League of Cities of the Philippines (LCP)

AN OFFICIAL of the League of Cities of the Philippines (LCP) declined to confirm Monday if a petition was filed with the Supreme Court seeking to nullify again the granting of cityhood status to 16 municipalities that allegedly failed to meet requirements set by law.
The justices already rendered their final ruling on the case in April 2011 but previous reports said the LCP will not back down from the fight.
Sun.Star tried to reach Mayor Hernani Braganza of Alaminos City, Pangasinan, in his capacity as LCP secretary general but failed as of this posting Monday.
Another source in the LCP, meanwhile, has to check first if the petition really exists.
“I’ll have to ask (our) legal (department) about this. I’ll try to respond the soonest,” the source said in a text message.
Voting 7-6, the High Court junked the LCP’s appeal to reverse its February 15, 2011 ruling favoring the cityhood of the following municipalities: Lamitan in Basilan, Baybay in Leyte, Bogo in Cebu, Catbalogan in Samar, Tandag in Surigao del Sur, Borongan in Samar, Tayabas in Quezon, Tabuk in Kalinga, Bayugan in Agusan del Sur and Batac in Ilocos Norte.
Completing the list are Mati in Davao Oriental, Guihulngan in Negros Oriental, Cabadbaran in Agusan del Norte, El Salvador in Misamis Oriental, Carcar in Cebu and Naga also in Cebu.
Those who concurred with the decision penned by Associate Justice Lucas Bersamin are then Chief Justice Renato Corona, Presbitero Velasco Jr., Teresita Leonardo-De Castro, Roberto Abad, Jose Perez and Jose Mendoza.
The dissenters are Associate Justices Martin Villarama Jr., Antonio Carpio, Maria Lourdes Sereno, Conchita Carpio-Morales, Arturo Brion and Diosdado Peralta.
Carpio, now the acting Chief Justice after Corona’s removal by the Senate impeachment court in May, wrote the November 18, 2008 decision that declared the cityhood laws passed in early 2007 as unconstitutional.
Associate Justice Mariano del Castillo and then retiring magistrate Antonio Eduardo Nachura abstained from the resolution of the issue, which has been ruled eight times since November 2008.
LCP president Oscar Rodriguez earlier said the justices failed to follow the revised Local Government Code (Republic Act 9009) to the letter.
Under the code, a municipality may be converted into a component city only if it meets two of three requirements: locally generated average income of P100 million for the last two years and contiguous territory of at least 100 square kilometers or a population of not less than 150,000 inhabitants.
One of these municipalities, El Salvador in Misamis Oriental, even failed to meet all the requirements for cityhood. El Salvador only has P17-million locally-generated income as of 2009, 87 square kilometers of area and 41,905 inhabitants.
Out of every peso in government taxes, 40 centavos will go to local government units as part of its IRA.
As a result of the ruling, the LCP feared its members will get a reduced share from the National Government, affecting the rollout of infrastructure projects and other social services.
Rodriguez, mayor of San Fernando in Pampanga, said last year his city stands to lose at least P27 million, while other cities such as Puerto Princesa, Valenzuela will be slashed by P100 million and P50 million in revenue allotments, respectively.
