindanao Program, which is implemented under the oversight of MinDA.
The highlight of the annual conference is the presentation of the Mindanao Business Policy Agenda to President Benigno Aquino III.
The formulation of the agenda began with broad-based regional policy consultations held in Mindanao’s major cities to identify and address bottlenecks that hold back trade and investment, and to clarify government rules, regulations and timelines.
Drawing on the outputs of these consultations, a draft policy agenda was compiled by MinDA in collaboration with PCCI. The draft listed the most urgent policy concerns, as well as required government actions and private sector commitments.
The regional consultations were followed by high-level roundtables focusing on specific sectors, including infrastructure, which were held in Manila on July 3-4 with MinDA and Cabinet officials and private sector representatives for a thorough review of the draft policy agenda, and for government to formulate appropriate responses. MANILA — A fishing banca with five fishermen onboard capsized off Palawan early Friday, the Philippine Coast Guard (PCG) said.
The PCG said the police reported that F/Bca Irish of 0.5 gross tonnages capsized due to rough seas and strong winds around 3 a.m. at about 4.5 nautical miles north of Fundeado Island in Palawan.
Coast Guard vessel MCS 3002 with seven special operation Unit personnel immediately proceeded to said area to conduct search and rescue operations.
All the five fishermen were eventually rescued and they were in good physical condition, the PCG said.
The fishermen were identified as Oscar Barnelio Lique, 53; Jason B Leonilo, 39; Juling Almoraje, 38; Bentot Bartolay, 30; and Julan Bartolan Leonilo, 37.

MANILA (4th Update, 4:15 p.m.) — The state weather bureau lifted Saturday afternoon all rainfall warning signals in Metro Manila but warned of occasional moderate to heavy rains due to Tropical Depression “Ferdie.
Earlier in the day, The Philippine Atmospheric, Geophysical and Astronomical Services Administration (Pagasa) hoisted red warning signal in the cities of Taguig, Mandaluyong, San Juan, Parañaque, Malabon, Navotas, Caloocan, Pasay, Pasig, Manila, Quezon City and Marikina due to heavy rainfall.
Hours later, the warning signal was downgraded to green.
Red warning signal is raised when rainfall recorded is over 30 millimeters (mm) per hour. Green alert is hoisted over areas where rainfall recorded is between 15 and 30 mm within one hour.
At 11 a.m. Saturday, Pagasa said Ferdie has crossed the Balintang Channel and merged with the low pressure area over the West Philippine Sea.
The tropical depression was located based on satellite and surface data at 130 kilometers northwest of Laoag City, with maximum sustained winds of 55 kilometers per hour (kph) near the center.
Ferdie is expected to leave the Philippine area of responsibility by Saturday night.
Three areas still remain under public storm warning signal number 1. These are Ilocos Norte, Ilocos Sur and Abra.
